About this file
This is a Notice of Intent to Sole Source a supply purchase order issued by the Defense Health Agency Contracting Activity (DHACA), Healthcare Contracting Division – West. The contracting officer intends to award a firm fixed price supply purchase order to Globus Medical North America Inc. (UEI: VTF5Y1Z1WVX9, CAGE: 7JM67) for the Precice Nail System and Anthem Tibia Plate System for use in the Naval Medical Center San Diego (NMCSD) Orthopedics Department. The procurement is being conducted under FAR 12.102(a) for commercial products. The NAICS code is 339112 (Surgical and Medical Instrument Manufacturing) with a business size standard of 1,000 employees, and the Product Service Code is 6515 (Medical and Surgical Instruments, Equipment and Supplies). Delivery is required no later than August 12, 2026, to Naval Medical Center San Diego, 34800 Bob Wilson Drive, San Diego, CA 92134.
The justification for sole source procurement centers on patient safety and clinical necessity. NMCSD has a patient currently undergoing complex orthopedic limb-lengthening procedures using the proprietary Precice Nail System, which allows remote, non-invasive bone length adjustments. As of January 2025, Globus Medical North America became the exclusive manufacturer and distributor following the transfer of all Precice distribution activities from NuVasive. Substituting an alternative system mid-treatment would require invasive surgery to remove and replace the existing implant, creating unacceptable clinical risks including infection, prolonged recovery, and procedural complications. Additionally, NMCSD's orthopedic surgeons are highly trained in this specific system, and introducing different technology would require new training and create operational unfamiliarity that could compromise surgical precision. Vendors challenging this sole source determination must submit capability statements (not exceeding four pages, 8.5" x 11" format, 10-point minimum font) including management, technical, and cost data with supporting evidence by 1000 Pacific Daylight Time, Tuesday, August 4, 2026, to Cha-on Gordon (cha-on.p.gordon2.civ@health.mil) or Michelle Sanders (michelle.e.sanders6.civ@health.mil). Telephone requests will not be accepted.

Notice of Intent to Sole Source HT941026N090
THIS IS A NOTICE OF INTENT TO AWARD A SOLE SOURCE SUPPLY CONTRACT AND
IS NOT A REQUEST FOR COMPETITIVE QUOTES. The Defense Health Agency Contracting Activity (DHACA), Healthcare Contracting Division – West (HCD-W), intends to award a firm fixed price supply purchase order for the Precice Nail System and Anthem Tibia Plate System for use in the Naval Medical Center San Diego (NMCSD) Orthopedics Department in accordance with Federal Acquisition Regulation (FAR) 12.102(a) under the Revolutionary FAR Overhaul (RFO) for the acquisition of commercial products and services.

Delivery Date:

Naval Medical Center San Diego 34800 Bob Wilson Drive San Diego, CA 92134
Globus Medical North America, Inc. is the sole source capable of meeting the Government’s minimum requirements to provide the critical supplies required for the proprietary Precice Nail System and Anthem Tibia Plate System at NMCSD. These medical supplies are vital to maintaining the continuity and safety of care for an NMCSD patient currently undergoing a series of complex orthopedic limb-lengthening procedures. The Precice Nail System and Anthem Tibia Plate System utilize proprietary internal nails and plates that allow for remote, non-invasive adjustments of bone length—a foundational component of this patient’s active treatment plan. As of January 2025, all distribution activities for Precice technologies were officially transferred from NuVasive to its affiliate, Globus Medical North America, Inc., establishing Globus Medical as the exclusive manufacturer and distributor of these components. Introducing an alternative system mid-treatment would require invasive surgery to remove and replace the existing implant, introducing unacceptable clinical risks such as infection, prolonged recovery times, and procedural complications. Furthermore, NMCSD’s orthopedic surgeons are highly trained and proficient in the precise operation of this specific system; introducing a different technology would require new training, present a steep learning curve, and create operational unfamiliarity that could compromise surgical precision. Because changing systems would interrupt essential care and cause undue harm to the patient, procuring these proprietary supplies directly from Globus Medical North America, Inc. is the only medically viable option to ensure patient safety and clinical success.
This notice of intent is not a request for competitive proposals, and no formal solicitation document exists for this requirement. Sources interested in responding to this notice are required to submit a capability statement. Submissions must include management, technical, and cost data in sufficient detail accompanied by convincing evidence to clearly demonstrate the capability to provide the required equipment and preventive maintenance. Capability statements shall not exceed four (4) pages (8.5" x 11" format) using a font size no smaller than 10-point. All capability statements received by the due date of this notice will be considered by the Government. Requests for documentation, inquiries for additional information, or submissions consisting solely of questions will not be considered affirmative responses. A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Government. Information received will be considered exclusively for the purpose of determining whether to conduct a competitive procurement or to proceed with a sole-source purchase order.
