About this file

This is an Indian Health Service (IHS) Buy Indian Act Indian Economic Enterprise (IEE) Representation Form, which is a self-certification document for businesses seeking to qualify for set-aside or sole source contracts under the Buy Indian Act. The form requires businesses to certify that they meet the definition of an "Indian Economic Enterprise" with "Indian Ownership" at three critical stages: when making an offer, at contract award, and throughout the contract performance period.

Key requirements include maintaining 51% ownership by an individual from a federally recognized tribal entity, being registered in the System of Award Management (SAM), and providing immediate written notification to the Contracting Officer if eligibility requirements are no longer met. The form emphasizes legal consequences for false or misleading information, with potential violations punishable under 18 U.S.C. 1001 and 31 U.S.C. 3729-3731. The document is issued by the Department of Health & Human Services, Indian Health Service, Division of Acquisition Policy, located in Rockville, MD.
