PERFORMANCE WORK STATEMENT (PWS)

Clear Creek Independent School District (CCISD)

JROTC LEADERSHIP CHALLENGE (JCLC)

United States Army Cadet Command

5th Brigade JROTC Programs 18-20 June 2024

Part 1 General Information

1. General: This is a non-personnel services contract to provide services to support to Clear Creek Independent School District (CCISD) 2024 JCLC. The Government shall not exercise any supervision or control over the contract service providers performing the services herein.

Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

1.1 Description of Services/Introduction: The contractor shall furnish lodging accommodations, meal services, training facilities, furniture, equipment, supplies, management, supervision, and labor as specified herein, for the JCLC Leadership Challenge Exercise, 18-20 June 2024. The contractor shall perform to the standards in this contract.

1.2 Background: JCLC is an annual requirement for all JROTC units. The camp is required to have proven capabilities to provide co-located lodging accommodations, meal services, specialized training facilities/activity areas, as well as a high ropes course, low ropes course, orienteering, swimming pool and a science/technology activity to support the CCISD JCLC.

1.3 Scope: The Contractor shall provide non-personal services. The contractor shall furnish facilities, furniture, equipment, supplies, management/administration, supervision, and labor to provide co-located facilities, training facilities, lodging accommodations, and meal services for 50 Cadets and 10 Cadre during the period of 18-20 June 2024 for the CCISD JROTC JCLC.

The contractor shall provide services in accordance with the terms, conditions and specifications set forth in the PWS.

1.4 Objectives: The objectives of this contract are:

• Provide Cadets an opportunity to practice leadership skills in an unfamiliar environment.

• Allow Cadets a chance to participate in citizenship building exercises.

• Give Cadets the opportunity to experience living and interacting with their peers from other units in a military setting.

• Instruct leadership-type skills to Cadets in a “hands on” military type environment.

• Provide an opportunity to participate in adventure training not available to Cadets.

• Take advantage of recreational facilities available and to have fun.

1.5 General Information:

1.5.1 Quality Control Plan (QCP): The contractor’s existing quality assurance system shall be utilized in accordance with FAR 12.208.

1.5.2 Quality Assurance: The Government will evaluate the Contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the Contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the acceptable quality levels (performance thresholds).

1.5.3 Recognized Holidays: The following provides information on recognized holidays for the purpose of the PWS. If submission of any documentation (e.g. deliverables, submittals, etc.) deadlines fall on a holiday, the closest workday prior to the holiday will apply as the deadline for submittal.

1.5.3.1 U.S. Holidays: Work shall not be performed on U.S. federally recognized holidays occurring during the normal workweek unless otherwise directed by the Contracting Officer.

When a U.S. holiday occurs on a Saturday or a Sunday, the holiday is observed on the preceding Friday or following Monday, respectively.

1.5.4 Operating Hours: The Government facility office hours, facility operating hours, and the Contractor support hour requirements often coincide, however, they may differ. Please refer to the following.

1.5.4.1 Government Facility Office Hours: Reserved.

1.5.4.3 Contractor Support Hours: The contractor is responsible for conducting business, between the hours of 1100 hours 18 June 2024 thru 1600 hours 20 June 2024. The Contractor shall have medical coverage and camp management personnel available to assist 24 hours a day during the entire JCLC. Training and dining facility personnel will be available to support training in accordance with the training schedule 0600-2100.The Contractor shall at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS for the period stated. Contractor shall keep in mind that the stability and continuity of the workforce are essential.

1.5.5 Training Holidays: Reserved.

1.5.6 Place of Performance: The work to be performed under this contract shall be performed within 250 miles of the League City, TX. Contractor shall perform services at the contractor facility.

1.6 Security Requirements: The following information is provided on security related matters. Contractor personnel performing work under this contract do not require a security clearance however they must be able to pass the security requirements to enter Camp Navajo.

Requirements shall be obtained from Camp Navajo. All contractors and any subcontractors must have approval to enter the installation at time of the proposal submission and must maintain the level of security required for the life of the contract. Contractor and all associated sub-contractors’ employees shall provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy.

