PERFORMANCE WORK STATEMENT (PWS)
MAINTENANCE AND REPAIR OF HEATING, VENTILATING, AND AIR CONDITIONING
(HVAC) SYSTEM FOR FORT KNOX, KY.
PART 1
GENERAL INFORMATION
1. GENERAL: This is a non-personal services contract to provide HVAC Maintenance and Repair. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.
1.1 DESCRIPTION OF SERVICES/INTRODUCTION: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to provide maintenance and repair of HVAC system for Fort Knox as defined in this Performance Work Statement (PWS) except for those items specified as government furnished property and services. The contractor shall perform to the standards in this contract.
1.2 BACKGROUND: The contractor shall provide maintenance and repair services for a variety of HVAC units to include heating systems up to 9 MBTU/HR and air conditioning equipment up to 910 tons and their components. This work includes the maintenance, repair, repair by replacement and installation of all components, devices, equipment, and associated systems, including but not limited to compressors, blowers, motors, drive assemblies, exhaust fans, service valves, dampers, condensers, cooling coils, dehumidifiers and controller for barracks bathrooms, piping, pumps, purge units, control systems and wiring, duct work, burner assemblies, combustion chambers, thermostats and temperature controls, registers, condensate and drip pans and drains, grills, evaporators, air filters, heat/air conditioning units, and all other items of equipment essential to the proper operation of HVAC equipment and systems in accordance with the manufacturer’s manuals.
1.3 OBJECTIVES: The objective of this contract is to provide complete and full preventive maintenance and repair on HVAC equipment at Fort Knox, KY. Preventive maintenance includes all inspections, testing, routine service, and maintenance in accordance with prescribed manufacturer guidelines and intervals. All work not specifically mentioned, which is required to ensure that maintenance is complete and is within the intent of this contract, shall be performed without additional cost. Contractor shall perform, coordinate, and complete the requirements of the contract in cooperation with any other contractors or trades performing work at Fort Knox, KY promptly and diligently as required by the standards of this contract.
1.4 SCOPE: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to provide maintenance and repair of HVAC system for Fort Knox as defined in this Performance Work Statement (PWS) except for those items specified as government furnished property.
1.5 GENERAL INFORMATION:
1.5.1 Contract Management: The contractor shall provide contract management during performance of this contract. The management concept used to ensure that all Performance Work Statement (PWS) requirements are met is a business decision of the contractor. Contract management personnel may be full-time or part-time to this contract, single function or multiple function, one or more individuals, on-site or off, from an overhead pool or as direct labor, or any other combination(s) that will ensure the contractor fully meets the requirements of the contract.
The government reserves the right to utilize government forces in all situations and other contractors to accomplish the same type or similar work as solicited for in this contract when HVAC maintenance and repair is incidental to another contract.
1.5.2 Upon Contract Award: The contractor shall designate in writing, to the KO and COR, a Project Manager as the point of contact to deal with the Mission Installation Contraction Command (MICC) – Fort Knox on contract matters. The contractor shall provide the name, telephone number(s), fax number, and e-mail address, as well as the individual’s level of authority to contractually bind the contractor. The contractor shall submit the same information for any designated alternate and shall resubmit the required information upon any change in primary or alternate designations.
1.5.3 Contracting Officer’s Authority: The Contracting Officer is the only person authorized to direct changes in any of the requirements under this contract and notwithstanding any provisions contained elsewhere in this contract, the said authority remains solely in the Contracting Officer. In the event that the contractor effects any change at the direction of any other person other than the Contracting Officer, the change will be considered to have been made without authority and solely at the risk of the contractor.
1.5.4 Meetings, Conferences, and Briefings: The contractor shall attend, participate in, and furnish input to scheduled and unscheduled meetings, conferences, and briefings that relate to the contracted functions and services as required by the government to provide effective communication and impart necessary information. The contractor shall participate in meetings with Installation customers, Federal, state, and local agencies and their representatives, and other contractors as required by the government. These meetings include both on-site and off-site meetings, and the frequency may be weekly, monthly, or as otherwise required. Meetings may start or end outside of normal working hours. The contractor shall not render final decisions for the government or represent the government at policy decision group level meetings.
1.5.4.1 Attendees: The Project Manager or designated representative shall be required to attend meetings as required by the government. Meeting attendees shall at times include contractor managerial, supervisory, and/or other personnel knowledgeable of the subject matter.
