Topic: Public Bid Opening, IFB 25-0203943.1 Time: May 5, 2026, 2:00 PM Pacific Time (US and Canada) Join: https://teams.microsoft.com/meet/294265770834742?p=odgzEEXlGXsagQbGyi Meeting ID: 294 265 770 834 742 Passcode: sr9Qd2Cd

mailto:amber.massey@state.ca.gov https://teams.microsoft.com/meet/294265770834742?p=odgzEEXlGXsagQbGyi

A deviation from a requirement is considered material if deviation is not in substantial accord with the IFB requirements, provides an advantage to one bidder over other bidders, or has a potentially significant effect on the delivery, quantity or quality of items bid, amount paid to the supplier, or on the cost to the State.

An error in the final bid may cause the rejection of that bid; however, CDT may at its sole option retain the bid and make certain immaterial corrections, including obvious clerical errors. CDT reserves the right to reject any and all bids for reasonable cause. CDT is not required to award a Contract.

Bids that contain false or misleading statements, or assumptions, or which provide references, which do not support an attribute or condition claimed by the bidder, may be rejected. If, in the opinion of CDT, such information was intended to mislead CDT in its evaluation of the bid, and the attribute, condition, or capability is a requirement of this IFB, it will be the basis for rejection of the bid.

As part of the evaluation process, Customers listed on Attachment 3, Customer Reference Survey, may be contacted and/or interviewed to verify the answers given on the Customer Reference Survey.

IFB submittals responsive to all requirements will have their costs evaluated. The required cost form will be checked for mathematical accuracy and for compliance to the Prevailing Wages, as applicable. If it is determined that costs are below the Prevailing Wage Rates, as applicable, the Bidders Response will be deemed non-responsive and will be rejected.

The total amount on Attachment 2, Cost Worksheet will be used to determine the lowest net cost to the State after applying any preferences or incentives (See Section 3 for more information on preferences and incentives).

The CDT reserves the right to make mathematical corrections to cost worksheets and/or ask clarifying questions.

In the event of a tie, CDT shall utilize a tie breaker to determine the winning Bidder. The tie breaker may be determined based on which bidder has the most SB and DVBE participation identified in the bid package. In the event of equal SB/DVBE participation, each bidder will be contacted by the CDT regarding a date and time for a flip of a coin. The Bidder whose bid was received first will make the call. Bidders or their authorized representative(s) are allowed to be present for the flip of the coin.

10. NOTICE OF INTENT TO AWARD

Award of contract, if made, will be to the responsive and responsible bidder providing the lowest net cost to the State after application of any preferences and/or incentives (See Section 3 for preference/incentive information) within forty-five (45) days after the scheduled date for Contract Award as specified in the IFB.

Written notification of the State’s intent to award will be issued to all Bidders and posted publicly on Cal eProcure (https://caleprocure.ca.gov/pages/index.aspx), CSCR, IFB Event Page (Event ID 0000039003). If a Bidder, having submitted, can show that its response, instead of the selected response, should be selected for contract award, Bidder will be allowed five (5) working days to submit a Notice of Intent to Protest, according to the instructions contained in the paragraph titled “Protests” of this IFB.

Under very specific circumstances, after identifying the low bidder/first-ranked bidder, and before issuing Notice of Intent to Award, CDT may decline to award a contract to the low bidder/first-ranked bidder upon a finding that the low bidder/first-ranked bidder is not “responsible” under the statutorily based standard and as interpreted by case law.

Under these circumstances, CDT will not proceed with an alternative award. In accordance with law and policy, CDT will provide the low bidder/first-ranked bidder with due process including notice of https://caleprocure.ca.gov/pages/index.aspx the specific documented reasons that bid is not responsible and provide the Bidder with a meaningful opportunity to be heard and to refute those reasons.

11. PROTESTS

Any Bidder’s issues regarding solicitation requirements must be resolved (or attempts to resolve them must have been made) before a protest may be submitted according to the procedure below.

These issues will first be resolved by the contact for the solicitation or if they result in a protest, the protest will be submitted to DGS Office of Legal Services to hear and resolve issues and whose decision will be final.

If a Bidder has submitted a response which it believes to be responsive to the requirements of the IFB and to be the response that should have been selected according to the evaluation procedures in the solicitation and Bidder believes the State has incorrectly selected another Bidder for award, Bidder may submit a protest of the selection as described below. Protests regarding selection of the “successful vendor” will be heard and resolved by DGS Office of Legal Services whose decision will be final.

All protests of award must be made within the five (5) calendar days the Notice of Intent to Award is posted, a detailed written statement of protest which shall include the IFB number, the name of the State agency, and the agency contact person. Include the reason(s) for protest; citing the law, rule, regulation, or procedure on which the protest is based. The protester must provide facts and evidence to support the claim.

Protests must be submitted to both the following:

SECTION 3 – SOCIO-ECONOMIC PREFERENCE/INCENTIVE PROGRAMS

1. INTRODUCTION

This Section describes socioeconomic and environmental programs established by State law and further defined by regulations and policies to increase business opportunities to small and disabled veteran businesses and those businesses operating in economically distressed areas of the State.

SB and/or DVBE firms must be certified by the State of California, Department of General Services (DGS), Procurement Division (PD), Office of Small Business and DVBE Services (OSDS).

