Justification for an Exception to Fair Opportunity
1) Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for an Exception to Fair Opportunity.”
Procurement Office: General Services Administration (GSA) – Region 7, Federal Acquisition
Services (FAS), Acquisition Operations Division (AOD)
Agency: United States Air Force (USAF), 90 th
Information Operations Squadron (90 th
IOS),
Task ID: ID07150027, Modification 002 Description of Requirement: Additional Personnel to Accelerate Development of Training
Applications and to Expand Use and Availability of Cyber Simulation Center
Total Estimated Value of the Action: $6,595,742.82
Period of Performance (PoP): Remainder of Base Year and Two One-Year Option Periods
Contractor Name: CACI Inc. Federal
Procurement Vehicle: Alliant Government Wide Acquisition Contract (GWAC) Task Order
GS00Q09BGD0020 / GSQ0716BG0009
2) Nature and description of action being approved:
The 90 th
IOS was directed to accelerate development of several training applications from a three-year delivery point to a two-year delivery point and to expand the use and availability of the Cyber
Simulation Center. Work is within scope of current Task Order GSQ0716BG0009.
3) A description of the supplies or services required to meet the agency’s needs (including the estimated value):
This accelerated development schedule requires migrating the development process from manual email driven configuration management to industry best practices, using tools such as those provided by the
Defense Intelligence Information Enterprise (DI2E), including JIRA, Confluence, Fortify, Jenkins, and
Stash. External interfaces will be rebuilt as cloud based web services – well documented and reusable.
Stove pipe message standards and protocols will be replaced by industry standard Representational
State Transfer (REST) web-services and messaging protocols in a service-oriented architecture (SOA).
New rich internet applications (RIA) and single page web-applications (SPA) will utilize these services to provide new and enhanced user experiences. All proprietary components and outdated technologies will be replaced with industry proven technologies and frameworks providing the heavy lifting building blocks for producing high quality, test driven systems. Inclusion of standards such as Java EE, Javascript, and XML/JSON will result in high quality, reusable and platform independent components.
This reduces reliance on expensive licensed server technologies and replaces them with proven low cost alternatives. This shift to earlier delivery provides a system capable of more rapidly responding to analysis, testing, training, and certification requirements.
Thirteen new personnel, including ten Application Developers, are necessary to achieve the accelerated development schedule. In addition to the ten Application Developers, two additional labor types are required to handle the increased Quality Assurance tempo and the new formal program level documentation. Information security and timely testing and delivery of production software is best guaranteed with two qualified and experienced Quality Assurance Specialists versus as is presently accomplished as a part time job shared by the Program Manager and Senior Network Specialist; the Air
Force has directed this position be utilized. The Technical Writer position is no different; moving from an informal to a certified program of record requires 8-10 times the documentation and the Air Force also directed this position be utilized.
Additionally, the Cyber Simulation Center was directed to double its development, analyses, and event support capabilities to support more events and a larger user population. Four additional personnel, including two Applications Developers, one Network Specialist and one Voice/Data
Communications Engineer, are required. One new labor type, Voice/Data Communications Engineer, is required to specialize in the significantly increased voice and data communications engineering role previously administered part time by a network engineer.
Estimated value of this action is $6,595,742.82; $6,546,643.00 in labor and $49,099.82 for the additional .75% Contract Access Fee (CAF).
4) Identification of Statutory Authority Permitting a Fair Opportunity Exception:
FAR 16.505(b)(1)(i) requires the Contracting Officer to provide each awardee under a multiple award contract, a fair opportunity to be considered for each order exceeding $3,000 unless a statutory exception applies. The specific exceptions set forth in 16.505(b)(2) that preclude the fair opportunity process are listed below. The authority pertaining to this specific acquisition is marked accordingly.
______16.505(b)(2)(i)A) The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.
______16.505(b)(2)(i)(B) Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.
__X__16.505(b)(2)(i)(C) The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.
______16.505(b)(2)(i)(D) It is necessary to place an order to satisfy a minimum guarantee.
______16.505(b)(2)(i)(E) For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source.
_______16.505(b)(2)(i)(F) In accordance with section 1331 of Public Law 111-240 (15 U.S.C.
644(r)), contracting officers may, at their discretion, set aside orders for any of the small business concerns identified in 19.000(a)(3). When setting aside orders for small business concerns, the specific small business program eligibility requirements identified in part 19 apply
5) Supporting rationale (for the authority cited in 4) above) including a demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the exception cited. If the contracting officer uses the logical follow-on exception, the rationale shall describe why the relationship between the initial order and the follow-on is logical (e.g., in terms of scope, period of performance, or value):

The accelerated development schedule and expanded use of the Cyber Simulation Center discussed in paragraph 3 is for the requirement awarded to CACI Inc. Federal on December 16, 2015 under Task
Order GSQ0716BG0009. Task Order GSQ0716BG0009 was competed among all Alliant Industry
Partners. Four quotes were received; only two were determined to be technically acceptable. After evaluation of the quotes, the contracting officer determined that the Government was willing to pay a premium for the required services, and the quote provided by CACI Inc. Federal fully met the
Government’s requirements, presented little to no risk of unsuccessful contract performance, and offered the best overall value to the Government for successful accomplishment of the mission.
Therefore, it is only logical that CACI Inc. Federal perform the acceleration and expansion of work already under contract to them.
6) Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:
Under Task Order GSQ0716BG0009, CACI Inc. Federal proposed their Alliant Year 7 (May 1, 2015 through April 30, 2015) labor rates for the base, Year 8 (May 1, 2016 through April 30, 2017) labor rates for Option Year 1 and Year 9 (May 1, 2017 through April 30, 2018) labor rates for Option Year 2.
Alliant labor rates have been determined to be fair and reasonable at the contract level. CACI Inc.
Federal discounted its Alliant labor rates in the Base Period by 18.75%; 19.06% in Option Year 1; and
19.63% in Option Year 2. The labor rates for the Applications Developers and Network Specialist labor categories necessary for this additional work were previously awarded under GSQ0716BG0009.
The labor rates for the Quality Assurance Specialists and Technical Writer shall be in accordance with
CACI Inc. Federal’s Alliant labor rates and it is anticipated that CACI Inc. Federal will offer the same discounts as previously negotiated.
7) Any other facts supporting the justification:
CACI Inc. Federal has been performing these services for the Air Force for over 20 years. As a result of
CACI Inc. Federal’s experience and current support, the Contracting Officer has determined that no other vendor has the immediate resources and skilled personnel to support the accelerated development schedule and expanded use of the Cyber Simulation Center.
8) A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made:
The requirement for the accelerated development schedule and expanded use of the Cyber Simulation
Center was not known prior to award of Task Order GSQ0716BG0009. The Air Force determined the need shortly after the December 16, 2015 award. At this time, no additional work within this scope is forecasted; however, the need for additional work may be required if the Air Force Space Command
Program Objective Memorandum funding is approved. If/when this occurs and the Air Force requests the assistance of GSA, the determination to recompete the requirement or use an exception to fair opportunity will be made.
9) The contracting officer’s certification that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief:
The contracting officer’s signature on the Signature/Approval page evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief.
10) Evidence that any supporting data that is the responsibility of technical or requirements personnel (e.g., verifying the Government’s minimum needs or requirements or other rationale for an exception to fair opportunity) and which form a basis for the justification have been certified as complete and accurate by the technical or requirements personnel:
See Technical Representative’s signature on Signature/Approval page.
