CALPIA.

Bidders who are representatives of a manufacturer shall provide a signed letter of agreement from the manufacturer with their bid package, stating that the manufacturer agrees to provide CALPIA with any needed technical support.

The successful bidder shall have a minimum of five (5) years of experience in manufacturing ergonomic task chairs or as a representative of said manufacturer. Due to the significant challenges of working inside a correctional facility compared to a normal retail setting, the successful bidder shall also document that they have a minimum of three (3) years of experience working in a correctional industry setting as a manufacturer or representative of said manufacturer.

Bidders shall provide a company profile, including number of years in business and verifiable company references within the last five years (minimum two, maximum five references). Bidders who are representatives of a manufacturer shall provide a company profile for both the

IFB #RW2421021 Page 6 of 11 manufacturer as well as their own company. Bidders shall provide documented quality control procedures that include receiving inspection standards.

Certified Test Reports (CTR):

Delivered products may be subject to additional testing to determine if delivered product meets specifications. If the delivered product doesn’t meet the specifications, CALPIA may terminate for default in accordance with General Provisions, Clause 75.

Contract Dollar Value:

Any contract resulting from this bid will expire three years from its effective date unless extended. However, in the event the ordering agency’s requirements are curtailed because of reducing requirements, cancellation of State programs, lack of fiscal appropriations, etc., the State shall be excused from purchasing any outstanding balances.

Quantities shown for each line item are estimated and are the anticipated contract purchase amount. The State will not be obligated to purchase the contractor’s excess inventory of any line item if actual purchases vary from the anticipated purchase pattern. The State reserves the right to order more or less of any line item.

Please Note:

Only bids quoted on the State’s own Cost Sheet will be considered. Bids submitted referencing supplier attachments, which include legal terms and conditions that conflict with the State’s general bid provisions shall be considered non-responsive and such bids shall be rejected. On the Cost Sheet if there is a discrepancy between the unit price and the extension price, the unit price shall prevail.

Corrective Action Plan:

Should there be any issue with quality and/or damage to the final product selected, CALPIA can request a written Correction Action Plan (CAP) from the Contractor. A CAP will be provided to CALPIA from the Contractor no later than three (3) business days from time that the incident is reported to the Contractor contact. The CAP will contain the nature of the reported issue, what immediate actions are taking place to correct the problem, and how the problem is going to be prevented from occurring again. The CAP can also contain any other relevant information that the Contractor feels is necessary to explain the situation. CALPIA may issue a vendor performance report based on the circumstances.

Cost to Cover:

Any failure to perform its obligations under a contract that ensues from this IFB by the contractor shall, in addition to any other remedies available to CALPIA, entitle CALPIA to recover from the contractor the difference between the contractor’s price and an alternate supplier’s higher price in the event that CALPIA chooses to pay an alternate supplier a higher price for goods or services that the contractor fails to provide in a timely fashion.

Delivery:

The items are to be delivered when and as requested within 30 calendar days after notification by the ordering agency, Monday through Friday, 8:00 a.m. to 2:30 p.m. Weekend or holiday deliveries cannot be accepted without prior approval in writing by ordering agency. Any single failure to deliver in a timely manner will be a material breach of this contract by the contractor.

It shall be the Contractor’s responsibility to obtain proper clearance for delivery drivers prior to any and all deliveries. Contact the institution listed for the driver clearance procedure.

All non-compliant products will be returned to Contractor at Contractor’s expense, and shall be replaced within 10 working days of notification to the Contractor by CALPIA.

CALPIA must be notified of any defective parts recall or Engineering Change Notifications (ECNs) affecting any current product in inventory or previous provided from contract implementation which may be deemed a safety issue (i.e. product safety recall).

If defective parts recall effects current inventory (i.e., creates obsolete parts), vendor will pick-up and credit CALPIA for any obsolete inventory and will provide time and labor to change out effected parts.

State agencies require that all suppliers certify the recycled content of all products offered or sold to the State. The State Agency Buy Recycled Campaign (SABRC) is a state mandated program that requires the reporting of all purchases made within 16 specified product categories. All state agencies are required to verify the recycled-content of all products purchased within each of these categories.

All businesses shall certify the minimum percentage in writing to the contracting officer or his or her representative, if not the exact percentage, of postconsumer recycled-content (PCRC) material in the products, materials, goods, or supplies offered or sold to the State regardless of whether the product meets the minimum content requirements specified in law (see reverse side). The certification shall be furnished under penalty of perjury. The certification shall be provided regardless of content, even if the product contains no recycled material. A State agency may waive the certification requirement if the percentage of postconsumer material in the products, materials, goods, or supplies can be verified in a written advertisement, including, but not limited to, a product label, a catalog, or a manufacturer or vendor Internet website.
