I. Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for other than full and open competition.

General Services Administration

Federal Acquisition Service

Region 2 Assisted Acquisition Services Division

26 Federal Plaza, Room 20-100, NY NY 10278

II. Nature and/or description of the action being approved.

This action is for the inclusion of open market items in accordance with the Alliant Small

Business ordering guide. The Requesting Activity, the Department of Army’s Project Manager

Warfighter Information Network-Tactical (PM WIN-T), requires programmatic support services, which can be met utilizing the labor categories awarded under the Alliant Small Business contract vehicle. The Contracting Officer believes that offerors will include as a part of their solution materials that are necessary to meet the requirements of the solicitation but which are not awarded in their respective contacts. Previous contracts for the same requirements and services provided included materials, such as [REDACTED].

III. A description of the supplies or services required to meet the agency’s needs

(including the estimated value).

The Contracting Officer cannot definitely state what materials offerors will include in their offers; however, the previous task order (GST0210CJ0519) included the following materials:

[REDACTED]

The total estimated value of the resultant task order is [REDACTED], of which approximately

[REDACTED] is estimated for materials.

IV. An identification of the statutory authority permitting other than full and open competition.

In accordance with FAR Subsection 6.302-1 as codified in 10 U.S.C. 2304(c)(1), all open market items shall be procured from the one responsible source in accordance with the evaluation criteria described in Section L of the RFQ.

V. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

In accordance with the ordering guide of the Alliant Small Business contract vehicle, open market items may be included as a part of the contractor’s total solution. In order to meet PM

WIN-T’s requirements, the contractor will need to incorporate some materials as a part of its total solution. To ensure the contractor can perform the proposed and awarded services under its

Alliant Small Business contract, it is in the government’s best interest to include the open market items using its approved purchasing system, if applicable, or through an approved source.

VI. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

To ensure as many potential sources are solicited from, the government posted a Sources Sought notification in GSA’s electronic Request for Quote (RFQ)/Request for Proposal (RFP) system, e-

Buy, on June 10, 2013. The notification included a copy of the draft RFQ.

In addition, the solicitation will include FAR 52.251-1, permitting offerors to include open market items that are awarded under another Multiple Award Schedule (MAS) contract vehicle.

Finally, in accordance with FAR Section 5.203 the Contracting Officer will post this J&A in the governmentwide point of entry, Federal Business Opportunities at www.fbo.gov.

VII. A determination by the contracting officer that the anticipated cost to the

Government will be fair and reasonable.

During the evaluation process, the evaluation team will review all proposed open market items and perform price analysis in accordance with FAR Subpart 15.4. Any open market items that are not determined to be fair and reasonable will not be included as a part of the resultant task order.

VIII. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.

The government posted a Sources Sought notification in GSA’s electronic Request for Quote

(RFQ)/Request for Proposal (RFP) system, e-Buy, on June 10, 2013. The notification included a copy of the draft RFQ. The respondents to the notification did not mention that any specific materials would be required. However, previous contracts for the same requirement indicate that a nominal amount of materials of commercial nature will be required by the contractor to successfully meet the government’s needs.

IX. Any other facts supporting the use of other than full and open competition.

No additional facts are present at this time.

X. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.

[REDACTED]

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

If offerors include materials that would best be procured via a separate procurement, the

Contracting Officer will do so, setting aside the materials to small businesses, if applicable.

Furthermore, offerors are encouraged to use government sources, enhancing the offerors ability to receive competitive offers for the open market items.
