JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
In Accordance With (IAW) FAR 6.303-2
1. Requiring Activity: United States Citizenship and Immigration Services (USCIS) 111 South George Mason Drive, Arlington, VA, 22204
Contracting Activity: General Services Administration, Federal Acquisition Service, Region 8, Denver, Colorado
2. This is a Sole Source approval to purchase from Viscount Systems, Inc. (VSI).
3. The requirement is for 4,500 (1,500 base, 1,500 option I, and 1,500 option II) sets of Freedom FICAM Licenses which include the software applications of Freedom FICAM, Freedom FICAM VeriCert, and the Freedom FICAM Alarm Management Software (AMS) manufactured by VSI. Each license is a lifetime license and includes Software Update Agreements (SUAs) and Software Support Agreements (SSAs) for an estimated total cost of $2.2M.
4. The statutory authority permitting other than full and open competition is 10 USC 2304(c) (1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1(a)(2)(ii)(A) and 6.302-1(a)(2)(ii)(B)
5. VSI’s Freedom FICAM system and licenses are the only products currently meeting USCIS’s Physical Access Control System (PACS) architecture using 13.02 topology and are the only products certified under the GSA Enterprise Physical Access Control System (EPACS). USCIS has accredited this topology for connecting the access systems to USCIS’s One NET IT network to enterprise the system nationwide. VSI’s Freedom FICAM Licenses are on the current GSA PACS Approved Product List (APL) and can be found at http://www.idmanagement.gov/approvedproductslist. Through existing contracts, USCIS has already begun the installation of VSI’s Freedom System at 30 sites. Also, as the manufacturer, VSI can provide the licenses at the lowest available price, eliminating reseller pass-through charges.
6. A FedbizOps announcement was not posted for this requirement. In accordance with FAR 5.202(a)(11), the proposed contract action is made under the terms of an existing contract that was previously synopsized in sufficient detail to comply with the requirements of 5.207 with respect to the current proposed contract action. The customer is currently procuring the VSI Freedom FICAM software through authorized Security Systems Integrators (SSIs) on an existing contract vehicle.
7. The anticipated cost to the Government will be fair and reasonable.
8. In August of 2012, USCIS conducted extensive research with the assistance of The Coleman Group to identify the most appropriate technology to implement for the Security Management of http://www.idmanagement.gov/approvedproductslist the agency. In the extensive study, it was found that VSI had developed the recommended technology to meet not only agency objectives but also requirements outlined by the Government for certification. As a result, installation of VSI’s system at USCIS sites has already begun.
Because a security solution was already selected and procured, market research for this requirement was focused on locating vendors that could provide VSI licenses. GSA conducted market research on reseller availability and pricing. In a search on GSA eLibrary, only one vendor on GSA schedules provided one of the VSI licenses. VSI does have SSIs that work closely with the Government to provide the requested licenses. However, excessive pass-through charges are applied when they are purchased through their SSIs. Additionally, USCIS can manage the software upgrades more effectively at the national level if they own licenses as opposed to leasing from the SSIs. As a result, market research indicated that purchasing the licenses from VSI is the most cost effective and efficient option for the Government.
9. In order to meet the security objectives and goals of the agency, the purchase of these licenses has become a high priority for USCIS. In order to upgrade the security systems of the agency, they require these specific licenses. With the current infrastructure already in place, VSI offers the only solution.
10. No other sources are available for this acquisition.
11. Due to the requirement for the licenses to work with the VSI system that is in place there are no actions that can take place to remove or overcome any barriers to competition.
12. The information contained in this justification for other than full and open competition is certified accurate and complete to the best of my knowledge and belief.
