U.S. General Services Administration
Rocky Mountain Region Federal Acquisition Service Building 41 Denver Federal Center Denver, CO 80225
LIMITED SOURCE JUSTIFICATION
TO SUPPORT
DEFENSE HEALTH AGENCY FIELD ENTERPRISE (DHA-FE)
MULTIPLE-AWARD BLANKET PURCHASE AGREEMENT (BPA)
AND ORDER
1) Identification of the Agency:
General Services Administration (GSA) Region 08, Federal Acquisition Service Acting in support of: Defense Health Agency-Facilities Enterprise Branch (DHA-FE)
2) Nature and/or description of the action being approved
GSA FAS executed four (4) multiple-award Blanket Purchase Agreements from RFQ 1429714 to Facility Services Inc., (FSI), J&J Maintenance Inc. (J&J), Hospital Housekeeping Systems, LLC. (HHS), and Valiant Government Services Inc. (VGS) for a period of 10 years, September 30, 2020, thru August 31, 2021. Then, as a result of the BPA awards, two orders were awarded for Site 1, 711 HPW, to J&J and Site 2, 633rd Medical Group (Langley AFB), to HHS, for a base plus four option years, September 30, 2020, thru August 31, 2025.
This request is to obtain approval of a limited source justification to award a limited source contract for Site 2, 633 Medical Group, Langley AFB, VA, DHA-FE Medical Facilities Operations & Maintenance resulting from a Government Accountability Office (GAO) protest.
An immediate stay was issued to HHS in response to the protest on October 19, 2020. A limited source contract is needed immediately to ensure continuation of critical services to this medical facility serving over 40,000 active duty, military veterans, and families.
The limited source order will be awarded to GSA MAS Schedule contractor, Hospital Housekeeping Systems, LLC (HHS), 47QSHA20D000V. The order will consist of a combination of Contract Line Item Numbers: Firm Fixed Price (FFP) and Time and Materials (T&M).
3) A description of the supplies/services required to meet the agency’s needs (including the estimated value)
The DHA-FE BPA and the BPA order provided Whole Medical Treatment Facilities Operations and Maintenance Support Services. These critical facility maintenance services are in support of Department of Defense (DoD), Defense Health Agency (DHA) and the 633rd Medical Group.
The 633rd Medical Group requires contractor support for its hospital which is operational 24 hours per day and 7 days per week. These essential contracted support services are to perform preventative maintenance, corrective maintenance, and emergency maintenance services on
Limited Sources Justification DoD’s Defense Health Agency Field Enterprise both the facility and the facility’s operational equipment. In addition, kitchen maintenance repairs, grounds maintenance, Operations Maintenance Program Review on Real Property Installed Equipment (RPIE), and work reception desk services are provided. The Government does not have sufficient or qualified personnel to perform these critical services.
The limited source order will be for a period of 4-months with a one-day transition period, October 31, 2020, through February 28, 2021. The estimated 4-month value is $1,484,342.47.
4) The authority and supporting rationale, and if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
The limited source justification authority for this order is FAR 8.405-6(a)(1)(A), an urgent and compelling need exists, and following competitive procedures would result in unacceptable delays. This limited source award for four months of medical facilities operations and maintenance services are essential to ensure continued operation of the hospital that supports approximately 40,000 active-duty members, their families, and military veterans. To not award this limited source order for these critical services that provide the operations and maintenance of catastrophic and critical hospital equipment would put patients at risk and could result in serious injury or death and result in mission failure for the 633 Medical Group.
As previously stated, the 633rd Medical Group is an Air Force Hospital that supports a local patient population of approximately 40,000 active-duty members, their families, and military veterans. To assist in providing this support that includes pandemic response operations, the medical group requires a contractor that has documented proven technical staff and reliable past performance that can provide timely preventative and corrective maintenance to over 10,752 catastrophic, critical, and other types of real-property installed equipment.
HHS is a company that has proven technical abilities and the capacity and capability to provide these uninterrupted critical services. In fact, HHS’ documented past performance indicates that they have always had 100% compliance for preventative and corrective maintenance for catastrophic and critical equipment. This past performance record contributed to their DHA-FE multiple-award Blanket Purchase Agreement award and the subsequent order for Site 2, 633 Medical Group, which is now stayed.
