About this file

This is an Indian Economic Enterprise Representation Form issued by the Department of Health & Human Services Indian Health Service (IHS) Office of Management Services, Division of Acquisition Policy.

The form is a self-certification template used in response to sources sought notices, requests for information (RFI), or solicitations to verify that an offeror meets the definition of an "Indian Economic Enterprise" under the Buy Indian Act (25 U.S.C. 47) and HHSAR 326.601. The offeror must maintain eligibility status at three critical points: when the offer is submitted, at the time of contract award, and throughout the full contract performance period. Any loss of eligibility requires immediate written notification to the Contracting Officer. The form requires offerors to provide documentation of eligibility, and successful offerors must be registered with the System of Award Management (SAM). The form includes warnings that false or misleading information constitutes a violation under 18 U.S.C. 1001, with false claims during contract performance subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287.

The representation section requires the offeror to indicate whether it does or does not meet the Indian Economic Enterprise definition with Indian ownership. Required fields include the name of the federally recognized tribal entity, business name, 51% owner name, UEI SAM number, certifying signature, and printed name of the signatory.