1.5.4.2 Reporting Requirement: The contractor shall participate in the Management Controls Program in accordance with AR 11-2. The contractor shall submit DA Forms 11-2-R identifying areas outlined in AR 11-2, providing assurance that management controls are efficient, effective, and are being carried out. The contractor shall identify any material weaknesses in the management controls and submit plans for the corrections of the weaknesses. The contractor shall submit the reports to the KO as required. When the contractor is the sole representative of the government at meetings, conferences, or trips off the Installation, a report shall be furnished to the KO and COR within two workdays after meeting completion. The report shall include identifying information, general observations and conclusions or recommended actions, and any additional information, such as handouts.
1.5.4.3 Command Interest: The contractor shall notify the KO and COR, in writing, on matters within the scope of this contract which affect the Installation, government funds, or satisfactory performance of this contract within one working day of the discovery of the matter.
1.5.5 Installation Closures: Announcements of Installation closures will be made in the following manner: during normal duty hours, notification will be given through normal chain of command;
during non-duty hours, notification will be made through local radio and television channels.
Installation closings shall in no way interfere with any contractor support required of the Installation’s activities operating and maintaining critical systems and services. See paragraph
1.2.6.7 for identification of mission essential personnel.
1.5.6 Federal Holidays: All government offices will be closed, except for minimum essential personnel required for in-house operations, during Federal holidays. Except as otherwise specified, the contractor shall not schedule routine work on Federal holidays. When a scheduled service is required less than three times per week and the schedule for that work falls on a Federal holiday, the contractor shall accomplish the work on the workday following or preceding the holiday, or as directed by the KO. The eleven Federal holidays per year are as follows:

When such holidays fall on a Saturday, the preceding Friday will be considered a holiday.
When such holidays fall on a Sunday, the succeeding Monday will be considered a holiday.
1.5.7 Training Holidays: Installation Commands have historically granted military personnel (enlisted and officers) training holidays (for example, Christmas Exodus) in addition to the ten Federal holidays listed above. Training holidays are not considered a day of excused absence for the government civilian work force or contractor employees. If a training holiday affects scheduled contract work or access to facilities, the work in affected facilities may be rescheduled to compensate for the training holiday. However, announced training holidays or exodus of military personnel may provide the contractor with an opportunity for unrestricted access to facilities/areas or uninterrupted performance of work. The contractor shall take full advantage of such opportunities by planning work that is better accomplished when personnel are not using facilities during those times.
1.5.8 HOURS OF OPERATION
1.5.8.1 Regular Duty Hours: The contractor's normal duty response hours shall be 0700 to 1630, Monday through Friday, excluding Federal holidays or as otherwise indicated in functional areas. The contractor shall ensure that service to customers is not interrupted during break and lunch periods. The KO must approve variances in operating hours.
1.5.8.2 Call-Out/Overtime: The contractor shall provide qualified personnel on a 24-hour per-day, 7 days per week basis to perform services and satisfy emergency requirements. The contractor shall submit their on- call duty roster to Department of Public Works (DPW) and the Fort Knox Fire Department no later than the first normal business day of each week. In the event that day is a scheduled holiday, the list will be provided by COB on the last normal business day prior to the holiday.
1.5.9 PLACE OF PERFORMANCE: The work to be performed under this contract will be performed at government facilities on the Fort Knox installation.
1.5.10 TYPE OF CONTRACT: Firm Fixed Price.
1.5.11 INTERFACES
1.5.11.1 Restricted Areas: Compliance by the contractor shall be mandatory for security access requirements to restricted areas that include, but are not limited to, the communication center, ammunition storage area, computer centers, Communications Security Equipment (COMSEC) Repair Facility, Special Compartmental Information Facility, the Gold Vault and research and development areas. The contractor with the government’s Security Officer for that area shall clear work in restricted areas. A list of government security points of contact will be furnished to the contractor prior to contract start.
1.5.11.2 Administrative Office Areas: Contractor operations shall not unduly interfere with government work in any area where the contractor is performing any service.
1.5.11.3 Other Government Agencies: The contractor shall be required to provide input to other government agencies to support reporting requirements, mission changes, plans and studies.
1.5.11.4 Other Contractors: Other government contractors will be performing required services in areas associated with the requirements of this contract. Some contractors will be providing services associated with, and in support of, work identified in this contract. Some examples are contractors who deliver material to and pick up material from the Installation, and construction contractors performing specialized and one-time jobs. The government will facilitate initial contact between contractors performing other contracts and this contract. The contractor shall provide all further required coordination between contractors for any task specified in this contract that relates to or impacts on any other contracted work. The contractor shall be responsible for any support services to other contractors within the scope of this contract as required by the government.
1.5.11.5 Disputes with Customers or Other Government Contractors: The contractor shall notify the KO and COR of unresolved disputes in receiving support from or providing support to customers or other contractors within two hours from the time the dispute occurs.
