2. Nature and/or Description of Action:

The mission of the is to function as an Echelon-Above- Corps multi-discipline intelligence unit. The Integrated Geo-Spatial Intelligence (GEOINT) Division is currently charged with providing timely and actionable information and intelligence support primarily to the U. S. Central Command (USCENTCOM), U.S. Special

Operations Command (USSOCOM), and Joint Special Operations Command (JSOC). The specific mission focus of this requirement involves Geospatial Enterprise TCPED Service (GETS) Systems and Application Support and development of new automated technical capabilities to satisfy the supported commanders’ stated requirements.

Task Order was awarded on 04 March 2011 with a base period of performance of 17 March 2011 to 16 March 2012, and four annual options for an additional performance. The Government exercised the Option to Extend Services, FAR 52.217-8, to extend the task order six (6) additional months; therefore, this task order currently expires 16 September 2016. The nature of this action is to secure authority to allow for continued contractor support by awarding a short-term bridge task order. The long-term follow-on task order was awarded on 16 June 2016; however, a timely Government Accountability Office (GAO) protest was received after award and a stay of performance was enacted. Therefore, this bridge task order will prevent a lapse in coverage until resolution of the protest to is made.

3. Description of Supplies or Services:

The contractor shall provide GETS Information Technology (IT) systems engineering and design, Web server development, and data base development and administrative support for a variety of programs and initiatives within the intelligence community.

4. Authority and Supporting Rationale

FAR 8.405-6(a)(1)(i)(C)– In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with (IAW) the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.

Previous task order was competitively solicited and awarded under GSA Schedule 70 (General Purpose Commercial Information Technology Equipment, Software, and Services), SIN 132-51 (Information Technology Professional Services). The Request for Quotes (RFQ) was released to all thirty-six (36) vendors whom responded to the Request for Information (RFI) issued during the market research phase. In response to the RFQ, four (4) vendors submitted timely quotes on 07 January 2011. As a result of the evaluation and best value determination, an award was made to MacB on 04 March 2011.

In October 2015, the Alliant GWAC was selected as the most appropriate vehicle for the follow-on task order due to an ODC requirement exceeding the micro-purchase threshold.

GSA issued a solicitation to all Allaint GWAC holders, on 21 March 2016, for the follow-on requirement to task order Award was made on 16 June 2016 after the quote evaluations and subsequent best value determination. A timely GAO protest was received on 24 June 2016, which required a stay in performance under the new task order until resolution of the protest. IAW FAR 33.104(f), GAO issues its recommendation on a protest within 100 days from the date of filing of the protest with the GAO. Therefore a decision on the protest is not expected until 03 October 2016; however, the requiring agency must account for unknown factors that could push the decision date back.

As a result of the protest, task order was extended until 16 September 2016 via the Option to Extend Services clause (FAR 52.217-8). Considering the anticipated GAO protest decision is not until October 2016, a short-term bridge task order is required to ensure there is not a lapse in coverage for this critical requirement. This short-term bridge is a logical follow-on to task order , which was awarded competitively under GSA Schedule 70, SIN 132-51. Therefore, the requirements of FAR 8.405- 6(a)(1)(i)(C) to limit sources has been met.

It is extremely important that the incumbent contractor (MacB) remain in place during this short-term bridge task order, as the support provided by this requirement is critical to the continued operations of and our national security.

5. Contracting Officer Determination – Best Value:

The cost estimate is derived from data obtained from MacB's GSA Schedule (GS-35F- 0275K) and the current task order managed by GSA/FAS/AASD. The ceiling labor rates under GS-35F-0275K have previously been determined fair and reasonable. Those ceiling rates, and previously awarded rates under task order , will be used as a basis for price analysis of this bridge task order.

6. Market Research:

Prior to extending task order the Government conducted market research to support the decision to extend services IAW FAR 52.217-8, determining the use of this option to be in the bests interests of the Government given the circumstances. A Request for Information (RFI) was posted to FedBizOpps on 05 February 2016 seeking interested contractors who could meet the PWS requirements without requiring a transition period.

It was determined that the incumbent was the only one capable of performing during the extension period without significant impacts to the Government’s mission through unacceptable delays in bringing a new contractor up to a fully operational performance level. IAW FAR 10.002(b)(1), the Contracting Officer (CO) may use market research conducted within 18 months before the award of any task order if the information is still current, accurate, and relevant. As such, the CO has determined the results from the market research conducted above to be current, accurate and relevant to the sole-source award of a short-term bridge task order under authority FAR 8.405-6(a)(1)(i)(C).

7. Other Supporting Facts:

The proposed short-term bridge task order would ensure continuation of services. The requiring activities minimum needs and required levels of service can only be satisfied by the incumbent contractor until the GAO protest decision is made on task order , the stay of performance is lifted under that task order, and the contractor is able to provide full operational support. A short-term bridge task order is the only way to avoid a lapse in coverage and maintain full operational performance of the required services.

8. Statement of Actions to Overcome Barriers to Competition:

The protested task order was competitively solicited and awarded against the GSA Alliant GWAC. In addition, the task order previously awarded under the GSA Schedules program was competitive as well. There is no reason to believe any subsequent requirements for these same/similar services will not be issued on a competitive basis.

10. Contracting Officer Certification:

The undersigned has determined that the anticipated cost to the Government for this acquisition will be fair and reasonable. Further, I certify that this justification is accurate and complete to the best of my knowledge and belief.

11. Approval:

Based on the above facts, it is the approving official's determination that the above referenced circumstances justifying limiting the source is required and in the Government's best interest to fulfill the required acquisition.
