About this file

This is a template form for the Indian Health Service Buy Indian Act Indian Economic Enterprise Representation, issued by the Department of Health & Human Services, Office of Management Services, Division of Acquisition Policy.

The form serves as a self-certification document that offerors must complete to represent their status as an "Indian Economic Enterprise" (IEE) with Indian Ownership under the authority of the Buy Indian Act (25 U.S.C. 47). Offerors must meet the IEE definition at three critical points: when submitting an offer, at the time of contract award, and throughout the full contract performance period. Any changes in eligibility status during these periods require immediate written notification to the Contracting Officer. The form requires offerors to indicate whether they do or do not meet the IEE definition and must include the name of the federally recognized tribal entity, the 51% owner of the IEE firm, business name, UEI SAM number, and certifying signature with printed name. Contracting Officers may require documentation of eligibility before awarding set-aside or sole source contracts, and awards are subject to protest if the offeror's eligibility is questioned. All offerors must be registered with the System of Award Management (SAM). The form emphasizes that false or misleading information violates federal law and is punishable under 18 U.S.C. 1001, with false claims during contract performance subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287.