1.5.12 DATA AND INFORMATION
The contractor shall respond to requests for information, including programmed (scheduled) and un-programmed requests. All responses shall meet the criteria defined below.
1.5.12.1 Data Criteria: The contractor shall submit programmed and un-programmed information, subject to government review for adequacy, utilizing the following criteria:
Complete: Includes all required information
Accurate: Factual and correctly tabulated data Timely: Provided within the specified time frames Properly Prepared: In accordance with applicable publication or other specified format Properly Distributed: Provided to the specified personnel.
Includes name and signature of Project Manager certifying completeness and accuracy of submitted data.
Submission by KO prescribed means
1.5.12.2 Programmed Requirements: The contractor shall furnish all recurring contract data and information as specified in the deliverables listings (TEs 1-04, 4-01, 5.1-04, 5.2-37, and 5.3-02) or as elsewhere required in this contract.
1.5.12.3 Un-programmed Requirements: The contractor shall provide data/information upon notification and within the required time frames. The data/information is often required within a very short suspense time, i.e. one day. The contractor shall provide data/information to include, but not limited to, the following:
Technical evaluation of suggestions Input for staff studies Fact sheets Audits Input to answer Congressional inquiries One-time reports Materiel, equipment, facilities, and other listings Materiel, equipment, facilities, and other property inventories, such as equipment density listings Equipment maintenance records Recommendations for amending, revising, or originating government regulations or policies within the scope of this contract Information requested by the KO and other government personnel performing official duties, to include monitoring contract compliance Responses to the KO and other government personnel conducting information and communication systems site surveys, information systems fielding, and communication engineering and construction as required by the government
Cost estimates, to include, but not limited to, cost estimates for work to be performed for reimbursable customers

1.5.12.4 Access to Data and Information: The contractor shall ensure that contractor-generated technical records, reports, files, and other documentation are made available to the KO, KO’s representatives, Public Works staff, and other authorized government representatives during the performance of this contract. The contractor shall provide copies of documentation to the KO, or his/her designated representative, within five workdays of request. The contractor shall obtain KO approval before releasing any information related to this contract to off-site offices, to other government activities or agencies, to other contractors, or to private parties.
1.5.12.5 Marking Proprietary Information: All records, files, reports, and data deemed proprietary by the contractor shall be clearly marked accordingly. The government will make the final determination of the appropriateness of proprietary claims by the contractor.
1.5.13 PERSONNEL: The contractor shall provide qualified supervisory, technical, administrative, and clerical personnel to accomplish all work and services required by this contract within specified time frames. This provision shall apply notwithstanding past historical records, estimates of personnel needed, or any minimum levels established elsewhere in this contract. Contractor employees shall be trained, qualified, certified, or licensed as required in this contract prior to starting work. The government will not provide initial skills training/initial certifications/initial licensing for contractor employees. The contractor shall maintain records of training qualifications, certifications, and licenses. The contractor shall maintain the workforce in such a manner as to ensure that the employees remain fully qualified to perform the work assigned. Personnel performing under this contract shall be employees of the contractor and not the government.
1.5.13.1 Key Personnel: The contractor shall submit the list of key personnel (see paragraph
5.2.3.7.2 for list of key personnel) to the KO and COR upon contract award. Key personnel include, but are not limited to, Project Manager, point of contact for contract matters and any alternates (if other than the Project Manager) (see paragraph 1.5.2), and any other individuals identified by the contractor as key. The Project Manager and any individuals to act in that capacity shall have full authority to contractually bind the contractor for prompt action on matters pertaining to the execution of the contract. Any changes to the working status of these key personnel shall be provided to the KO in writing within 5 working days of the change.
1.5.13.2 Contractor Employees: For the purpose of this contract, the term "contractor employee(s)" applies to all contractor and subcontractor employees performing work on this contract and being paid directly or indirectly by the contractor.
1.5.13.3 Employment Limitations
1.5.13.3.1 Employment of Aliens: The contractor shall not employ any alien who is not lawfully employable in the United States under the Immigration Reform and Control Act.
1.5.13.3.2 Language Requirement: The contractor shall employ only persons able to speak, read, write, and understand English for those positions interacting with government and other personnel in the performance of this contract, and/or where English is used or essential to provide the product, record, data, information, or service.
1.5.13.3.3 Mathematics Requirement: All contractor personnel shall be capable of performing basic mathematics for the function(s) and task(s), which they are assigned.