1.7 Key Control: The Contractor shall establish and implement methods of making sure all keys are accounted for by key control. Such procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas. The Contractor shall immediately report any occurrences of lost or duplicate keys to the Contracting Officer.

1.8 Post Award Conference/Periodic Progress Meetings: The Contractor shall attend any post award conference convened by the contracting activity or contract administration office in accordance with FAR Subpart 42.5. The Contracting Officer, COR, and other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor's performance. At these meetings the Contracting Officer will apprise the Contractor of how the Government views the Contractor's performance and the Contractor shall apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the Government.

1.8.1 The Contractor shall attend, participate in, and furnish input to scheduled and unscheduled meetings, conferences, and briefings that relate to the functions and services herein as required by the Government to provide effective communication and impart necessary information. The Contract Manager or designated representative shall attend meetings as requested by the Government. Meeting attendees shall at times include Contractor managerial, supervisory, and other personnel knowledgeable of the subject matter. Meetings may start or end outside of regular duty hours.

1.9 Contracting Officer’s Representative (COR): Refer to Part 2 of this PWS for the definition of a COR. As determined by the Contracting Officer, a COR will be appointed and identified by letter of designation, a copy of which will be provided to the Contractor by the Contracting Officer. The designation letter states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates, or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order. The COR monitors all technical aspects of the contract and assists in contract administration. The COR is not authorized to obligate the Government. If the work is not written in the contract, the COR is not authorized to request new work. The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract, perform inspections necessary in connection with contract performance, maintain written and oral communications with the Contractor concerning technical aspects of the contract, issue written interpretations of technical requirements, including Government drawings, designs, specifications, monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies, coordinate availability of Government property, and coordinate site entry of Contractor personnel.

1.10 Key Personnel: The following personnel are considered key personnel by the government: Camp Director. The contractor shall provide a camp director who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the contracting officer. The camp director or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The camp director or alternate shall be available between 0800-2000, Tuesday through Thursday.

1.11 Identification of Contractor Employees: All Contractor personnel attending meetings, answering Government telephones, and working in other situations where their Contractor status is not obvious to third parties must identify themselves, to include proper marking of signature blocks in correspondence, to avoid creating an impression in the minds of members of the public that they are Government officials. The Contractor shall ensure that all documents or reports produced by Contractors are suitably marked as Contractor products or that Contractor participation is appropriately disclosed.

1.17 Protection of Government and Contract Information: Per Public Use Notice of Limitations stated by Defense imagery Management operations Center and contained at www.dimoc.mil/resources/limitations/ , the Contractor shall not cite any information (e.g., contract information, pictures, locations, etc.) obtained through this contract on any hard copy or digital marketing tools to include its company website.

PART 2

DEFINITIONS & ACRONYMS

2. Definitions and Acronyms

2.1 Definitions: Although not inclusive of every term used within this PWS, the following provides a list of definitions used throughout this PWS and commonly used in the acquisition field.

Contracting Officer – means a person with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings on behalf of the Government. Note: The only individual who can legally bind the Government.

Contracting Officer's Representative (COR) – As defined in DFARS 202.101, means an individual designated and authorized in writing by the Contracting Officer to perform specific technical or administrative functions. DoD Instruction (DoDI) 5000.72, Part II Definitions states the following when defining a COR: “Defined in subpart 202.101 of Reference (f). Any individual delegated responsibilities pursuant to subpart 1.602-2 of Reference (e), regardless of local terminology, must be certified in accordance with this instruction. For example, local terminology can be COR, Contracting Officer’s technical representative, technical point of contact, technical representative, alternate COR, administrative COR, assistant COR, line-item manager, task order manager, quality assurance personnel, quality assurance evaluator, or COR management.” In addition, Army Regulation 70-13, Chapter 2, paragraph 2-2g, states, in part, the following when providing other surveillance support personnel to assist the COR when needed, “…These other surveillance support personnel may serve as on-site representatives of the COR in performance of actual contract surveillance if they meet all COR requirements and have been appointed by the Contracting Officer as alternate CORs.”

