4. Authority: FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.

5. Reasons for Authority Cited:

Northern Lights, BSA is the only reasonable source capable of providing the services of this contract. They are the only organization within a 225-mile radius from Cretin- Derham Hall High School that possess the facilities necessary to conduct tough, challenging, realistic, and quality training for our cadets.

If this contract were not awarded to this vendor, it would increase costs that the government can’t reasonably be expected to recover through competitive bidding. The costs incurred will be additional buses to transport cadets to/from training venues, meal cost increase, as well as the cost of lodging and facility usage.

6. Publicizing Contract Actions:

For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 apply and will be followed.

7. Market Research:

During the planning stage for this event, a web search was conducted in February 2024 for the type of training and safety features we require. Distance and ability to meet JCLC training requirements were the parameters used in the search. We used a 225-mile radius from the high school as the boundary to limit cost. Our search came back null. Similar online research was conducted for the 2023 contract packet. Furthermore, in 2022, the Contract Specialist attempted to locate competition amongst specific socioeconomic groups, a Sources Sought Synopsis was posted on Sam.Gov from 28 January to 7 February 2022, with no response that would contradict this conclusion. The previous solicitation was solicited unrestricted and resulted in only one offer being received by the Northern Lights Council of Boy Scouts of Boy Scouts of America. The contractor is not a small business concern. However, is a non-profit organization incorporated as a 501(c)(3) with an active SAM registration with no exclusions.

8. Other Facts:

The previous services provided were professionally executed and performed in an exemplary manner. A contract officer representative will be appointed to ensure that all terms and conditions are met.