1.5.13.3.4 Physical Fitness: The contractor shall ensure that all contractor personnel meet the physical requirements to perform the function(s) and task(s) to which they are assigned. This may include performing work in conditions of extreme heat and cold, high humidity, lifting heavy loads, working in confined spaces and at heights.
1.5.13.3.5 Employment of Military or Government Personnel: Employment of off-duty military personnel or government civilian personnel shall not conflict with Department of Defense (DoD) Joint Ethics Regulation 5500.7-R. The contractor shall not employ for performance under this contract any person whose employment would result in a conflict of interest with the government's standards of conduct.
1.5.13.4 Organizational Chart: The contractor shall submit an Organizational Chart to the KO and COR upon contract award date reflecting the contractor’s organizational responsibilities, key personnel as defined in paragraph 1.2.6.1, and home and work phone numbers of key personnel. The Organizational Chart shall also include all required personnel appointments (i.e.
Energy Officer, etc.). The contractor shall provide the KO an updated Organizational Chart within three workdays of any change.
1.5.13.5 Employee Roster: At contract start date, and on the first workday of each month thereafter, the contractor shall provide a current Employee Roster to the COR. The Employee Roster shall identify all contractor and subcontractor employees by name, contractor employee number and name of employing contractor or subcontractor.
1.5.13.6 IDENTIFICATION OF EMPLOYEES
1.5.13.6.1 Contractor ID Card and Badge: The contractor shall provide each employee a contractor/subcontractor identification (ID) card and an ID badge on contract start date or on employment start date. ID card format shall be approved by the KO and include, at a minimum, a badge number, date issued and expiration date (not to exceed the end of the final option period), employee’s name, contractor or subcontractor’s name, functional area of assignment, and photograph. ID cards for key personnel shall also indicate their job titles. The ID badge shall, as a minimum, have the employee’s name and name of the contractor or subcontractor.
The ID badge shall be a minimum of three inches long by two inches high, with 1/8 inch lettering. A combination ID card and ID badge may be utilized if it can be worn on the employee’s outer garment.
1.5.13.6.2 Display of Contractor ID Badge: All contractor personnel on duty shall wear identification badges on the upper front quadrant of the outer garment at all times when performing work under this contract. If wear of the badge in the designated location should constitute a safety hazard, the contractor shall designate an alternate location for display of the badge for the employee affected.
1.5.13.6.3 Government Computer Access Card (CAC): Contractor employees who are required to access government computers with machine-readable cards within the performance of their duties will be issued the government. The contractor employee shall complete DD Form 1172- 2, Application for Department of Defense Common Access Card DEERS Enrollment. The contractor’s Facility Security Officer shall certify on the individual’s application for a CAC that the CAC is required in performance of the employee’s duties. Upon contract award, and upon change in designation, the contractor shall provide the KO the name, business address, and business telephone number of individual(s) designated to act as the contractor representative(s) responsible for managing the DA Civilian ID Cards issued to both contractor and subcontractor employees. The contractor shall reference TE 3-01 for steps on obtaining a CAC.
1.5.13.6.4 Display of ID Cards: Contractor personnel shall carry any contractor issued and DA Civilian ID/CAC cards at all times when performing work under this contract and display the cards when requested.
1.5.13.7 CONTRACTOR ACCOUNTABILITY
1.5.13.7.1 Termination: Upon termination of this contract or of termination of employment of any contractor employee, the contractor shall collect and dispose of all contractor-furnished identification cards. If any of the cards are not collected, the contractor shall notify the KO in writing within 24 hours of employee termination and/or contract expiration as to the circumstances for non-collection of the card(s). If employee has a GFP computer, the GPF Computer shall be turned into the Government.
1.5.13.7.2 Prime Contractor: The prime contractor’s representative shall be responsible for the collection and turn-in of CAC cards from terminated contractor/subcontractor employees and from all contractor/subcontractor employees upon completion of the contract. CAC cards shall be collected and turned into the COR, or his/her designated representative. Turn-in shall be accomplished within five workdays of employee termination and/or contract expiration. If the card is not collected, the contractor shall notify the KO/COR and Chief, AG ID Card Section, in writing within 24 hours of employee termination and/or contract expiration as to the circumstance for non-collection of the card(s).
1.5.13.7.3 Answering Telephones: Contractor personnel shall identify themselves as contractor employees (for example, John Doe, ABC Corp) when answering government telephones.
1.5.13.7.4 Utilizing Electronic Mail (e-mail): When contractor or subcontractor personnel send e-mail messages as part of contract performance, each sender shall include his/her first and last name, e-mail address and the name of the individual’s employer. Accounts established in government e-mail systems for contractor and subcontractor personnel shall identify individuals as contractor personnel in the Address Book display and on the individuals’ e-mail. Detailed properties for the account shall include the name of the individual’s employer and the name customer for the contract. The contractor shall immediately notify the DPW Information Assurance Officer (IASO) when a contractor employee is no longer performing duties that require an account in the government e-mail system.