Contractor – means a supplier or vendor awarded a contract to provide specific supplies or service to the Government. The term used in this contract refers to the prime.

Day – means, unless otherwise specified, a calendar day.

Defective Service – means a service output that does not meet the standard of performance associated with the Performance Work Statement.

Deliverable – means anything that can be physically delivered but may include non-manufactured things such as meeting minutes or reports.

Government-furnished Property – As reflected in FAR 52.245-1, Government-furnished Property “means property in the possession of, or directly acquired by, the Government and subsequently furnished to the Contractor for performance of a contract. Government-furnished property includes, but is not limited to, spares and property furnished for repair, maintenance, overhaul, or modification. Government-furnished property also includes contractor-acquired property if the contractor-acquired property is a deliverable under a cost contract when accepted by the Government for continued use under the contract.

Government Property - means all property owned or leased by the Government. Government property includes both Government-furnished and Contractor-acquired property. Government property includes material, equipment, special tooling, special test equipment, and real property. Government property does not include intellectual property and software.

Property Administrator - means an authorized representative of the Contracting Officer appointed in accordance with agency procedures, responsible for administering the contract requirements and obligations relating to Government property in the possession of a Contractor.

Physical Security – means that part of security concerned with physical measures designed to safeguard personnel; to prevent unauthorized access to equipment, installations, material, and documents; and to safeguard against espionage, sabotage, damage, and theft.

Quality Assurance – (or Government contract quality assurance) means the various functions, including inspection, performed by the Government to determine whether a Contractor has fulfilled the contract obligations pertaining to quality and quantity.

Quality Assurance Surveillance Plan (QASP) – means the key Government-developed surveillance process document, and is applied to Performance-Based Service Contracting (PBSC). The QASP is used for managing Contractor performance assessment by ensuring that systematic quality assurance methods validate that Contractor quality control efforts are timely, effective, and are delivering the results specified in the contract or task order. The QASP directly corresponds to the performance objectives and standards (i.e., quality, quantity, timeliness) specified in the Performance Work Statement (PWS). It provides specific details on how the Government will survey, observe, test, sample, evaluate, and document Contractor performance results to determine if the Contractor has met the required standards for each objective in the PWS. The QASP, with very few if any exceptions, is an internal to Government document.

Quality Control – means all necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.

Statement – means the specific results-based activities required to satisfy HLOs. A statement contains a result, the context of the statement, and the required action(s). Statements focus on “what” is to be accomplished; however, they are not prescriptive in describing “how” the outcome is to be achieved. Each HLO may have several statements to flesh out the areas necessary to meet the objective. Statements are similar to Level 3 in a Work Breakdown Structure.

Subcontractor – means one that enters into a contract with a prime Contractor. The Government does not have privity of contract with the subcontractor.

Workday - The number of hours per day the Contractor provides services in accordance with the contract.

Work Week - Monday through Friday, unless otherwise specified.

2.2 Acronyms: Although not inclusive of every term used within this PWS, or that may be included in an acquisition, the following provides a list of acronyms commonly used in the acquisition field.

3. Government Property and Services

3.1 There are no government provided property or services.

CONTRACTOR FURNISHED ITEMS AND SERVICES

4. Contractor Furnished Property and Services

4.1 General: The Contractor shall furnish all supplies, equipment, facilities, and services required to perform work under this contract that are not listed under Section 3 of this PWS.

4.2 Materials: The Contractor shall provide all co-located facilities, meal services, food, training areas, and training equipment. Training equipment and materials provided must be serviceable and safe for use. Contractor shall furnish necessary materials such as food, disposable plates, cups, napkins, and utensils for each meal and serving equipment to perform under this contract. Facilities shall include adequate gender separate lodging for 50 Cadets and 10 Cadre as well as, specialized training facilities/activity areas, as well as a high ropes course, low ropes course, orienteering, swimming pool and a science/technology activity to support the CCISD JCLC. Contractor shall provide the minimum number of trained instructors to support the different training venues to conduct a safe training event.

