About this file

This is an Indian Health Service Buy Indian Act Indian Economic Enterprise Representation Form used by the Department of Health & Human Services to verify offeror eligibility for set-aside or sole source contracting opportunities.

The form serves as a self-certification document that offerors must complete when responding to Sources Sought Notices, Requests for Information (RFI), or solicitations under the Buy Indian Act authority. Offerors must certify whether they meet the definition of an "Indian Economic Enterprise" with Indian Ownership as defined in HHSAR 326.601. Enterprises must maintain eligibility status at three critical junctures: at the time an offer is submitted, at contract award, and throughout the entire contract performance period. Any change in eligibility status requires immediate written notification to the Contracting Officer. The form requires offerors to provide the name of the Federally Recognized Tribal Entity, the 51% owner of the Indian Economic Enterprise firm, business name, Unique Entity Identifier (UEI) number, and a certifying signature from an authorized representative. The document emphasizes that false or misleading information submitted in connection with Buy Indian Act awards constitutes a violation of federal law under 18 U.S.C. 1001, with additional penalties for false claims during contract performance under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. Successful offerors must also maintain registration with the System of Award Management (SAM), and awards may be subject to protest if the eligibility of the successful offeror is questioned.
