About this file

This document is an Addendum to Invitation for Bid (IFB) #10204303 issued by the California Department of Water Resources (DWR). The Addendum revises the original Scope of Work for the laboratory testing of soil samples on an as-needed basis. The services will be performed at the contractor's and/or subcontractor's place of business, located within 40 miles of DWR's Bryte Soils and Concrete Laboratory. The contractor will be required to perform a variety of laboratory tests, including consolidated undrained triaxial compression, one-dimensional consolidation, direct shear, and others, using ASTM and Caltrans test procedures. DWR may perform quality assurance and control of the contractor's testing to ensure compliance with standards.

The contract will be paid on a per test basis, with an hourly rate for additional services such as travel, consultation, and report preparation. No overtime rates will be accepted, and the contractor is responsible for adequate staffing and reporting. Travel costs outside of the 40-mile radius will be compensated, but the state will not cover per diem or other overnight travel expenses.

6. Additional Services. Due to the on-call nature of this project, it is anticipated that other services and equipment related to the testing and inspection of construction materials may be required. The Contractor will provide these services at an appropriate cost which has been agreed upon by the Department on a case-by-case basis. No additional services or equipment will be provided without specific approval in writing from the DWR Contract Manager.

7. Quality Control of Testing by DWR Staff. DWR may perform quality assurance and control of the Contractor’s execution of laboratory tests to verify compliance with ASTM test standards without notice to the Contractor as necessary. No deviations to ASTM tests will be allowed without prior approval by the DWR Contract Manager.

8. Sample Delivery. Samples will be delivered to the contractor’s laboratory for testing by a DWR courier, by a delivery service, or the Department may request that the samples be picked up by the Contractor.

9. Reporting Requirements. For laboratory testing, results will be transmitted to the DWR

Project Engineer’s Manager after tests are performed. Informal reports will be provided to the DWR Manager upon request. A formal report will be submitted at the completion of each work order by the agreed upon completion date indicated on the Work Order. The formal report will contain the date, location, type, and results of each test performed, and it will comply with the reporting requirements specified within the appropriate ASTM standards.

10. Applicable Laws and Regulations. All work provided by the Contractor will conform to the latest requirements of Federal, State, City and County regulations. The Contractor will be responsible for compliance with all applicable laws, codes, rules, and regulations in connection with work performed under this agreement.

11. Safety. The Contractor will be responsible for accident prevention and safety, and for the protection of persons and property in relation to the testing and inspection services being provided and those areas under their control.

12. Contract Pay Items. The total amount to be paid by the State under this contract will be the sum of the total moneys earned for each of the contract pay items listed in the Bid Sheet. The total amount will not exceed the amount stated on the face sheet of the standard agreement or any amendments thereto. Payment of said total amount by the State will constitute full compensation for all work required by these Specifications.

Moneys earned for each of the contract pay items are separated into two categories: (1) an hourly rate pay item which applies to additional services including approved travel time, time to prepare weekly type written reports; and (2) laboratory test pay items which apply to performing specific laboratory tests (Items 1-33).

13. Laboratory Test Pay Items (Bid Item No.s 1-33). Payment for laboratory tests will be based on a per test basis. Rates for performing each laboratory test includes all labor, equipment and overhead associated with setting up the laboratory test, performing the laboratory test, clean up after the laboratory test, report preparation for the laboratory test, and calculations associated with the laboratory test. Aside from additional services such as approved travel and preparing the weekly type written report, no hourly rate will apply towards work associated with performing laboratory tests.

14. Hourly Rate for Additional Services (Bid Item No. 34). Travel between the Contractors place of business and the Bryte Soils and Concrete Laboratory will not be compensated.

Costs for travel time outside of this, including travel to project sites, will be paid based on the Contractor’s office and the elapsed mileage using an average travel rate of 50 miles per hour. The costs to be paid for travel will be the unit price per hour for additional services (Bid Item No. 34). As an example, the Contractor needs to travel to Oroville Dam to collect samples. The distance between Oroville and the Contractor’s office is 75 miles each way, or 150 miles total. Assuming 50 miles per hour, this would require 3 hours of travel time. The contractor would be able to charge 3 hours of travel time at the unit price for additional services. Costs for contract administration, consultation, and preparing the type written reports to the DWR Contract Manager will be paid the unit price per hour. The number of hours for these services will be determined in the work order. Additional hourly charges beyond the agreed upon hours in the task order must be requested in writing and approved by the DWR Project Engineer prior to beginning any additional work on a project. The written request must clearly state the special conditions that justify additional administration, consultation, and reporting charges. The state will not accept overtime rates for these services. It is the responsibility of the Contractor to adequately staff projects and prepare reports without the accumulation of overtime. Note that the hourly rate determination is not dependent on the number of Contractor staff. The State will not be responsible for Per Diem or other costs related to overnight or long-distance travel. Any incurred Per Diem costs will be paid by the Contractor without compensation by the State.
