Justification and Approval (J&A) for Other than Full and Open Competition Federal Acquisition Regulation (FAR) Part 6

1. Identification of the Agency and Contracting Activity: Defense Health Agency Contracting Activity (DHACA), Professional Services Contracting Activity (PS-CD)

2. Nature and/or Description of Action being Approved: CHANGED- Approval is being requested to amend Justification and Approval 25-0367. This amendment is being issued as a result of negotiations causing the ceiling of the contract to increase and a delay in award. This is award will result in a sole source contract to the American College of Surgeons (ACS) for the Adult National Surgical Quality Improvement Program (NSQIP) with Quality Verification Program (QVP); Pediatric NSQIP; Metabolic and Bariatric Surgical Accreditation and Quality Improvement Program (MBSAQIP); Trauma Verification, Review, and Consultation Program (VRC); the Trauma Quality Improvement Program (TQIP) and the Commission on Cancer Programs and Accreditation. This will be a follow-on for existing services currently being performed under contract HT001120D0004. The current contract expires 24 May 2025. Due to extended negotiations and required approvals for this amendment, a gap in service is imminent.

This action was solicited and will be awarded on 29 May 2025 as a Firm Fixed Price Indefinite-delivery, Indefinite-quantity contract to ACS with a 12-month base, plus four, 12-month option periods with the option to extend up to six months.

3. Description of Supplies/Services and Estimated Value: CHANGED- This is a non-personal services contract to provide memberships, program support, accreditation (bariatrics and cancer) and verification (surgery and trauma) for designated Military Treatment Facilities (MTFs) via six ACS Quality Programs: Adult NSQIP with QVP, Pediatric NSQIP, MBSAQIP, Trauma VRC, TQIP, and the Commission on Cancer Programs and Accreditation. These quality programs are nationally and internationally recognized for their initiatives to measurably improve surgical, trauma, bariatric, and cancer quality. Membership to the preceding ACS programs provides the following key services:

1. Data analysis based on valid, risk-adjusted outcome models.

2. Reports that provide for continual viewing of aggregate data from the local level as well as from a national level of hospitals that participate in their programs (surgical, bariatric, trauma, and cancer).

3. Enhanced ability of the Department of Defense (DoD) to validate and/or improve the quality of surgical, trauma, bariatric, and cancer care provided by participating MTFs.
