Method of Award:
This bid shall be awarded on an “All or None” basis to the bidder deemed by CALPIA, at its sole discretion, to offer the best value. BEST VALUE is determined by CALPIA alone, under statutory authority, considering the following criteria and depending on the specific needs of
CALPIA.
1. Cost: Fair, reasonable, and competitive price, expressed warranties, life cycle of product, and customer service commitments for goods and or services.
2. Performance: Past performance, including but not limited to the quality and/or reliability of the product or service as well as efficient billing practices; certification by the International Organization for Standardization (ISO).
3. Experience: Length of time and/or number of instances the bidder has offered or produced the requested type of product and/or service.
CALPIA may consider other factors deemed necessary to ensure that best value is achieved.
In the interest of achieving best value, CALPIA does not grant Small Business, Disabled Veteran Business Enterprise (DVBE), Target Area Contract Preference Act (TACPA), Local Agency Military Base Recovery Act (LAMBRA), or Enterprise Zone Act (EZA) preferences in evaluating bids. Employment of ex-offenders by the bidder is encouraged by CALPIA as part of our ongoing mission to change lives through opportunities.
Please note that no verbal information given will be binding upon the CALPIA unless such information is issued in writing as an official addendum to this IFB.
IFB #RW2401009 Page 3 of 6
Specifications:
All NFDM powder must meet California Department of Food and Agriculture (CDFA) guidelines for milk. All product sold to CALPIA under the ensuing agreement must be Grade A and rBST free.
Contract Dollar Value:
Any contract resulting from this bid will expire two years from its effective date unless extended.
However, in the event the ordering agency’s requirements are curtailed because of reducing requirements, cancellation of State programs, lack of fiscal appropriations, etc., the State shall be excused from purchasing any outstanding balances.
Quantity shown on the Contract Price Sheet (Exhibit 1) is estimated and is the anticipated contract purchase requirement. The State will not be obligated to purchase the contractor’s excess inventory if actual purchases vary from the anticipated purchase pattern.
Please Note:
Only bids quoted on the State’s own Contract Price Sheet will be considered. Bids submitted referencing supplier attachments that include legal terms and conditions conflicting with the State’s general bid provisions shall be considered non-responsive. Such bids shall be rejected.
Cost to Cover:
Any failure to perform its obligations under the contract by the contractor shall, in addition to any other remedies available to CALPIA, entitle CALPIA to recover from the contractor the difference between the contractor’s price and an alternate supplier’s higher price in the event that CALPIA chooses to pay an alternate supplier a higher price for goods or services that the contractor fails to provide in a timely fashion.
Emergency Extension Option:
In the event of an emergency, CALPIA, upon mutual agreement with the contractor, may extend the contract in various increments until the establishment of a new contract. The total term of the emergency extension shall not exceed one (1) additional year. The Emergency Extension Option may be exercised in the event that a replacement contract cannot be established due to the protest of Intent to Award, loss of key CALPIA procurement staff, or other circumstance that would otherwise cause an unanticipated disruption to production processes at the CALPIA Bakery Enterprise.
Minimum Order:
Minimum delivery or pickup of product on this contract will be one truckload with approximately 42,000 pounds of NFDM powder (approximately 765 bags-55# each) unless otherwise agreed upon.
Ordering Procedure:
CALPIA will issue a purchase order for NFDM powder on a quarterly basis with monthly drop shipments or pickups scheduled.
Prices and Invoice Procedure:
The Base Price will fluctuate as determined by the United States Department of Agriculture (USDA) California Marketing Area Federal Milk Order 51 Monthly Product Price Average for
IFB #RW2401009 Page 4 of 6
Nonfat Dry Milk. The Base Price shall be clearly identified on the supplier’s invoice and shall be taken from the USDA price in effect for the date on which the delivery is to occur. See Attachment A for an example of USDA Federal Milk Order No. 51.
The fixed Service Charge amount quoted on the Contract Price Sheet (Exhibit 1) will be the fixed amount needed to cover any overhead, freight, or other costs incurred by the contractor in conjunction with supplying product to CALPIA. Note that only the fixed Service Charge rate will be shown on the Contract Price Sheet.
The Service Charge stated on any contract resulting from this IFB shall be firm for the first year of the contract unless otherwise approved by CALPIA. After that, the Service Charge may be adjusted upon mutual agreement of CALPIA and the contractor. Any adjustment for increase or decrease shall be based on documented changes to the contractor’s costs. The contractor may request a new Service Charge by submitting the proposed contract changes prior to the month that the change would become effective.
Invoicing Requirements:
The contractor is to render invoices as instructed on individual orders. Invoices shall include the purchase order number, the contract number, the item number, the unit price, and the extension price. With each invoice, the contractor shall submit a copy of the applicable portion of the most recent USDA California Marketing Area Federal Milk Order pricing to substantiate the invoiced base prices. Invoices submitted without the attached report will be delayed until such documentation is provided.
Freight on Board (F.O.B.) Point:
For the purpose of this bid, only bids quoting F.O.B. Destination will be accepted. Bids quoting other than F.O.B. Destination will be rejected. The Service Charge must include the cost of shipping; additional charges for shipping will not be paid.

Product delivery will be one truckload delivered approximately once a month, with the option to buy more if needed. CALPIA may also schedule one of its own trucks to pick up the product from the contractor’s site if feasible. Any single failure to deliver or provide in a timely manner will be a material breach of this contract by the contractor.
A packing slip must be included with each shipment showing the contract number and an accurate description of the item, weight, quantities, etc.
