About this file

This memorandum provides justification for limiting competition to a sole source award. The United States Army Medical Research Acquisition Activity, on behalf of the Walter Reed Army Institute of Research, requires a water purification system to replace an existing failing reverse osmosis machine. The new system must be capable of reusing components from the existing system to reduce costs, increase production capacity, and meet quality standards for laboratory accreditation. Only Neu-Ion High Purity Water Systems can meet these needs to reuse existing components and provide required maintenance services under the fixed price contract valued at $65,866 over a five year period from August 2023 through July 2028. Market research found Neu-Ion to be the only vendor reasonably capable of meeting the requirement.

Memorandum for Record – Limiting Competition at or below the Simplified

Acquisition Threshold

1. Contracting Activity: United States Army Medical Research Acquisition Activity (USAMRAA) on behalf of the Walter Reed Army Institute of Research (WRAIR)

2. Description of Action:

Nature: New Requirement Follow-on Requirement

Contract Vehicle: Purchase Order Number 0011946348

Pricing/Contract Type: Fixed Price Cost Reimbursable Hybrid

Time & Materials/Labor Hours

Funds: Operations & Maintenance, Army (OMA) Other Funds:

Name of Proposed Contractor(s) and Address:

Neu-Ion High Purity Water Systems 7200 Rutherford Rd, Suite 100 Baltimore, MD 21244

Brand Name Buy: Yes No

3. Description of Services or Supplies:

The purpose of this requirement is to procure a water purification system capable of meeting increasing laboratory demands. A water purification system is critical to eliminate impurities from laboratory tap water to ensure appropriate chemical reactions in laboratory experiments. Diagnostics and Countermeasures Branch (DCB) requires uninstallation, removal, and proper disposal of DCB’s existing, failing, Reverse Osmosis (RO) machine as well as delivery and installation of a replacement system with the goal of increasing the RO make up rate to the storage tank. The goal is to re-use as many of DCB’s existing water purification system components as possible, to upgrade the level controls to a more robust system, and to replace old piping and minimize any dead legs to the sink in order for the laboratory to process more samples. DCB requires preventative and emergency maintenance services for the new system.

Period of Performance: 1 August 2023 to 31 July 2028 Total Value: $65,866.00 (including option periods)

4. Authority:

FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.

5. Reasons for Authority Cited:

Neu-Ion has been identified as the only vendor capable of meeting DCB’s needs. Neu- Ion has the unique capability where it reuse components from the existing system whereas other sources will not be able to accomplish this aspect as their parts will not be compatible with the existing system requiring duplication of effort and cost in order to achieve the desired outcome. Specifically, utilizing Neu-Ion would save considerable cost from having to purchase an entirely new system and all new components.

Furthermore, the contract will include consumable supplies and required maintenance to support the operation of the Neu Ion High Purity Water system, including quarterly prefilter (city and RO replacements), semi-annual carbon filter replacements, semi-annual mixed bed DI Tank exchanges, annual UV bulb and sleeve replacements, semi-annual postfilter replacements, and annual ventfilter replacement as well as priority dispatch). In addition, Neu-Ion will provide quarterly, written evaluation reports. This standard operating service approach and supportive traceable documentation are guided by ISO 9001 certified quality management systems and are necessary to maintain the laboratories CAP accreditation.

As a result, only one reasonable source, Neu-Ion Technologies Corporation, is capable of meeting the requirement.

6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 do not apply due to the $ threshold, apply and will be followed, or do not apply due to an exception at 5.202

Requirement to post justification in accordance with FAR 8.405-6(b)(3), FAR 13.105(c), or FAR 16.505(a)(4)(iii)(A)

Action is NOT a brand name restriction and is under $250K, no posting required

7. Market Research: Market research was conducted by WRAIR on 26 April 2023, consisting of internet searching, historical contract information, and vendor quote.

Request for Information was posted from 31 May 2023 – 9 June 2023 on SAM.GOV with no responses. A notice of intent was posted for 15 days from 13 June 2023 – 27 June 2023, resulting in no responses.

WRAIR will continue to monitor market development to identify suppliers that may provide the equipment and services in the future, however at this time, Neu-Ion has been identified as the only vendor reasonably capable of meeting DCB’s needs.