Certified Reporting Requirements apply to SB/DVBE preference and incentive programs as described in General Terms and Conditions (GTC, 2/2025), 19., Small Business Participation and DVBE Participation Reporting Requirements.

2. DVBE PARTICIPATION REQUIREMENT

WAIVED

3. SB PREFERENCE AND NON-SB SUBCONTRACTOR PREFERENCE PROGRAMS

The following information shall apply to both Small Businesses (SBs) and Microbusinesses (MBs).

Bidders shall note that for the purposes of this IFB, the OSDS SB certification of “SB-PW” (public works) may be used to fulfill the SB/Non-SB Preference Program(s).

3.1. SB Preference

A five percent (5%) small business preference will be granted to Bidders certified as “Small Business” in accordance with Section 1896 et. seq., Title 2, California Code of Regulations (CCR). Certification must be provided by OSDS.

If claiming the SB Preference, include your OSDS number and the required information as directed in the bid documents.

For award based on low price, the preference is applied by reducing the bid price by the five percent (5%) preference as computed from the lowest responsive and responsible. The preference is used only for evaluation purposes and does not alter the amounts of the actual bids. The maximum SB preference allowed may not exceed $50,000 per bid. In combination with any other preferences (TACPA, recycled, etc.), the maximum limit of the combined preferences is 15% of the bid amount and, in no case, more than $100,000.00 per bid, whichever is less.

A certified SB may only be displaced by another certified SB with a higher percentage of DVBE participation resulting in a lower adjusted bid price.

3.2. NON-SB SUBCONTRACTOR PREFERENCE

In accordance with Government Code (GC) Section 14838(b)(1)(2), the application of the five percent (5%) small business bidding preference is extended to a bidder whose business is not certified as a small business but commits to subcontracting at least twenty-five percent (25%) of its net bid price to businesses that are California certified small businesses and/or microbusinesses performing a commercially useful function.

If requesting the Non-SB Subcontractor Preference, Bidder must indicate as directed in the bid documents and the GSPD 05-105, Bidder Declaration and certify participation indicating a minimum of 25% of the net bid price to OSDS Certified SB firms. The preference is used only for evaluation purposes and does not alter the amounts of the actual bids.

For award based on low price, computation of the five percent (5%) preference is identical to the above description. However, a Non-SB may not displace a certified SB.

4. DVBE INCENTIVE PROGRAM

This program is separate from the DVBE Requirement. The incentive is designed to encourage bidders to partner with DVBE subcontractors and is made available to bidders regardless of DVBE participation requirements.

A DVBE Incentive will be granted to Bidders in accordance with Section 999.5(a) and (d) of the Military and Veterans Code (M&VC) and 2 CCR Section 1896.98 et. seq.

If requesting the DVBE Incentive, Bidder must indicate as directed in the bid documents and the GSPD 05-105, Bidder Declaration and certify participation by subcontracting a minimum one percent (1%) and a maximum of five percent (5%) of the net bid price to OSDS Certified DVBE firms. The incentive is used only for evaluation purposes and does not alter the amounts of the actual bids.

For award based on low price, incentive is applied by reducing the bid price by the amount of incentive as computed from the lowest responsive and responsible bid price (not to exceed $100,000). The computation is for evaluation purposes only and does not include the SB preference; however, the SB preference may be applied and may affect the application of the incentive and the outcome of the ranking.

Application of the incentive shall not displace an award to a certified SB. When applying the DVBE Incentive program, bidders claiming the “Non-SB Preference” are considered a non-small business.

For contracts to be awarded based on low bid, the incentive amount is equal to a percentage of the lowest responsive and responsible bid based on the amount of DVBE participation in the bid being evaluated (see table below).

Confirmed DVBE Participation DVBE Incentive Amount for IFB

5% or more 5% of lowest responsive and responsible bid

4% - 4.99% 4% of lowest responsive and responsible bid

3% - 3.99% 3% of lowest responsive and responsible bid

2% - 2.99% 2% of lowest responsive and responsible bid

.01% - 1.99% 1% of lowest responsive and responsible bid

5. COMMERCIALLY USEFUL FUNCTION

For purposes of meeting or exceeding the DVBE participation requirements and/or participating in the preference/incentive programs using subcontractors, Bidders shall ensure listed subcontractors perform a Commercially Useful Function as defined in the Military and Veterans Code (M&VC) section 999.9 and GC section 14842.

Contractor shall request the substitution in writing to CDT and receive approval from both the CDT and DGS in writing prior to the commencement of any work by the proposed subcontractor or supplier. A DVBE subcontractor may only be replaced by another DVBE subcontractor. Changes to the scope of work that impact the DVBE subcontractor(s) identified in the bid or offer and approved DVBE substitutions will be documented by contract amendment.

If for this Contract, Contractor made a commitment to achieve the DVBE participation goal, CDT will withhold $10,000 from the final payment, or the full final payment if less than $10,000 until the Contractor complies with the certification requirements above. A Contractor that fails to comply with the certification requirement shall, after written notice, be allowed to cure the defect. Notwithstanding any other law, if, after at least 15 calendar days but not more than 30 calendar days from the date of the notice, the prime contractor refuses to comply with the certification requirements, CDT shall permanently deduct $10,000 from the final payment, or the full payment if less than $10,000.

A person or entity that knowingly provides false information shall be subject to a civil penalty for violation (M&VC § 999.5(d); GC § 14841).