SPECIFIC TASKS

5.1 Basic Services: The contractor shall furnish facilities, furniture, equipment, supplies, medical services, tools, management, supervision and labor as specified herein to provide co-located facilities, training facilities, lodging accommodations and meal services for 50 Cadets and 10 Cadre during the period of 18-20 June 2024 for the CCISD JROTC JCLC. Contractor shall provide co-located facilities within 5-minute walking distance of each other. The contractor shall provide services in accordance with the terms, conditions and specifications set forth in this PWS.

5.2 Tasks: Tasks consist of the following:

5.2.1 Lodging Requirements and Specifications: The contractor’s facilities shall be co-located to the training facilities, dining facility and meet the following minimum standards:

5.2.1.1 The contractor shall provide fixed-facility, climate-controlled lodging accommodations with adequate ventilation and personal space for 50 Cadets and 10 Cadre participating in the CCISD JCLC. Lodging accommodations shall include male and female bathhouses equipped with toilets, toilet paper, sinks, hand soap, paper towels, running hot water, showers with privacy draping and changing areas.

5.2.1.2 Male and female Cadets will be lodged separately. Female Cadre will be lodged near female Cadets and Male Cadre will be lodged near male Cadets to ensure appropriate supervision and accountability.

5.2.1.3 The Contractor shall provide non-smoking sleeping facilities that are furnished solely based on one individual to a bed/cot. Rooms which house multiple cadets or “open bay” type rooms are acceptable. Contractor shall provide all bedding including sheets, blankets, pillows and pillowcases.

5.2.1.4 The Contractor facility shall not be undergoing renovation or remodeling during the time of the camp and not be located within an area considered a high crime area or designated a high crime area as determined by local police statistics.

5.2.2 Meal Requirements:

5.2.2.1 Contractor will provide a co-located dining facility to accommodate 50 Cadets and 10 Cadre and all food and condiments for use at each meal.

5.2.2.2 Contractor will provide serving equipment, chafing dishes, heating elements to maintain food temperature, serving utensils, disposable plates, cups, napkins, and utensils for each meal.

5.2.2.3 Contractor will wipe down and sanitize all tables at the serving location as well food preparation area and equipment. Contractor shall supply all cleaning supplies.

5.2.2.4 Contractor shall set-up all food and serving areas, tables, chairs, and other equipment a minimum of 30 minutes prior to each meal start time as coordinated with the Government

POC.

5.2.2.5 Contractor shall tear down each meal service upon completion and remove all debris from the site.

5.2.2.6 Meals: The contractor shall provide the following quantity of meals to Cadets and Cadre during the dates and times indicated below:

5.2.2.7 Menus. The contractor shall provide a menu like the following for each meal. All meals shall be served hot (as applicable). The menu shall be coordinated with the Government POC a minimum of 10 calendar days prior to the event and any changes agreed upon at that time.

5.2.3 Hydration Stations: Contractor shall provide unlimited amount of water and ice per day for use throughout the JCLC. Sufficient commercial water containers for 60 persons shall be located throughout the camp. Contractors shall fill containers with ice and water throughout the day to keep cold water available, so Cadets and Cadre have cold water available to stay hydrated.

5.2.4 Facilities and Training Facilities

5.2.4.1 The contractor shall provide co-located training facilities to include high ropes, low ropes, orienteering course, a science/technology activity and a swimming pool for a water safety course. The contractor shall provide trained personnel throughout the training facilities.

5.2.4.2 The contractor shall provide one (1) safe and maintained swimming pool with both shallow and deep areas capable of accommodating 25 cadets at a time, all with diverse swimming skill levels as well as adequate, certified lifeguards/spotters.

5.2.4.3 The contractor shall provide an outdoor training area capable of accommodating 50 Cadets. This area shall include a pit designed for the creation of a campfire.

5.2.4.4 The contractor shall provide an outdoor open field of at least 110 meters by 110 meters, with certified instructors, for night land navigation training. This area can include wooded areas as that emphasizes the importance of proper navigation techniques.

