4. Authority: FAR 8.405-6 (b)(1)
(b) Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer.
(1) Brand name specifications shall not be used unless the particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs
5. Justification Rationale:
The HBGB is responsible for maintaining a common software/hardware baseline to support the United States Air Force. It establishes a standardized cross-functional process for responding to warfighters’ urgent needs identified during conflict or crisis situations that are life-threatening or impede a near-term critical mission. In order to maintain the integrity of the HBGB infrastructure, the HBGB has identified the purchase of the Oracle server, storages, Brocade switches and maintenance support as the equipment required to support this effort. The required hardware has the capabilities to operate with the existing advanced computer systems that are configured to meet the exceptional needs of the HBG Division. The processor speeds, increased memory, extended warranties and abilities to install and run critical computer applications are equipment characteristics that aid in the required networking functionality of the HBGB. As a result of these characteristics, the requested server, storage and switches are technically acceptable with capabilities that support the HBG processes.
)The network system is currently utilizing similar switches, storages and Oracle servers as one of the computer hardware models to support their IT System. The required hardware is currently certified for use in the IT System certification documentation and is accredited within the accreditation baseline. HBGB engineers have evaluated technology from major server, switches and storage manufacturers and tested for compatibility with the communication infrastructure and Enterprise Architecture application requirements. These tests have established a set of criterion that must be met to ensure that the division maintains the integrity and operability of its network. The required equipment has met all criteria and security requirements.
The requested equipment is required to ensure consistency of the current configurations. At this time, HBG does not have a qualified replacement that can fit into their customized environment that will not limit, diminish, or cripple the agencies capabilities to deploy compatible functional servers, storages or switches to their current network. HGB continually review new hardware systems that could possibly reduce total system costs and life cycle sustainment costs. An acquisition of non-compliant equipment in HBG infrastructure is not mission effective and would cause an unacceptable degradation in network functionality. It would be very costly to the Government for system reconfigurations and certifications, leading to additional testing, training and cost to the government in redesigning the system architecture. For this reason, it is necessary for HBG to continue utilizing the required hardware until further studies are performed on alternative hardware. Therefore, no other brand name is acceptable to fulfill this requirement for the U. S. Air Force.
6. Contracting Officer Determination:
The Contracting Officer has determined that the anticipated cost to the Government for this acquisition will be fair and reasonable. Actions anticipated to ensure the reasonableness of the price will be accomplished with the procedures and criteria contained in FAR 8.404(d), as appropriate. Adequate price competition is anticipated to establish a fair and reasonable price. In addition, the Contracting Officer will use various price analysis techniques and procedures to ensure a fair and reasonable price. Examples of such techniques may include, but are not limited to: comparison of competitive published price lists, comparison of the proposed prices with the independent Government cost estimate, and comparison of proposed prices received in response to the request for quote, or any other reasonable bases.
7. Market Research:
Market research was conducted in accordance with FAR Part 10. Market research revealed there are several information technology products available commercially; however, these products cannot interface with the hardware and software that HBGB currently used. Market research determined that in the Oracle equipment is available in the commercial marketplace from multiple sources and multiple acquisition vehicles. In accordance with FAR Subpart 8.002(a)(1) Priorities for Use of Government Supply Sources the use of GSA Federal Supply Schedules in accordance with FAR Subpart 8.4 was researched for available sources. In performing market research on GSA Advantage, it was determined that there were several vendors authorized to sell Oracle hardware under this vehicle. A Request for Information (RFI) was issued on 04/29/13 to all vendors under GSA Schedule 70, SIN 132-8 and sufficient competition was identified.
8. Other Supporting Facts:
Based on the Sources Sought notice published in a-Buy, at least eight vendors have expressed an interest in this requirement. The interested vendors are listed below:
1. Sterling Computer Corp 5. Aprisa Technology LLC
| 2. New Tech Solutions Inc | 6. Teledon Solutions |
| 3. Dynamics Systems, Inc | 7. Iron Bow Technology |
4. Digital Consulting Services 8. BIAS Corporation Although only eight vendors expressed an interest, the RFQ will be issued to all vendors under GSA Schedule 70, SIN 132-8 to ensure receiving adequate competition.
9. Statement of Actions to Overcome Barriers to Competition:
HBGB is currently performing research to move towards an alternative other than the requested hardware. This research is ongoing and USAF engineering staff coordinates regularly with equipment manufacturers and vendors to keep current on technology. Additionally, vendor and trade magazines are scanned for new, open technologies that can satisfy future infrastructure requirements. However, in an effort to remove or overcome such a barrier to competition in the future, the USAF engineering staff will continue to conduct market research for new companies and products that could satisfy the government’s requirements.
10. Requiring Agency Certification:
I certify that the supporting data under my cognizance which form the basis for this justification are accurate and complete to the best of my knowledge and belief.
