PERFORMANCE WORK STATEMENT (PWS)

IN SUPPORT OF

UNITED STATES CADET COMMAND

2BDE JCLC Butler

17-19 JUNE 2024

PART 1

GENERAL INFORMATION

1. General: This is a non-personal services contract under which the Government will not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

1.1 Description of Services/Introduction: This is a non-personal service in which the contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to provide meals, lodging, and training facilities in accordance with and as defined in this performance work statement (PWS) except for those items specified as government furnished property and services.

The contractor shall perform to the standards in this contract.

1.2 Background: The Army Junior Reserve Officer Training Corps (JROTC) program has an annual training requirement which the contractor provides all associated support requirements for Junior Cadet Leadership Challenge (JCLC) Butler. The contractor provides trained staff to provide meals and billeting for cadets and cadre while they conduct training.

1.3 Objectives: The contractor shall provide meals, lodging and training for a total of 50 cadets and 5 cadre personnel during the training session of JCLC Butler scheduled for 17-19 June 2024.

1.3.1 The contractor shall provide personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items necessary to perform meal preparation, serving, and cleanup in addition to serving equipment, chafing dishes, heating elements to maintain food temperature, serving utensils, disposable plates, cups, napkins, and utensils for requested meals.

1.3.2 The contractor shall provide lodging / barracks spaces, accommodations, and training facilities for a total of 50 cadets and 5 cadre for the duration of the JCLC as specified for the rotation from 17 to 19 June 2024.

1.3.3 The contractor’s personnel shall wear clean clothing and present themselves with clothing that does not contain statements that may be offensive to the military or others by using a portion of the uniform.

1.4 Scope: The contractor shall provide lodging, meal services and training facilitation from 17-19 June 2024. Kayaking, Biking, Swimming, High & Low Confidence/Challenge Courses, Zip Line, Cargo Net Climbing, will be part of the

JCLC.

1.5 . Period of Performance: The period of performance for this contract is from 17 to 19 June 2024.

1.6 General Information

1.6.1 Quality Control: The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirements of the contract.

1.6.2 Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).

1.6.3 Recognized Holidays: Contractor will be required to work Juneteenth which is 19 June 2024.

1.6.4 Hours of Operation: The contractor shall be available to conduct business between the hours of 6:00 AM to 8:00 PM for meal services and 24 hours a day for lodging and training facility use, for the duration of the contract. The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the contractor business is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.

1.6.5 Place of Performance: The place of performance for this contract for JCLC Butler will be within 50 miles of Pittsburgh, PA 15219.

1.6.6 Type of Contract: The Government will award a firm fixed price contract.

1.6.7 Security Requirements: Contractor personnel performing work under this contract are not required to have a security clearance.

1.6.8 Special Qualifications: Contractor shall insure ensure all food handling employees meet board of health standards and food handling requirements as well as having knowledge of safety regulations, such as, Occupational Safety and Health Association, (OSHA), proper clothing, and footwear. Contractor shall maintain a professional demeanor when serving the food and be aware of all food safety requirements for preparing and serving food.

1.6.9. Identification of Contractor Employees: All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.

1.6.10. Organizational Conflict of Interest: Contractor and subcontractor personnel performing work under this contract may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI) as defined in FAR Subpart

9.5. The Contractor shall notify the Contracting Officer immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the Contracting Officer to avoid or mitigate any such OCI. The Contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the Contracting Officer and in the event the Contracting Officer unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the Contracting Officer may affect other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the OCI.

PART 2

DEFINITIONS & ACRONYMS

2. DEFINITIONS AND ACRONYMS:

2.1. DEFINITIONS

2.1.1. CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.

2.1.2. CONTRACTING OFFICER. A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.

2.1.3. CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.

2.1.4. DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.

2.1.5. DELIVERABLE. Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.

2.1.6. Reserved

2.1.7. PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property.

2.1.8. QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

2.1.9. QUALITY ASSURANCE SURVEILLANCE PLAN (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.

2.1.10. QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.

2.1.11. SUBCONTRACTOR. One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.

2.1.12. WORK DAY. The number of hours per day the Contractor provides services in accordance with the contract.

2.1.13. WORK WEEK. Monday through Friday, unless specified otherwise.

GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES

3. GOVERNMENT FURNISHED ITEMS AND SERVICES:

3.1. The Government will not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

3.2. Cadets and cadre will be responsible for bringing their own sheets & pillows or sleeping bags.

PART 4

CONTRACTOR FURNISHED ITEMS AND SERVICES

4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:

4.1 General: The Contractor shall furnish all food, meal serving services, equipment, supplies, management, supervision, and labor to perform work under this contract that is not listed under Section 3 of this PWS.

