FAR Part 6 Justification and Approval for Other than Full and Open Competition
1. Contracting Activity: Mission and Installation Contracting Command (MICC) Center- Fort Knox, 199 6th Avenue, Fort Knox KY 40121-7520
2. Description of Action: The United States Army Human Resources Command (HRC) request an exception to fair opportunity for the renewal of Kofax software support for HRC. Kofax software, all software updates and support are proprietary therefore HRC will require a Brand Name Justification. The Government projects award for 1 July 2021 and will use Operations and Maintenance, Army (OMA) funds.
An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d) (i) (B).
3. Description of Supplies: Kofax Software Licenses
KOFAX Software One Year Renewal for the following serial numbers: TG59462, WC37658, WH14744, XA27132, XK43061, XK43148, XK43147, XK43145, YA45825, YA45826, UI49070, UI49071, UI49072, UG46923, TG59462, VF22391, UK60323, UK60324, CM33261, CM33260.
Period of Coverage: 1 July 2021 to 30 June 2022
Total Value: $445,200.86
4. Authority Cited: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2) and 6.302-1(c), Only one responsible source and no other supplies or services will satisfy agency requirements, and brand name descriptions.
5. Reason for Authority Cited: In 2010, HRC purchased approximately $1.9 million of KOFAX unlimited licenses designed for use within the command. HRC owns these licenses in perpetuity but continues to require software patches, updates, and telephonic support. KOFAX software's ability to classify and extract document types uniquely fulfills the HRC mission to digitally classify and process Soldier records for varied Human Resource systems and for the Soldier. HRC has used KOFAX extensively for over a decade and has a significant repository of KOFAX configuration files, as well as a fully qualified staff and trained workforce that uses KOFAX as an integral aspect of their day to day work processes. KOFAX is the only manufacturer and provider of support for the licenses HRC procured in 2010 and continues to use daily.
The KOFAX Software Renewal requested will provide software support to an existing system. The software support required must be provided with brand name specifications to ensure continuity of operations and will prevent data loss and potential network intrusions from third party software. The software used on the KOFAX system has an approved Certificate of Net-worthiness (CON). If a different brand of software were procured, the software would have to go through the CON approval process and

Version – March 2018 FOR OFFICIAL USE ONLY user/operators would have to be retrained resulting in an immeasurable amount of downtime. In addition, the current environment includes existing KOFAX systems, management tools in use as well as KOFAX dependent systems and applications. If support other than KOFAX is used these tools and applications will fail or result in various compatibility issues which would further delay mission success. The KOFAX systems are also utilized to support the storage requirements for mission critical data.
The potential use of another vendor would result in substantial investment costs and an immeasurable amount of downtime that would be detrimental to mission success
6. Efforts to Obtain Competition: U.S. Army HRC continues to solicit offers for its requirements from as many potential sources as is practicable but the KOFAX Software cited is not available from CHESS and is proprietary to KOFAX.
7. Actions to Increase Competition: U.S. Army HRC continues to solicit offers for its requirements from as many potential sources as is practicable. The KOFAX Software cited is not available from CHESS. There is an ongoing effort to automate administrative tasks to the fullest extent possible, thus reducing the total cost of ownership. Products offering a high degree of automation utilizing the latest technologies will be considered for implementation. Accordingly, the HRC will continue to monitor advancements in commercially available information technology products and services, particularly those listed within existing enterprise-related contracts under the Army CHESS Program.
8. Market Research: Information Technology hardware and software is required to be purchased through the Army CHESS program unless a waiver is approved, the current items are not available through the ARMY CHESS. The Statement of Non-Availability (SONA) Request No: 216766631, dated 14 December 2020 has been completed. HRC has determined that the requested support is available on the Solutions for Enterprise- Wide Procurement (SEWP) and via GSA. More than one reseller of Kofax support within these contract vehicles may provide support for HRCs Kofax software.
