FAR Part 16 Exception to Fair Opportunity Justification Under Multiple Award Indefinite Delivery Contracts

For Actions Exceeding the Simplified Acquisition Threshold (SAT)

1. Contracting Activity: U.S. Army Mission and Installation Contracting Command – Fort Knox (MICC – FT Knox), 199 6th Avenue, Suite 250, Fort Knox, KY40121-5720

2. Description of Action: HRC requests a Firm-Fixed-Price delivery order for renewal of Crossmatch WEBS maintenance for the existing perpetual licenses. The Government projects award for April of Fiscal Year (FY) 2020. Operations and Maintenance, Army (OMA) funding in the amount of will be provided by Purchase Request 0011393241 for this contract action.

An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).

3. Description of Supplies: Crossmatch’s WEBS software maintenance is a web-based approach for the collection and management of fingerprint enrollment data. The fingerprint data is required for all applicants for criminal background check. This procurement provides the United States National Guard Bureau (NGB) the necessary software maintenance to utilize the existing web based fingerprint enrollment system that is currently installed on the HRC Data Center infrastructure. The WEBS system consists of servers located in the HRC Data Center and the workstations with OEM Fingerprint Capture Devices are located at the recruiting stations used by the ARNG. The maintenance on the software licenses for WEBS Enrollment Servers allows for patches and incident tickets related to the servers to be submitted. The capacity packs allow the workstations with OEM Fingerprint Capture Devices to connect to the WEBS enrollment server. The following software maintenance is needed for this procurement:

Item Item Description Part/Serial Number QTY & U/I

WEBS Enrollment Server Capacity

Pack Software Maintenance (Perpetual License)

950093-12 340 each

WEBS Enrollment Redundant Server Software Maintenance

(Perpetual License) 950094-12 Four (4) each

Period of Coverage: 1 April 2020 through 31 March 2021

Total Value:

4. Authority Cited: FAR 16.505(a)(4) – Restricting consideration to an item peculiar to one manufacturer (e.g., a particular brand-name, product, or a feature of a product that is peculiar to one manufacturer.

5. Reason for Authority Cited: As further described in FAR 16.505(a)(4)(i), the contracting officer must justify restricting consideration to an item peculiar to one manufacturer (e.g., a particular brand-name, product, or a feature of a product that is peculiar to one manufacturer). A brand-name item, even if available on more than one contract, is an item peculiar to one manufacturer. Brand-name specifications shall not be used unless the particular brand-name, product, or feature is essential to the Government’s requirements and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.

This is the annual maintenance renewal for the NGB’s portion of the existing web-based fingerprint enrollment capability for the Recruiting Services Network (RSN). This capability is used by Recruiters for all Army Components and integrated into a single system. The Active Duty and USAR maintenance is handled under a separate maintenance agreement. The Crossmatch capacity pack licenses are required to connect to the existing Crossmatch Proprietary Fingerprint Capture devices used by the NGB in the 54 states and territories to connect to the Crossmatch WEBS software. The maintenance agreement provides for security patches and technical support for the Crossmatch WEBS software.

Alternatives:

a. Do not renew the software maintenance: This will hamper the ability of the NGB recruiters to obtain fingerprints for background checks on applicants. It will also impact the cybersecurity posture of the WEBS software and violate AR 25-2, Army Cybersecurity, which requires vendor provided security patches for applications be available.

b. Procure new software and hardware for finger print capability: This would significantly expand the current procurement from software maintenance renewal to a complete new system. The current system uses proprietary hardware and software to provide the current fingerprint capability. Any new system would require a hardware and software procurement.

c. Return to a client based scanning capability: The WEBs software followed the ARMY CIO/G6 guidance to migrate systems from being legacy client server to being cloud capable. The original WEBS software procurement in 2017 move the client server system of finger prints and other PII data being stored on the recruiter’s laptop to a cloud capable architecture. This move reduced the potential cyber security impact of spillage of PII data stored on the recruiter’s laptop. It also streamlined the fingerprinting process. Moving back to a client server architecture will increase the risk of a PII spillage and complicate the fingerprinting process currently in use.

d. Impact if not approved: This will hamper the ability of the NGB recruiters to obtain fingerprints for background checks on applicants. This can cause unqualified

6. Actions to Increase Competition: The products to be acquired with this acquisition fit within the framework of a larger end-to-end system therefore, no other brands were considered. Army Regulation 25-1, Army Information Technology, directs commands to plan for a life cycle of existing IT equipment. Based on a Five (5) year life cycle replacement cycle, this system will be reviewed in FY 22 for possible replacement options.

7. Market Research: Crossmatch will allow all CHESS vendors to be an authorized reseller of their products. In accordance with the ITES-3H Ordering Guide, NAICS code 334111 is required for the utilization of ITES-3H contract vehicle. Two CHESS vendors indicated that they could provide this maintenance.