4.2. Materials: The Contractor shall furnish all materials, supplies and equipment necessary to meet the requirements under this PWS to include all condiments, utensils, plates, and napkins.

4.3. Equipment:

4.3.1. Cooking Equipment. The Contractor shall be responsible for set up of the serving line, tables, cooking equipment and meal serving equipment. Chafing dishes will be used to keep meals warm. The contractor shall provide all cleaning supplies to clean the tables and be responsible for all trash removal.

4.3.2. The contractor shall provide a bed, or bunk (with mattress) for each cadet to sleep on.

4.4 Utility Conservation: The Contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount to accomplish the required tasks.

4.5 Taxes. The government will be exempt from paying any sales taxes related to this contract. Tax exemption forms will be provided to the contractor upon request.

PART 5

SPECIFIC TASKS

5. Specific Tasks:

5.1. Basic Services. The contractor shall provide all services for meal preparation, serving and clean up as well as furnishing all lodging, facilities, equipment, showers, latrines, and facilities for 50 cadets and 5 cadre for the performance of this contract. There is one training session: 17-19 June 2024.

Cadets and cadre will be responsible for bringing their own sheets & pillows or sleeping bags. The contractor shall provide a bed, or bunk (with mattress) for each cadet and cadre.

5.1.1. The Contractor shall furnish all necessary servicing equipment and provide disposable utensils, disposable plates, disposable cups, condiments, and napkins to all authorized personnel.

5.1.2. The Contractor shall provide the necessary management, supervision and labor required to set up, serve and clean up for the meal as well as support the lodging and training requirements of this PWS.

5.1.3. The Contractor will set up serving lines for each meal to expedite the service.

5.1.4. The Contractor shall provide the necessary management, supplies, equipment, supervision, and labor required to set up, clean up and remove trash from the dining area. Upon completion of the meal, the vendor shall ensure the facility is clean and sanitized.

5.2. Meals.

5.2.1. Menus. The contractor shall provide a menu similar to the one stated in Para 5.2.2. All breakfast and dinner meals shall be served hot.

5.2.1.1 The menu shall be coordinated with the Government POC upon receipt of the award date as soon as possible within 10 days. Any changes to the menu for alternative replacement shall be agreed upon at that time.

5.2.2. Sample Menu:

Breakfast sample: Scrambled eggs, bacon, potatoes, fruit choices, assorted juice choices, milk & coffee (and condiments)

Lunch sample: Pasta with salad and dinner roll, choices of desert, fruit punch, milk & coffee (and condiments)

Dinner sample: Turkey with stuffing and mashed potatoes, desert choices, salad, rolls, juice, milk, & coffee (and condiments)

5.2.3. Consideration / accommodations shall be made for vegetarian meals for approximately 3 to 5 people per meal.

5.2.4. The contractor shall deliver, and setup all equipment required to prepare, cook and serve the food at least 30 minutes prior to serving time. The contractor shall have meals ready to serve at least 15 minutes prior to the prescribed times below. Upon completion of the meal, the contractor shall clean and sanitize the serving and eating areas in the facility.

5.2.5. Mealtimes:

5.3. Lodging:

5.3.1. Housing and Hygiene. The contractor shall provide lodging for a total of 50 cadets and 5 cadre in support of this JCLC. Approximately 20 percent of the cadets and cadre are female.

5.3.1.1. The contractor shall provide the capability to lodge female and male cadets separately and provide separate male and female latrines, including showering and personal hygiene areas. Male cadet housing shall be organized by platoons. Female cadet housing may be combined based on numbers of females attending training.

5.3.1.2 The contractor shall provide cadre lodging separate from cadets with access to latrines and showers.

5.3.1.3 The contractor shall provide a bed, or bunk with mattress for each cadet and cadre.

5.4. Facilities

5.4.1. Classroom. The contractor shall provide a building or large room in a building equipped with tables and chairs for in-processing of cadets and cadre on opening day and for use as an indoor classroom if needed.