1.5.13.8 Mission Essential Personnel: In cases of increased security levels of the Installation (i.e. FPCON Delta) or other contingencies, access to the installation may be limited to mission essential personnel only. Upon contract award, the government and the contractor shall jointly determine positions within the contractor’s organization that are to be named mission essential.
The contractor shall provide the KO, the DPW, and Fort Knox IOC by encrypted e-mail a list of the names of contractor personnel occupying mission essential positions within one workday of joint determination of positions, no later than the first workday of each month thereafter, and immediately upon any change in mission essential personnel. The government will provide the Contractor with required format for the listing. Personnel not listed on the emergency essential listing will be denied access to the installation during applicable increased security levels.
1.5.13.9 EMPLOYEE DRESS
1.5.13.9.1 Uniforms: The contract does not require uniforms for contractor personnel. If the contractor elects to provide uniforms, at the contractor’s expense, the selected uniforms shall not be similar to military or Installation guard uniforms and shall consist of, at a minimum, shirt, which identify company and functional area for which the employee works. If uniforms are not provided at contractor expense, contractor personnel shall wear attire, which is appropriate for the duties performed. Contractor personnel shall not wear clothing with slogans, drawings, or language which could be construed as being lewd, obscene, profane, or sexually suggestive, or which advocates the use of illegal drugs or other unlawful conduct.
1.5.13.10 CONDUCT OF PERSONNEL: The contractor shall be responsible for the performance and conduct of contractor/subcontractor employees at all times. Personnel employed by the contractor in the performance of this contract, or any representative of the contractor entering the Installation, shall abide by the security regulations listed in the contract and shall be subject to such checks by the government as deemed necessary.
1.5.13.10.1 Personnel Removal: Government rules, regulations, laws, directives, and requirements which are issued during the contract term relating to law and order, Installation administration, and security on the Installation shall be applicable to all contractor employees or representatives who enter the Installation. Violation of such rules, regulations, laws, directives, or requirements may be grounds for removal (permanently or temporarily as the government determines) from the work site. Removal of employees does not relieve the contractor from the responsibility for the work defined in this contract.
Removal by Installation Commander: The Installation Commander may bar an individual from the Installation under the authority of 18 USC 1382 (1972) and Paragraph B-15, Appendix B of AR 380-49 for conduct determined contrary to good order, discipline, or Installation security.
Removal by KO: The KO may require the contractor to remove any employee, working under this contract, for reason of misconduct or security. Contractor employees shall be subject to dismissal from the premises upon determination by the KO that such action is necessary in the interest of the government.
Removal by Military Police: Contractor employees may be denied entry to the
Installation by Military Police and/or Gate Security Guards if it is determined that such entry may be contrary to good order, discipline, or the security of the Installation. The Military Police may remove any employee for reason of misconduct or security.
1.5.13.10.2 Personnel Courtesy: Contractor employees shall be courteous to civilian, military, or other contractor personnel at all times.
1.5.13.10.3 Alcohol/Drug Use: The use of alcoholic beverages or illegal drugs by contractor personnel is forbidden during performance of work under this contract or while physically on the Installation during duty hours.
1.5.13.10.4 Loitering: Contractor employees shall not loiter in any working or patron area.
Upon completion of their assigned duties, employees shall depart the facility. The contractor shall allow only authorized personnel to be present in contractor's work areas.
1.5.13.10.5 Fraud, Waste and Abuse: In accordance with AR 11-2, Management Control, the contractor shall be responsible for maintaining proper conduct and good discipline within contractor occupied work areas. Contractor personnel shall be encouraged to be alert to and report suspected situations of fraud, waste, and abuse, or other intentionally dishonest conduct against the government observed during or in the performance of this contract.
1.5.13.10.6 Sexual Harassment/Discrimination: The contractor shall abide by the laws prohibiting sexual harassment and unlawful discrimination.
1.5.13.11 Search and Seizure: All contractor personnel and property may be subject to search and seizure upon entering, while on, and upon leaving Installation confines.
1.5.13.12 PERSONNEL TRAINING
1.5.13.12.1 Training and Recruitment Plan: The contractor shall develop, maintain, and implement plans that incorporate the contractor's policy concerning the training of incumbent and replacement personnel, to include recruitment procedures.
