4. SCOPE OF WORK

4.1 General

Provide a complete, functional, code-compliant ADA restroom addition/renovation at the DSS building. “Turnkey” means the contractor shall coordinate and provide all work reasonably inferable from the Contract Documents and necessary for a complete installation, whether or not each incidental item is individually listed.

4.2 Minimum Work Elements

• Preconstruction coordination, field verification, layout, protection of occupants and existing property, and required temporary controls.

• Selective demolition and lawful removal and disposal of demolished materials.

• Framing, blocking, backing, drywall or other wall assemblies, patching, and finish work.

• Plumbing rough-in and finish installation, including accessible fixtures, trim, shutoffs, connections, testing, and required modifications to existing systems.

• Electrical work, including wiring, lighting, switching, receptacles, controls, connections, and testing as required by the approved design and code.

• Mechanical ventilation and associated ductwork, controls, power, penetrations, and exterior termination as required.

• Accessible door, hardware, clearances, grab bars, accessories, signage, fixture mounting heights, turning space, and other accessibility components.

• Flooring, base, wall and ceiling finishes, sealants, primers, and paint suitable for a commercial restroom environment.

• Firestopping, patching, touch-up, cleaning, start-up, demonstrations, closeout documentation, warranties, and correction of punch-list items.

4.3 Contract Documents and Design Information

The work shall conform to the drawings, specifications, sketches, and addenda listed below. The County should attach or expressly identify the design documents before advertisement so that all bidders price the same work.

[INSERT TECHNICAL SPECIFICATIONS, IF ANY] N/A

Written addenda issued for this IFB As issued

4.4 Existing Conditions and Coordination

The building may remain occupied during construction. Coordinate shutdowns, deliveries, noisy work, utility interruptions, and access with the County. Maintain safe access for staff and the public, protect existing finishes and systems, control dust and debris, and secure the work area. No shutdown or impairment of a building system may occur without advance County approval.

4.5 Hazardous or Unforeseen Conditions

Do not disturb suspected asbestos-containing material, lead-based paint, mold, or other hazardous material unless the Contract Documents specifically assign that work. Stop affected work, protect the area, and promptly notify the County.

Concealed conditions materially differing from those reasonably observable shall be reported before disturbance and addressed only through written direction or an executed change order.

IFB No. 2026-9 #3 | Page 4 of 16

4.6 Permits, Codes, and Inspections

The contractor shall obtain and close out all permits and inspections required for the work and shall comply with the Virginia Uniform Statewide Building Code, applicable accessibility standards, OSHA requirements, and all other governing requirements. Bid pricing shall include permit and inspection costs unless the County expressly states otherwise by addendum.

4.7 Submittals and Closeout

• Provide product data, color/finish selections, shop drawings, and samples requiring approval before purchase or installation.

• Provide a baseline schedule within 10 calendar days after Notice of Award and update it when requested.

• At closeout, provide final inspection approvals, warranties, operating information, product data, keys, and marked-up record information applicable to the completed work.

5. CONTRACT TIME AND SITE OPERATIONS

The bidder shall state the proposed number of calendar days from Notice to Proceed to Substantial Completion and Final Completion on the Bid Form. The County’s desired completion requirement is 30 Days from Notice to Proceed. Work hours shall be coordinated with the County and shall not interfere unreasonably with DSS operations.

Substantial Completion means the restroom is complete, code-compliant, inspected, operational, and available for its intended use, with only minor punch-list work remaining. Final Completion includes correction of all punch-list items and delivery of all closeout documents.

The Contractor shall pay the County liquidated damages in the amount of One Hundred Dollars ($100.00) for each calendar day that Substantial Completion extends beyond the Contract Time, as adjusted by any duly authorized written change order.

The parties acknowledge that actual damages resulting from delay would be difficult to determine accurately and that the stated amount represents a reasonable estimate of the County’s anticipated damages and is not intended as a penalty.

The County may deduct liquidated damages from amounts otherwise due to the Contractor. Assessment of liquidated damages does not prevent the County from exercising any other rights or remedies available under the Contract or applicable law.

6. BID PRICE AND PAYMENT

The lump-sum bid shall include all costs necessary to complete the work, including labor, materials, equipment, supervision, overhead, profit, freight, delivery, mobilization, permits, taxes not legally exempt, insurance, cleanup, and incidentals. No additional compensation will be due for work reasonably inferable from the Contract Documents.

Payment will be based on properly documented invoices for work satisfactorily completed and accepted. Before the first payment request, the contractor shall provide a schedule of values acceptable to the County. The County may withhold payment for defective or incomplete work, unresolved claims, missing documentation, or other grounds permitted by the contract or law. Final payment is contingent on Final Completion and receipt of required closeout materials.

7. BID EVALUATION AND AWARD

The County will review bids for responsiveness and bidder responsibility. In determining responsibility, the County may consider licensure, financial and technical capacity, relevant experience, past performance, safety record, ability to meet the schedule, references, and compliance with the solicitation.

Award, if made, will be to the lowest responsive and responsible bidder. The County reserves the right to reject any or all bids, waive informalities, request clarification, verify information, and cancel or reissue the solicitation when in the County’s best interest and permitted by law. The County may conduct pre-award discussions or request evidence supporting responsibility, but it will not permit a bidder to alter the substance or price of its bid except as allowed by law.

8.6 Changes

Only a written change order signed by authorized representatives of the County and contractor may change the contract price, time, or scope. The County may terminate the contract for default after written notice and a reasonable opportunity to cure, subject to the urgency and nature of the default. The County may also terminate for convenience by written notice and will pay for conforming work completed and reasonable, documented demobilization costs through the effective termination date, but not anticipated profit on unperformed work.

8.11 Order of Precedence and Entire Agreement

The final contract will consist of the County’s written agreement or purchase order, addenda, this IFB, drawings and specifications, the accepted bid, and approved change orders. In the event of conflict, subsequently executed change orders and addenda govern, followed by the written agreement, technical requirements, this IFB, and the bidder’s submission. Bidder terms that conflict with County terms are rejected unless expressly accepted in writing by the County.