5.4.2. Medical. The contractor shall provide a building or separate room to set-up a first aid station with a minimum of one trained medical personnel that will be available 24 hours a day with training in First Aid, CPR and AED use. The contractor shall provide first aid. The Government will provide transportation to medical facilities, if required.

5.4.3. Rappelling and Climbing. The contractor shall provide a rappel tower with climbing wall. Rappel tower is not to exceed 60 ft. in height and shall be a minimum of 20 ft. in height. The rappel tower shall be in compliance with the standards set forth in CCR 145-2.

5.4.4. Climbing wall. The contractor shall provide a climbing wall or walls that do not exceed 60 ft. in height and is a minimum of 20 ft in height.

5.4.4.1. Climbing ropes. The contractor shall provide a climbing area that consists of both ropes and nets. Climbing ropes and nets shall not exceed 60 ft.

5.4.4.2. The contractor shall provide all necessary rappelling and climbing ropes, harnesses, safety helmets, and other associated equipment necessary to safely conduct rappelling and climbing activities in accordance with applicable safety rules and regulations.

5.4.4.3. The contractor shall provide a minimum of five (5) safety trained and certified personnel to conduct and monitor all rappelling and climbing activities in accordance with applicable safety rules and regulations.

5.4.5. High and Low Confidence Courses.

5.4.5.1. The contractor shall provide a High Ropes Confidence Course that consists of ten or more events, stations or legs. Course shall exceed 10 feet in height above the ground, maximum 60 ft, and allow for cadets to navigate the entire course without returning to the ground until completion.

5.4.5.2. The contractor shall provide a Low Ropes Confidence Course that consists of five or more events, stations or legs. Course will not exceed four feet in height above the ground and will support learning teamwork and problem solving.

5.4.5.3. The contractor shall provide all necessary ropes, harnesses, safety helmets, and other associated equipment necessary to safely conduct high and low ropes confidence course activities in accordance with applicable safety rules and regulations.

5.4.5.4. The contractor shall provide a minimum of five (5) safety trained and certified personnel to conduct and monitor all high and low ropes confidence course activities in accordance with applicable safety rules and regulations.

5.4.6. Inclement weather facility. The contractor shall provide an indoor facility capable of conducting organized team building, team bonding, and leadership development activities in the event of inclement weather.

5.4.7. Zip Line. The contractor shall provide a zip line activity a minimum of 20 ft.

in height at its starting point. Participants shall be attached to the zip line in a manner which ensures the cadet cannot fall even if they fail to maintain physical control of themselves. The contractor shall provide a minimum of five (5) safety trained and certified personnel along with all necessary ropes, harnesses, safety helmets, and other associated equipment necessary to safely conduct zip line activities.

5.4.8. Water Activities. The contractor shall provide access to an outdoor swimming location which allows for drown proofing training with a minimum of two (2) certified lifeguards.

5.4.9. Land Navigation and Orienteering.

5.4.9.1. The contractor shall provide a building or large room in a building equipped with tables and chairs for cadre to use while teaching cadets land navigation classes.

5.4.9.2. The contractor shall provide an area that is a mix of wooded, brushy and open area that is a minimum of 10 acres in which cadre may create and conduct a land navigation course.

5.4.10. Ceremonies. The contractor shall provide an area 1 to 2 acres in size to conduct organized athletics/graduation ceremonies.

4.4.10. Transportation. The contractor shall provide transportation between lodging and training areas during training events.

5.5. Other Training events

5.5.1 The contractor shall provide organized team building, team bonding, and leadership development activities during the requested times.

5.5.2. The contractor shall provide properly trained staff to facilitate all organized activities.

PART 6

APPLICABLE PUBLICATIONS

6.1. The Contractor shall abide by all current regulations, publications, manuals, and local policies and procedures to include but not limited to:

6.2. Contractor shall have knowledge of safety awareness, such as Occupational Safety and Health Association, (OSHA), proper clothing and footwear.

6.3. Contractor shall be knowledgeable of rappelling and rope climbing regulations, including Army TC-21-24 Rappelling and ISO 22846-1 for protective clothing, equipment and how to conduct.
