About this file

This document is a Brand Name Justification for the procurement of HI-Infinity cataract packs, Model AS131120-18, for the DoD Blood Program/DCSS. The justification explains that the cataract packs are required to be compatible with the Alcon Centurion Phacoemulsification machine used at the Military Treatment Facility on Guam. The procurement will be conducted using simplified acquisition procedures below the Simplified Acquisition Threshold. Market research identified two potential sources, a small business and a large business. The Brand Name Justification states this represents the best value as the prices will be determined through competitive quotations or comparison to past prices.

The related federal contract opportunity is a Solicitation for the monthly supply and delivery of the HI-Infinity cataract packs to the U.S. Naval Hospital. The contract will be firm-fixed price for a period of 12 months with a projected award date of July 17, 2024. The contractor will be responsible for all labor and transportation to supply and deliver 4 cases per month on the first working day of each month.

BRAND NAME DOCUMENTATION

Purchase Request Number 12133905

1. Requesting Department: DoD Blood Program/DCSS

2. Description of Action being approved: This is a new requirement. The resulting contract will be firm-fixed price.

3. Description of Product, Supplies or Services required to meet the Department’s needs

The items being procured are Hi-Infinity cataract packs, Model AS131120-18.

4. Identify the authority permitting other than full and open competition. (Requesting

Office completes with assistance of Contract Specialist)

This acquisition is being conducted using simplified acquisition procedures and is below the Simplified Acquisition Threshold. The basis for not providing competition to the maximum extent practicable is Federal Acquisition Regulation Subpart 13.106-1(b).

5. Justification Rationale:

The HI-Infinity cataract packs, Model AS131120-18, meet all requirements prescribed by the American Board of Ophthalmology and the Joint Commission on Allied Health

Personnel in Ophthalmology.

The Ophthalmology service at the Military Treatment Facility (MTF) provides a great service to the community by performing cataract surgeries for the servicemen and service women on Guam. To remove a cataract from the eye requires a

Phacoemulsification machine. The Phacoemulsification machine at the MTF is the Alcon

Centurion. The Alcon Centurion is designed to only fit and accept the accessories manufactured by Alcon – including the model cataract packs that make up this requirement. It is the exact same concept as smart phones. The manufacturer of the iPhone makes apps and accessories that work on and with an iPhone but not on an

Android. Purchasing other than the HI-Infinity cataract packs, Model AS131120-18, will result in non-fulfillment of the Ophthalmology mission.

6. Best Value Determination:

A contract issued under this brand name documentation represents the best value as the agreed to prices will be based upon either (1) competitive quotations or offers from authorized suppliers of the brand name product in a competitive environment, (2) a comparison of the prices received with past prices, or (3) the results of the market research. Therefore the price paid will represent the most advantageous offer and provide the greatest overall benefit/value in response to the requirement.

7. Market Research conducted

Market research, utilizing the Small Business Dynamic Search Engine, the GSA

Advantage website, and internet searches of commercial entities, revealed one small business – BHPE, LLC and one large business, Alcon Surgical - that confirmed they could meet the requirement.

8. Statement of actions, if any to remove barriers to competition in the future.

The requirement is open to any potential source that can provide the product specified.

As the technical or requirement personnel, I certify that the evidence of the supporting data that forms the basis of this justification is complete and accurate.