1.5.13.12.2 Orientation Training: The contractor shall conduct an orientation training class for all contractor employees within five workdays of initial employment. This training shall be relative to HVAC PM and Maintenance and/or contractor and government offices with which the employees will interact. The training shall include, but is not limited to, the following topics:
General orientation regarding contract requirements and the role of the respective the overall HVAC contract
HVAC internal and external (customer) standing operating procedures and general work requirements.
Familiarization with the physical configuration of the Installation, to include at a minimum, the location and layout of HVAC facilities, master publications library, storage areas, and shop areas.
The contractor's safety plan, the Army Safety Program (AR 385-10), the Installation safety program, HVAC specific safety training, and Hazard Communication training pursuant to 29 Code of Federal Regulations (CFR) 1910.1200

1.5.13.12.3 Contractor Personnel Training: The contractor shall be responsible for the training of all contractor personnel.
1.5.13.13 Specific Personnel Requirements: All contractor personnel shall be fully qualified to perform the work to which they are assigned under this contract. License and certification requirements are noted below:
1.5.13.13.1 Confined Space Entry: The contractor employees shall be trained in Confined Space Entry in accordance with 803 Kentucky Administrative Regulation (KAR) 2:200 and Occupational Safety and Health Administration (OSHA) regulations when performing utility work. The contractor shall maintain a log that shall record the following: confined space to be entered, location/building, purpose of entry, authorized duration of permit (date and time), type of permit space hazards, preparation for entry-checks, equipment required for entry and work, list of authorized entrants, and testing record (recording the acceptable conditions to actual readings). Contractor shall also notify Fort Knox Fire Department before entering the confined space and at the termination of work in the confined space.
1.5.13.13.2 Vertical Lift Devices: All contractor personnel operating vertical lift devices shall be certified in accordance with AR 420-49. Vertical lift device inspectors shall be certified in accordance with AR 420-49.
1.5.13.13.3 Handling HAZMAT: All contractor personnel, including subcontractors, required to handle HAZMAT shall be trained to the level required by all environmental laws to perform their designated functions and shall be certified in accordance with DoD 4500.9-R, 49 CFR, and Technical Manual (TM) 38-250.
1.5.14 OCCUPATIONAL HEALTH SERVICES: The contractor shall provide all health screenings, protective/health clothing and equipment as required by Federal, state or local laws or regulations.
1.5.14.1 Contingencies: The government establishes contingency plans and contingency training missions to support mobilization and national emergencies, and to augment local governments in the event of natural disasters. The government must be able to react to such events without undue delay. These sudden or unusual events could result in a great impact upon contractor performance and contract requirements. The contractor shall establish, maintain, and implement, as directed by the KO, plans and procedures to meet the government's requirements for contingencies. In the event that unusual conditions develop, the contractor shall continue, and expand, if necessary, contract performance. The cost of the expended efforts will be negotiated when the extent of the abnormal situation(s) and required support are identified. Installation mobilization and disaster contingency plans are maintained and will be made available to the contractor upon contract award.
1.5.14.2 Contingency/Mobilization Planning: Thirty calendar days after contract award, and upon change, the contractor shall provide in writing, to the KO, a single point of contact within the contractor's organization for participation in and coordination of contingency and mobilization planning activities. The contractor shall participate in government contingency/mobilization planning conferences and shall provide input as appropriate.
1.5.15 DOCUMENTATION/REPORTS
1.5.15.1 Workload Data Report: The contractor shall report all work accomplished under the contract and shall furnish the workload data to the KO in electronic format by close of business on the 10th calendar day of the following month. The workload data shall be in a format compatible with government workload analysis automated information systems where such exist. For data elements not currently available through Army Public Works information systems, the contractor shall develop the methodology, format, and structure necessary to furnish such data. The reported workload shall be verifiable to the source documentation that is prepared and maintained as the normal product or by-product of the specific functional areas tasks. All required documentation, to include original source documents, supporting the workload data, shall be maintained and made available for government verification as required.
The supporting documentation shall be maintained in such a manner to facilitate ease of review, verification, and shall not be commingled with previous documentation to hinder the expeditious verification of reported workload accomplishment. The workload data shall be subject to review and comment by the KO and shall be updated as required. At a minimum, the data provided shall list the following information by month:
Demand Maintenance Orders (DMOs) by task code and priority completed during each month.
Project Work Orders (PWOs) submitted for approval including PWO document number, task description, date estimate submitted to the government, and estimated material/other direct costs, labor, and total estimate per PWO.
In-progress PWOs including PWO document number, task description, date submitted to the government, date approved by the government, estimated material/ODCs, labor, and total costs per PWO.