HHS is prepared to assume responsibility and has the capacity to fulfill all of the requirements for the site upon award of this limited source bridge contract. HHS is accustomed to short notice timelines as demonstrated when awarded a task order to Keller Army Community Hospital, West Point, New York, a total of 134,000 square feet for the hospital and clinics, in which they interviewed the existing workforce, mobilized a new O&M Manager, negotiated with the out-going contractor for equipment and tools, prepared and submitted deliverables to take over full contract operations on day one of contract operations. Another example is HHS’ performance at DW McMillian Hospital which was a total of 151,000 square feet for hospital and clinics. Both of the aforementioned references stated HHS has provided exceptional and timely services. HHS’ past performance at these prior locations provides the confidence that HHS will successfully perform these services over this four month bridge contract.
633rd Medical Group requires a contractor, HHS, with the proven, documented ability to handle short-notice responses, a history of quality medical operations and maintenance performance, and demonstrated quality and reliable past performance to provide these uninterrupted critical services.
5) A determination by the ordering activity contracting officer that the order represents the best value consistent with 8.404(d)
A competitive best value award determination for the DHA BPA multiple awards was recently made for this requirement with competitive pricing and past performance. The BPA awards were based on best value to the Government utilizing trade-offs of non-price and price factors and the award of the two sites was based on the lowest price after the four multiple award BPA selections. HHS was determined as one of the MAS contractors to demonstrate best value to the Government. HHS will honor their recent competed rates for the work described in this bridge contract. The rates quoted did not exceed the rates on HHS’ MAS schedule that have been determined to be fair and reasonable by the MAS Contracting Officer.
Additionally, HHS provided discounts on the labor rates ranging from Based on the above facts, the DHA BPA Contracting Officer has determined that this limited source bridge order represents the best value to the government, is the best means to fulfilling this critical need, and is consistent with 8.404(d).
6) A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
No additional market research was conducted for this limited source bridge contract because of the immediate need to continue services and the market research is recent. Market research was conducted and documented, including multiple Requests For Information (RFI) and industry outreach, on the Government’s Point of Entry (previously known as www.fedbizops.gov) and GSA E-Buy (www.gsaebuy.gov), for the DHA BPA. These postings resulted in at least 19, and up to 30, interested small and large businesses responses. The Request for Quotation (RFQ) for the competitive action was released May 14, 2020, via the GSA E-Buy. The multiple-award BPAs and the orders were awarded on September 30, 2020. Given the recent market research and the ensuing competitive procurement, no additional market research was necessary.
7) Any other facts supporting the justification
This limited source contract will be for a 4-month period of performance to maintain continuity of operations while the GAO reviews the protest and issues a decision. The additional time allows for a transition period, to prevent any lapse in service as a result of the protest, should a decision not be rendered in favor of the Government.
The Government does not have the government staffing to provide these operations and maintenance facility functions. Building and equipment maintenance requires specialized experience and certifications to maintain the equipment. Without the technical support of the contract maintenance personnel, the hospital equipment would remain inoperable and noncompliant with applicable health and safety standards if a qualified contractor is not present to repair immediately. Patients would be at risk of suffering injuries or, possibly, death. These continued critical essential services are paramount to ensuring the government does not suffer any serious harm, reduces life and safety risks for personnel and hospital operations and contributes to mission success for DHA.
HHS is the MAS contractor and a current DHA BPA holder that has already been determined technically qualified, already started performance, is the best value, and is the lowest priced offeror to meet the Government’s requirement for performance of these services beginning on November 1, 2020.
8) A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services made.
There is no action the agency could have taken to remove or overcome this barrier that led to the restricted consideration because it resulted from the filing of a GAO protest. All MAS contractor holders were provided fair opportunity for the multiple award BPAs and the orders.
This limited source justification is only necessary due to the stay of performance in response to a timely GAO protest.
9) I certify that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief.
Joan A. Johnson Contracting Officer
GSA/FAS/R8
10) Certification by the technical requirements personnel that supporting data and rationale which form a basis for the justification have been certified as complete and accurate
I certify that this justification is accurate and complete to the best of my knowledge and belief.
Marvin Hsie Deputy, Sustainment Branch, DHA-FE
11) Final Approval I determine that circumstances under FAR 8.405(a)(1)(A) apply to this justification.
