About this file
This document is a Justification and Approval (J&A) for a cabinet X-ray security system maintenance, repair, and training services requirement. The key details are:
The requirement is for the maintenance, repair, and training services of cabinet X-ray security systems at multiple Military Entrance Processing Stations (MEPS). The systems can only be serviced by technicians certified by the Original Equipment Manufacturer (OEM), and the contractor must provide OEM-certified spare parts. Alternatives, such as using non-certified parts or services, are not viable due to federal regulations and safety concerns. A sources sought notice was posted, and a pre-solicitation notice was published, but the requirement will be competed as a 100% small business set-aside. The Performance Work Statement was drafted to allow for maximum competition within the constraints of the OEM certification requirements.

Control No.: MICC 2024-72
Astrophysics and Smiths Detection systems, only services technicians that have successfully passed a certification exam from the respective OEM and maintain current OEM maintenance certification can install and provide maintenance services on these systems.
b. The prospective contractor will also be required to furnish OEM-certified spare parts as needed to repair defective equipment. Federal regulation 21 CFR 1020.40 requires cabinet X-ray security systems to be maintained and certified by their manufacturers with certified component parts. Each system is composed of proprietary spare parts that can only be acquired from and certified by the OEM or their authorized resellers.
c. Alternatives. The alternative would be procuring third-party maintenance, parts, and repair services that are not certified or affiliated with the OEM. This is not a viable option. USMEPCOM and federal regulations require certified parts, maintenance, and repair services. Procuring parts or services without these certifications would place USMEPCOM out of compliance with the regulations and potentially expose them to serious cost and legal liabilities as described below.
d. Impact if justification not approved: Failure to approve this justification could lead to potentially serious cost and safety risks. OEM-certified parts and maintenance services help ensure that the X-ray systems are safe and in compliance with industry standards. Utilizing non-certified parts or maintenance service risks exposing USMEPCOM personnel and the general public to radiation leakage if a defective machine is not repaired correctly. That could leave the Government legally liable in case of accidental illness or injury.
e. Additionally, the OEM requires parts and maintenance to be certified in order for the X-ray systems to remain under their initial manufacturer warranty. While the current X-ray systems are not under warranty, several of them are older models that will likely need to be replaced in the near future. If the systems are replaced, they will need to be maintained according to OEM standards or risk voiding the warranty, which would cause substantial duplicate cost to USMEPCOM if equipment needed to be repaired or replaced.
6. Efforts to Obtain Competition: A sources sought notice (SSN) was posted to the System for Award Management (SAM.gov) on 08 May 2024, with responses due on 15 May 2024. Three vendors responded to the SSN. A pre-solicitation notice was also published to SAM.gov on 17 June 2024 in accordance with FAR 5.201.
7. Actions to Increase Competition: This requirement will be competed as a small-business set-aside to capable maintenance service providers. The eventual prime contractor will be required to obtain the proprietary parts, maintenance, and repair services described in this justification from the OEM or an authorized reseller. The Performance Work Statement was also drafted to allow for as much competition as