Completed PWOs including PWO document number, task description, date submitted to the government, date approved by the government, estimated material/ODCs, labor, hours performed, GFEBS total costs to date, and date completed per PWO.
Completed Preventive Maintenance (PM) and filter changes for each month.
Completed Water Treatment PM for each month.
1.5.15.2 Service Contract Reporting: The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided for this contract for the Department of Public Works via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address:
http://www.sam.gov
Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2023. Contractors may direct questions to the help desk at http://www.sam.gov.
1.5.15.3 Management Plan: The contractor shall submit a management plan to the KO and COR for review at contract bid date. The management plan shall reflect an understanding of all tasks specified in the PWS and describe an approach to satisfy these requirements. If any portion of the plan is found to be inadequate, the plan will be returned to the contractor with the inadequacies listed. The contractor shall submit a revised plan to the KO within five working days following receipt of the notification of rejection. The plan shall be implemented on contract start date. Any revisions to the Management Plan shall have the approval of the KO. At a minimum, the Management Plan shall address:
Industrial relations and personnel management.
Productivity control, productivity measurement, cost control, and work control, including work scheduling, workflow, and achievement of established standards.
Management, utilization, maintenance, standards, and accountability of government property.
Overall project management and administration.
Overall financial management, including accuracy of cost control data and reporting procedures.
Data collection and other documentation, including accuracy, document flow and control of associated files.
Subcontract management.
Staffing matrix indicating how each section or division of the proposed work force interrelates with each other in the performance of the contract.
Management of all resources, i.e., equipment and staffing plan, including the accomplishment of emergency work.
Show how the contractor’s corporate headquarters will support and provide expertise to the contractor’s on-site Project Manager.
Contractor's project office autonomy, i.e., show how the contractor plans to provide on-site decision authority and independence from the contractor’s corporate headquarters commensurate with Project Office responsibility.
Contract operations planning and control.
Methods the contractor intends to employ to ensure that contractor personnel are trained and current on state-of-the art processes, techniques, and equipment to gain the economies and efficiencies expected by the government.
Specific internal or external SOPs or plans as specified in this contract.
1.5.16 ADMINISTRATIVE REQUIREMENTS: The contractor shall prepare all correspondence and maintain all functional files, blank forms, and the technical and administrative publication libraries required to accomplish the functions and tasks included in this contract. The contractor shall annotate the date received on all incoming documents and correspondence received. The contractor shall conduct reports control and records administration programs.
1.5.16.1 Release of Information: The contractor shall not release any news (including photographs and films, public announcements, or denial or confirmation of it) or Installation related information of any subject matter within this contract or any phase of any program herein to the media without the prior written approval of the Public Affairs Officer (PAO).
1.5.16.2 Regulations, Manuals, and Technical Documents: The contractor shall comply with and obey all government regulations. Regulations, manuals, and technical documents applicable to this contract are listed in section 6.
1.5.16.3 Use of Terms: Publications may contain references to divisions, such as "Facilities Operations and Maintenance Division," "Services Division”, or to branches within those divisions. Such terms shall be interpreted to mean "the contractor" as used herein, unless the cited function is specifically excluded herein.
1.5.16.4 Publications Libraries: The contractor shall maintain Technical Reference Libraries, including all publications, data, exhibits, and other information provided therein. Technical Reference Libraries shall be updated as required to ensure that all information therein is correct.
Technical Reference Libraries shall be considered government property.
1.5.16.5 Performance Work Statement (PWS) Annual Update: The contractor shall review and provide recommendations for updating the PWS and its Technical Exhibit attachments annually.
The annual review shall be initiated and completed 60 calendar days prior to the start of each option period.
1.5.17 PERFORMANCE
1.5.17.1 Quality Control (QC): The contractor shall be responsible for the quality of products and services provided under the terms of this contract, to include those provided by subcontractors. To ensure that the requirements of this contract are met, the contractor shall implement an effective, economical Quality Control Program.
1.5.17.2 Contractor Quality Control Program: The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS.
The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. The Contractor shall provide three hard copies and three electronic copies of the Contractor’s Quality Control Plan to the Government within 15 days after contract award. Additional three hard copies and three electronic comprehensive copies shall be submitted to the KO and COR within 5 working days when changes are made thereafter. After acceptance of the quality control plan, the contractor shall receive the contracting officer’s acceptance in writing of any proposed change to his QC system.
The contractor shall develop, implement, and maintain a Quality Control Program (QCP) for measuring and attaining quality of performance under this contract. The contractor's QCP shall explain the manner in which the contractor shall ensure all contract requirements are being accomplished in accordance with the specifications of this contract and industry standards. A sustaining focus throughout the QCP shall be the attainment of continuous quality improvement.
