Federal Archaeological Resources

Protection Act Permit

To conduct work upon United States Government lands, owned, or controlled by the United States Section, International Boundary and Water Commission (USIBWC) under Archeological Resources Protection Act of 1979 (P.L. 96-95; 93 Stat. 721, 16 U.S.C. 470aa-II and 43 CFR 7) and USIBWC regulations found at 22 CFR 1104 et seq.

University, museum or other scientific or educational institution in which the material collected under this permit will be deposited for permanent preservation: (a current, valid curation agreement and inventory of collected artifacts must be kept on file with the USIBWC Environmental Management Division of the Engineering Department). Texas Archeological Research Laboratory (TARL), University of Texas at Austin is the designated depository for the collected material. TARL is an approved repository on The University of Texas at Austin, and the address follows: Records and Collection Curation, Texas Archeological Research Laboratory, The University of Texas at Austin, J.J. Special Conditions:

This permit is subject to the provisions of the Archeological Resources Protection Act (ARPA) of 1979, its regulations (22 CFR 1104) and special conditions (see attached item # 13 below).

This permit does not cover the Mexican portion of the Rio Grande or other properties not owned or managed by the USIBWC. You are reminded that ARPA does not apply to Mexican territory, and the USIBWC does not have jurisdiction over the Mexican portion of the Rio Grande for that purpose. If you intend to conduct work in Mexican territory, you must obtain permission by separate request through the USIBWC.

1.

This permit will not be exclusive in character and there is hereby reserved unto the land owners the right to use, lease or permit the use of said land or any part thereof for any purpose.

2.

Other institutions may be engaged in archaeological research in the general area covered by this permit. In case there should be conflict with respect to a site not specifically designated in a permit, the parties concerned will reach agreement between themselves as to which will work the site.

3.

The USIBWC, including its employees, will be held blameless for any and all events, deeds or mishaps, regardless of whether or not they arise from operations under this permit.

4.

Such guidance and protection as are consistent with duties of the USIBWC official in charge of the area will be afforded the permit holder and his party.

5.

Transportation in USIBWC vehicles cannot be furnished, except in cases where no extra expense to the USIBWC is involved and a release of claims form is filed.

6.

All costs will be borne by the permittee.

7.

The exploration or excavation of any Native American Indian grave or burial ground on Indian lands and reservation under the jurisdiction of the USIBWC is restricted to qualified archaeologists. No grave or burial ground abandoned less than 200 years may be investigated without permission of the governing council of the Indians concerned. Such permission must be promptly recorded with the official in charge of the designated area.

8. All excavated areas will be restored by filling in the excavations and otherwise leaving the area as near to original condition as is practicable.

9.

The permittee will conduct all operations in such a manner as to prevent the erosion of the land, pollution of the water resources, and damage to the watershed. The permittee will do all things necessary to prevent or reduce to the fullest extent the scarring of the lands.

10.

Any findings of mined or processed precious metals or other treasure or treasure trove in the area covered by this permit are the exclusive property of the landowner. Findings will not be disturbed or removed from the site without specific written permission from the USIBWC.

Two copies of the final report, without locational data, accompanied by a completed National Technical Information Service (NTIS) Report Documentation Page (SF-298) with each report, available at (703) 605-6239, will be submitted to: United States Section, International Boundary and Water Commission, United States Section, Mr. Mark Howe, Cultural Resources Specialist, Environmental Management Division, 4171 N Mesa, C-100, El Paso, TX 79902.

12.

Before undertaking any work on lands administered by the USIBWC, clearance must be obtained by permittee.

13.

Other special conditions:

Information on prehistoric and historic sites, features, isolated observations (artifacts) and traditional cultural properties that specifies their exact location will be presented in a separate volume. Treat locational information as confidential.

Preliminary Report:

Within 60 calendar days of the conclusion of field work, a preliminary draft report of the work performed under this permit, illustrated with representative photographs and listing new and significant collected materials, should be furnished to: International Boundary and Water Commission, United States Section, Mr. Mark Howe, Cultural Resources Specialist, Environmental Management Division, 4171 N Mesa, C-100, El Paso, TX 79902-1441

This information is being collected to report on the results of archaeological studies conducted on lands under the jurisdiction of the USIBWC. This information will be used to ensure that the work was conducted in accordance with statutory and regulatory requirements and any terms and conditions stipulated in the permit. Response to this request is required to obtain a benefit. The public reporting burden for the preliminary and final reports is estimated to average one hour per response, including time for reviewing instructions, searching existing data sources, gathering and maintaining data, and completing the reports.
