(End of Provision Addendum)
ADDENDUM TO FAR 52.212-2, EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) This acquisition will be conducted as Low Price Technically Acceptable (LPTA) source selection in accordance with FAR 15.101-2 and USTRANSCOM source selection procedures. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. For a proposal to be considered for award it must comply with all required terms and conditions of the solicitation, demonstrate the technical capability to meet or exceed the PWS requirements, and reflect a fair and reasonable price. Included in the conditions for award is the requirement to submit a Subcontracting Plan as required by FAR 19.702 which is determined acceptable IAW FAR 19.704. Contractors whose Subcontracting Plans are determined unacceptable shall not be considered for award. Each offeror’s past performance will be considered in the Government’s responsibility determination for that offeror. Each offeror’s responsibility will be determined IAW the criteria specified in FAR 9.104-1. The Government intends to evaluate proposals and award a contract without conducting discussions.
Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a price and technical standpoint. The Government reserves the right, however, to conduct discussions, written and/or oral, with offerors if it is determined to be in the Government’s best interest.
(b) The Government intends to award a single contract as a result of this solicitation. The government reserves the right not to award a contract based on the quality, quantity of proposals received and funding availability. In addition to meeting all terms and conditions of the solicitation, each offeror's proposal will be evaluated against the following:
(1) Evaluation criteria:
a. Technical
b. Price
(c) As this is a LPTA procedure, tradeoffs will not be permitted for the initial contract award and proposals will be evaluated for acceptability but not ranked. Each offeror’s technical approach will be rated as acceptable or unacceptable.
Only technically acceptable proposals will be considered further. An award will be made to the lowest-priced technically acceptable offeror whose proposed prices are determined to be fair and reasonable.
(d) Factor 1 – Technical Approach: Each offeror’s Technical Capability Proposal will be evaluated as Acceptable or Unacceptable, as defined below.
Technical Approach Acceptable/Unacceptable Ratings Adjectival Rating Description Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
If any technical factor is rated as Unacceptable, the overall technical rating will be Unacceptable. If all technical factors are rated as Acceptable, then the overall technical rating will be Acceptable. Unacceptable proposals fail to meet specified minimum performance or capability requirements; proposal has one or more deficiencies. Proposals with an unacceptable rating will not be considered further. A proposal may be rated as unacceptable if the Government determines that the route(s) offered are not feasible within the present Courier Station Network. Offers proposals must receive a rating of Acceptable for all technical factors in order to be considered for award:
To be rated Acceptable, the approach must meet specified minimum performance or capability requirements delineated in the Request for Proposal.
(e) Factor 2- Price: The Government will evaluate the offerors price by taking the Passenger Round Trip Seat Price multiplied by 2 plus the per lb cargo Price multiplied by the inbound and outbound historical/estimated weights.
The amount calculated above for each route will be multiplied by the estimated number of missions per route for the base period and all option periods to include the six month extension on routes 1 through 13 to determine the Total Evaluated Price. Below is an example of how this will be calculated:
EXAMPLE: [2 Passengers x Seat Price + (Outbound + Inbound lbs) x cost per lb.] x # of Missions = Evaluated Route price. All 12 routes for base, options and six month extension combined provide the Total Evaluated Price.
The Government will conduct a price analysis to determine whether the proposed prices are fair and reasonable.
This determination may be accomplished by one or more of the techniques set forth in FAR 15.404-1(b)(2). The Contracting Officer will fully document the price evaluation. Submission of unrealistically low prices submitted initially or subsequently, may be grounds for eliminating a proposal from the competition on the basis that the offeror does not understand the requirements or has made an improvident proposal. Further, the Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.
If the Government extends the contract pursuant to FAR 52.217-8, Option to Extend Services, such extension will be at the rates in effect under the contract when the final option is exercised. The Government will consider the total evaluated price of each proposal when making a best value decision. For the Total Evaluated Price (TEP) calculation, pricing for a 6-month extension of services period will be based on the prices proposed in the offeror’s final Option Period. Offerors shall not submit a price for the potential 6-month Extension of Services.
(f) Options. The Government will evaluate the offeror's total price by adding the total price of the base requirement, all option periods, and the total price for the 6-month Extension of Services. Evaluation of options shall not obligate the Government to exercise the option(s).
(g) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(h) The Government intends to award a contract without discussions with respective offerors. The Government, however, reserves the right to conduct discussions if deemed in its best interest.
(i) Communication conducted to resolve minor or clerical errors will not constitute discussion, and the Contracting
Officer reserves the right to award a contract without the opportunity for proposal revision.
(j) The Government reserves the right to award no contract at all depending on the quality of the proposals submitted and availability of funds.
(k) The following conditions shall be met in order to be eligible for award:
(1) The offeror must be determined responsible according to the standards in FAR subpart 9.1.
(2) Pursuant to 32 C.F.R. §861.4, the offeror must be a DOD Approved Air Carrier at the time of proposal submission.
(3) Pursuant to 49 U.S. Code §41106, the offeror must be a participant in the Civil Reserve Air Fleet
(CRAF) program, unless no CRAF participant is available.
(4) The offeror must submit a Subcontracting Plan as required by FAR 19.702 determined acceptable
IAW the requirements of FAR 19.704. Airlift services may not be subcontracted. Contractors whose Subcontracting Plans are determined unacceptable shall not be considered for award.
(5) The offeror's proposal must comply with requirements of law, regulation, and all conditions set forth in the solicitation. The offeror's proposal must demonstrate a clear understanding of the nature and scope of work required. Failure to provide a reasonable and complete proposal may reflect lack of understanding of the work requirements of the contract and may result in a determination that the proposal is unacceptable. The Government does not assume a duty to search for clarification data to cure problems or inconsistencies with an offeror's proposal.
(6) Other information submitted by the offeror must comply with the conditions set forth in the solicitation. The Government reserves the right to make the final determination as to whether the other information complies with the conditions set forth in the solicitation.
(7) Non-Government Personnel. No non-Government personnel will be involved in the source selection.