The Program shall emphasize deficiency prevention over deficiency detection. The contractor’s QCP shall:
Be independent from all other parts of the contractor’s organization.
Be directly accountable to the contractor’s top management.
Contain a direct and indirect communication with the government regarding performance of the contract. Communication shall include regular and formal meetings with the government.
Contain processes for corrective action without dependence upon government direction.
Contain specific surveillance techniques for all contract services. Surveillance methods shall be comprehensive and adaptable to the reporting system of the plan.
Contractor’s QC Plan Content: The Contractor’s QC Plan shall address, at a minimum, the following:
Internal work performance standards.
Productivity measurement and work control, including work scheduling, work flow, and application of established standards for all functional areas under contractor control.
Management, accountability, and utilization of government property.
Overall project management and administration.
Overall financial management, including accuracy of cost control data and reporting procedures.
Industrial relations and personnel management.
Subcontractor management, to include subcontractor’s cost control.
Data collection and other documentation, including document flow and control of associated files.
Qualifications: The Quality Control Plan shall include the names and minimum acceptable qualifications of firms or individuals tasked to perform quality control and the extent of their authority. Their functional roles shall be depicted in an organization chart.
Test Methods: The plan shall discuss proposed test methods, including names and qualifications of technicians or qualified testing laboratories to be used.
Customer Complaint Program: The QCP shall include a customer comments/complaint program and processing system. The program shall allow identification and correction of validated customer complaints and provide feedback to the government and customers on corrective action(s) taken. The term customer refers to customers internal and external to the organizations identified by this contract.
1.5.17.3 Performance Evaluation Meetings: The Project Manager shall meet periodically with the KO and the government Contracting Officer Representative (COR)/Quality Assurance Evaluators (QAEs) to review contract performance. Meetings shall include review and analyses of key process indicators, analyses of process deficiencies, and problem resolution. At these meetings, the KO and the contractor shall discuss contractor's performance as viewed by the government and problems, if any, being experienced. The KO will take appropriate action to resolve outstanding issues. A mutual effort shall be made by the contractor and KO to resolve any and all problems identified.
1.5.17.4 Government Quality Assurance: The government will inspect and evaluate for compliance with contract terms throughout the contract period. Evaluation will be based on the contractor’s compliance with the requirements set forth in this contract. The contractor shall ensure that all work meets acceptable quality levels or tolerances specified in contract specifications, the Performance Requirements Summary (PRS) or in applicable referenced documents. The government will perform random surveillance to monitor quality and timely completion of Demand Maintenance Orders (DMO’s), Project Work Orders (PWOs), and Preventive Maintenance Orders (PMO’s). The Government will document their findings in an inspection report. These inspection reports indicating any deficient performance shall be provided to the contractor and shall be signed by the contractor’s designated representatives indicating receipt of a copy of the report. The contractor shall reply in writing to the COR and KO within seven work days from the date the unsatisfactory inspection report was received, giving reasons for the unsatisfactory performance, corrective action(s) taken, and procedures to preclude recurrence. In the event the contractor does not agree with the rating, the contractor shall present data supporting the disagreement. The government will reply in writing either agreeing with corrective actions and proposed procedures to preclude recurrence or disagreeing and providing detailed reasons accordingly. The KO will take appropriate action to resolve any area(s) of disagreement.
1.5.18 COMPLIANCE: The contractor and contractor employees shall abide by Federal, State, and local laws, as prescribed in applicable directives listed in section 6 while engaged in the performance of all operations associated with this contract.
1.5.19 CERTIFICATIONS, LICENSES, AND PERMITS: The contractor shall, without additional effort by the government, obtain all certifications, licenses, and permits required for performance of work and for complying with all applicable Federal, State, and local laws. Evidence of such documents shall be kept on file and subject to KO review upon request.
1.5.20 INSPECTION BY GOVERNMENT AGENCIES: The contractor shall provide access to government-owned, contractor-operated (GOCO) facilities and government-furnished and government-owned property and cooperate with visiting government personnel conducting official inspection visits and surveys at the Installation. Inspection visits will be made by agencies including, but not limited to, the Inspector General (IG), Army Audit Agency (AAA), Army Corps of Engineers, Environmental Protection Agency (EPA), OSHA, Kentucky Environmental Quality Commission (EQC), Government Accountability Office (GAO), Internal Review and Audit Compliance (IRAC) Office, Safety, the Installation Security Office, Army Material Command (AMC), and Training and Doctrine Command (TRADOC).
1.5.21 SAFETY
