Limited Sources Justification –ID09170056 - RC-R9-17-00102

LIMITED SOURCES JUSTIFICATION

Upon the basis of the following justification, I hereby approve the use of restricting consideration of the proposed contractual action pursuant to the authority of FAR 8.405-6.

JUSTIFICATION

1. AGENCY AND CONTRACTING ACTIVITY: [FAR 8.405-6 (c) (2) (i)]

Agency:

Department of Housing and Urban Development Federal Housing Administration 451 7th Street S.W.

Washington, DC 20410

Contracting Activity:

General Services Administration Federal Acquisition Service 50 United Nations Plaza San Francisco, CA 94102

2. NATURE/DESCRIPTION OF ACTION(S): [FAR 8.405-6 (c) (2) (ii)]

This justification approves the use of a FAR 52.217-8 clause to extend the term of the current BPA Call for approximately 16 weeks. The Government did not evaluate the pricing for the FAR 52.217-8 clause at the time of award. The Government issued BPA Order GSQ0917BH0037 under the single awarded BPA GS-09Q-17-BHA-0001 to KPMG LLP. The BPA Order ends on April 30, 2018. The approved extension is for a 16-week period and will avoid disruption to mission critical programs and activities that are currently underway at the Department of Housing and Urban Development, Federal Housing Administration.

3. DESCRIPTION OF SUPPLIES/SERVICES: [FAR 8.405-6 (c) (2) (iii)]

The contractor, KPMG LLP, will obtain assessment, update and/or corrective, maintenance, and administrative services of HUD Applications that reside in the HUD Technology

GENERAL SERVICES ADMINISTRATION

FEDERAL ACQUISITION SERVICE

50 United Nations Plaza

San Francisco, CA 94102

Environment. The effort includes ensuring that the HUD’s systems are fully compatible with current and planned systems in the HUD Infrastructure as outlined in the statement of work.

This BPA Call Order will help ensure that these systems in the HUD Infrastructure are/will be fully functional in relation to existing software elements and to existing operating environments within the HUD Infrastructure throughout the entire performance period of the contract.

The total estimated value of the proposed action is $680,262.80.

4. AUTHORITY AND SUPPORTING RATIONALE: [FAR 8.405-6 (c) (2) (iv)]

Under FAR 8.405-6(a)(1)(i)(B), KPMG LLP currently meets the requirement of “only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.” KPMG has the unique knowledge and background working with HUD on a daily basis, has the required staff, the specific technical expertise, and/or the required clearances. The primary factor supporting the request to extend services is to provide continuity of services to support this ongoing effort until the subsequent order is awarded. The new order is anticipated to be awarded before July 2018 and continuity until this period is essential. Only continued, uninterrupted support from the incumbent contractor can prevent a disruption to the current services.

In addition to these statements, this extension is being enacted by exercising FAR Clause 52.217- 8, which was included within the solicitation and resultant task order at time of award; however, the pricing of the option was not included in the total evaluated price of the price reasonableness evaluation.

5. REPRESENTATION OF THE BEST VALUE: [FAR 8.405-6 (c) (2) (v)]

The Contracting Officer will ensure that the rates set in BPA Order GSQ0917BH0037 are used for this extension IAW FAR 52.217-8. At the time of original award evaluation, although the amounts for the additional period were not evaluated, the original total evaluated price was considered the best value to the Government. Had the extension prices allowed for under the FAR 52.217-8 clause been included in the original evaluation, KPMG’s pricing would have been increased by an additional half-year value of their current term pricing, causing the best value determination result to be exactly the same.

6. DESCRIPTION OF MARKET RESEARCH: [FAR 8.405-6 (c) (2) (vi)]

Market research reveals that there are vendors that can perform these services, but in order to complete the new competition, an additional 16-weeks of service will be required under the current effort to avoid a break in service. Federal Acquisition Service (FAS) Region 9, Contracting Division expects to process the new contract award around July 2018.

7. ANY SUPPORTING FACTS: [FAR 8.405-6 (c) (2) (vii)]

None

8. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION: [FAR 8.405-6 (c)

(2) (viii)]

FAS Region 9, Contracting Division is in the acquisition planning stage for the follow on order, however the anticipated award date is July 2018 or sooner.

(Intentionally left blank)

9. TECHNICAL/REQUIREMENTS CERTIFICATION: [FAR 8.405-6 (c) (2) (x)]

I certify that the facts and representation under my cognizance which are included in this justification and which form the basis for this justification are complete and accurate.