5.2.4.5 The contractor shall provide “high ropes” and “low ropes” venues for Cadet leadership and confidence building. The contractor shall ensure all necessary equipment and certified instructors are available to complete the high and low rope training during the duration of the JCLC. The contractor shall provide two (2) days of use of the high ropes & challenging outdoor personal experience C.O.P.E. course. Contractor shall provide qualified and trained instructors. The contractor shall provide qualified and trained instructors on COPE course.

5.2.4.6 The contractor shall provide an outdoor flat surface area 100 feet by 100 feet or space large enough for a platoon of 20 cadets marching drill competition.

5.2.4.7 Contractor shall provide a facility for processing and camp operations center for staff and HQ.

5.2.4.8 Contractor shall provide access to emergency services. Specifically, contractor will call 911 in case of emergency.

5.2.4.9 Contractor shall provide portable latrines at each remote training location where permanent bathroom facilities are not readily accessible with toilet paper and cleaning services. Contractor shall coordinate with Cadre for placement. Examples of such training sites may include land navigation course, marksmanship range, tower operations and water session areas.

5.2.4.10 The Contractor shall make the dining facility and equipment for inclement weather available. Inclement weather equipment includes lightning protective shelters, dining facilities, and other hard structures.

5.2.4.11 The contractor shall provide a leadership reaction course and instructors.

5.2.5 Fire and Safety. The contractor's facility shall comply with applicable fire and safety codes and regulations.

5.2.6 Security. The contractor shall provide security to ensure participants are in a safe and crime free environment.

5.2.7 Taxes. The government is exempt from paying any sales taxes related to this contract.

Tax exemption forms will be provided to the contractor upon request.

5.2.8 Courtesy. The contractor's employees shall be courteous to all persons served under this contract. Courtesy rendered shall be equal to that rendered to other customers of the establishment and equal to that expected of any public lodging facility. Services and consideration provided to all guests shall be provided to event participants.

5.2.9 Contractor Personnel Attire. Contractor personnel shall wear clothing that is clean, does not contain statements that may be offensive to others.

5.2.10 Miscellaneous Services. The contractor shall not be responsible for any miscellaneous charges incurred by the JCLC participant. The contractor shall explain to the participant that miscellaneous services are not covered by this contract and are payable by the participant, such as personal telephone charges, internet service, meals in excess of the contract requirements, and other such services.

5.2.11 Landline Telephone: The contractor shall provide at least one landline telephone available throughout the whole camp and facilities, for use as needed during the JCLC.

PART 6

APPLICABLE PUBLICATIONS

Performance Requirements Summary (PRS)

The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success.

PWS Para. 5.2.1 The contractor shall provide lodging accommodations for 50 Cadets and 10 Cadre who are participating in the JROTC JCLC 18-20 June 2024. Lodging accommodations must include one bed/cot per individual.

Contractor shall provide co-located facilities within 5-minute walking distance.

Lodging accommodations provided with bed, tents, pavilion areas with screened rooms, and necessary bathhouses. Is not undergoing renovation or remodeling during the time of the camp and not located within an area considered a high crime area or designated a high crime area as determined by local police statistics. The contractor's facility shall comply with applicable fire and safety codes and regulations.

100% of the time that this must be provided to be successful

PWS Para. 5.2.2 The contractor shall provide timely meals for 50 Cadets, and 10 Cadre participating in the JCLC, 18-20 June 2024. Meals served co-located to lodging and training facilities.

Meals served are nutritious, hot, filling, and of appropriate temperature. The contractor shall have meals prepared to serve 30 minutes prior to the serving times indicated in the PWS.

Meals served 100% of the time.

PWS Para. 5.2.4 Contractor shall provide co-located training facilities to include high ropes, low ropes course, orienteering, swimming pool and a science/technology activity to support the CCISD JCLC.

Contractor shall provide trained staff members at the facility.

Contractor shall provide lifeguards. Contractor shall provide all training equipment for the facility.
