The anticipated period of performance will begin around December 2026 and will not exceed five years. If an RFP is subsequently issued, it may be solicited through GSA eBuy for GSA Multiple Award Schedules or OASIS+, or synopsized on the System for Award Management (SAM) website. All costs associated with responding to this RFI are the responsibility of the interested party, and the Government will not provide reimbursement for any information or administrative costs incurred.

The Capability Statement must include administrative information (company name, point of contact, CAGE, NAICS codes, business size status, GSA SINs, and applicable contract numbers) and detailed responses addressing organizational capabilities in five key areas: comprehensive economic assessment of damages in personal injury and wrongful death cases; calculating lost future retirement benefits including Thrift Savings Plan and Social Security; valuing residual earning capacity and accounting for Veterans Affairs disability ratings; calculating offsets for government-funded VA and Department of War benefits; and preparing rebuttal reports to claimant actuaries. Respondents should also address subcontracting arrangements if applicable and provide any suggestions for improving the draft Performance Work Statement.

Defense Health Agency Actuarial Service for Military Medical Malpractice Claims

1.0 Description

THIS IS A REQUEST FOR INFORMATION (RFI) ONLY. This RFI is being issued solely for information and planning purposes. It does not constitute a Request for Proposal (RFP) or a promise to issue an RFP in the future. This request for information does not commit the Government to contract for any supply or service whatsoever. Further, the Defense Health Agency (DHA) is not at this time seeking quotes or proposals and will not accept unsolicited proposals.

Respondents are advised that the U.S. Government will not pay for any information or administrative costs incurred in response to this RFI; all costs associated with responding to this RFI will be solely at the interested party’s expense. Not responding to this RFI does not preclude participation in any future RFP, if any is issued.

If a solicitation is released, it may be solicited through the GSA eBuy for GSA Multiple Award Schedules or OASIS+ or synopsized on System for Award Management (SAM) website. It is the responsibility of the potential offerors to monitor both sites for additional information pertaining to this requirement. The results of this market research may contribute to determining the method of procurement.

2.0 Background

The DHA is seeking contract support for professional Actuarial Services in support of the Defense Health Agency (DHA) Office of the General Counsel (OGC) in accordance with the attached Performance Work Statement (PWS). Please be advised this is a draft PWS and is subject to change based on the information received from this RFI.

2.3 Period of Performance: The anticipated period of performance will begin on or around December 2026 and will not exceed 5 years.

3.0 Requested Information

The DHA is seeking the following:

3.1 Companies/Vendors who are capable of providing or have provided similar financial and program management support services with the requirements listed in section 5 of the draft PWS attached.

3.2 Performance Metrics:

3.2.1 Organizational Capabilities in actuarial report calculation for personal injury and wrongful death cases.

Describe your organization’s capability in conducting comprehensive economic assessment of economic damages in personal injury, wrongful death, or medical malpractice cases. Calculations include the anticipated military career earnings, the potential post-military civilian career earnings, and a justified estimated personal consumption deduction (for death cases). For non-death non-permanent incapacitation cases, the duration is until the claimant is medically rehabilitated and able to resume employment. Economic damages also include the loss of household services when the injured claimant can no longer perform such services.

3.2.2. Organizational Capabilities in calculating lost future retirement benefits.

Describe your organization’s capability in calculating lost future retirement benefits, including the Thrift Savings Plan, and lost future Social Security benefits.

3.2.3 Organizational Capabilities in accounting for residual earning capacity.

Describe your organization’s capability in valuing residual earning capacity in non-death cases and accounting for the disability percentage derived from the Veterans Affairs Schedule for Rating Disabilities.

3.2.4 Organizational Capabilities in calculating offsets for government-funded Veterans Affairs / Department of War benefits and medical care.

Describe your organization’s capability in accounting for disability retired pay, disability severance pay, the Survivor Benefit Plan, VA disability compensation, and TRICARE healthcare coverage.

3.2.5 Organizational Capabilities in preparing rebuttal reports to a claimant’s actuary / economist consultant report and responding to requests for clarification from government counsel.

Describe your organization’s capability in reviewing a claimant’s actuary / economist consultant report, rebutting errors, and explaining any weaknesses or skewed assumptions in the report. Describe your organization’s capability in responding to government attorney requests for clarification of your actuary / economist consultant reports.
