About this file

This is a Justification and Approval (J&A) for Other than Full and Open Competition document (Control Number FY26-0922) issued in October 2024 for a follow-on sole source contract.

The contracting activity is the Defense Health Agency (DHA), Healthcare Contracting Division (HCD) - West, supporting Naval Hospital Camp Pendleton on behalf of NMRTC Camp Pendleton's Ophthalmology Department. The requirement is for Firm Fixed Price repair and maintenance services for government-owned Pentacam ophthalmic equipment. The sole source contractor is OCULUS INC., located at 17721 59th Avenue NE, Arlington, WA 98223-6446. OCULUS INC. is the proprietary distributor and sole manufacturer of Pentacam equipment models (Pentacam Basic, Pentacam HR, Pentacam AXL, and Pentacam AXL Wave) in the United States and provides all repairs and maintenance services through certified in-house technicians. The statutory authority for this sole source acquisition is FAR 12.102(a) for acquisitions valued at or below the simplified acquisition threshold, based on only one source being available. The contracting activity conducted market research and posted a notice of intent to sole source on SAM.gov on August 25, 2026, with a deadline of August 28, 2026 at 4:00 PM PST. No capability statements were received from qualified vendors, and no challenges were filed. This is a follow-on contract to previous contract HT941023P0154, which was also issued under sole source authority due to proprietary repair and maintenance requirements. The document indicates no other vendors have been identified that can provide these specialized proprietary repair and maintenance services.

4. Statutory Authority Permitting Other Than Full and Open Competition:

5. Rationale Justifying Use of Authority Cited:

NMRTC Camp Pendleton has a mission requirement to provide quality medical care to patients.

To meet this requirement, NMRTC Camp Pendleton is required to maintain all equipment ready for use for surgical and clinical procedures. Medical equipment must be maintained at peak efficiency with little to no down time to meet the demands of mission requirements. In support of quality efficiency, all Oculus Inc. equipment require qualified Oculus Technicians who are able to understand the complex medical equipment and provide immediate solutions and or replacements needed. OCULUS INC. is the sole manufacturer and service repair of equipment in question. As such, a sole source letter has been provided by the vendor stating: OCULUS, Inc.

is the proprietary distributor of the Pentacam® Basic, Pentacam® HR, Pentacam® AXL, and Pentacam® AXL Wave in the United States. All repairs and services are done in-house by certified OCULUS Service Technicians.

6. Efforts to Obtain Competition:

Other than the proposed contractor, OCULUS, Inc., market research did not identify any other options for qualified vendors to provide Pentacam Equipment Repair and Maintenance Services. As this is a follow-on contract, the contractor has been under a sole source agreement for several years and previous market research has not identified any other vendors that could provide these proprietary repair and maintenance services. A notice of intent to sole source was posted SAM.gov on Aug 25, 2026, and did not receive any capability statements from qualified vendors by the 28 AUG 2026 4:00 PST deadline. No challenges were received in regard to this posting.

7. Actions to Increase Competition/Remove or Overcome any Barriers to Competition:

In the future, DHA will examine other similar equipment, if the Pentacam Equipment fails to meet customer criteria and published capabilities to meet the needs of the customer. In accordance with FAR Part 5.101 regulations, a notice of intent to sole source will be posted on SAM.gov to see if any new vendors have entered the market that are able to meet the published criteria to meet the customer’s needs and required specifications.

8. Market Research:

As noted above, Other than the proposed contractor, OCULUS, Inc., market research did not identify any other options for qualified vendors to provide Pentacam Equipment Repair and
