About this file

This is an Indian Health Service (IHS) Buy Indian Act Indian Economic Enterprise Representation Form used for solicitations, sources sought notices, and Requests for Information (RFI). The form serves as a self-certification document that allows offerors to represent whether they meet the definition of an "Indian Economic Enterprise" (IEE) as defined under 25 U.S.C. 47 and HHSAR 326.601.

Offerors must maintain Indian Economic Enterprise status at three critical points: when submitting an offer, at the time of contract award, and throughout the entire contract performance period. Any loss of eligibility requires immediate written notification to the Contracting Officer. The form requires the offeror to provide the name of the Federally Recognized Tribal Entity, the name of the 51% owner of the IEE firm, business name, UEI SAM number, and a certifying signature. Offerors must be registered in the System of Award Management (SAM). False or misleading information submitted in connection with Buy Indian Act set-aside or sole source awards violates 18 U.S.C. 1001 and is subject to criminal penalties. False claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. Individual Contracting Officers may require documentation of eligibility before award, and successful offerors may be subject to protest regarding their eligibility status. The specific solicitation referenced is 75H70926BAO-026 for Pest Control Services, dated February 12, 2026.
