Contract Clauses
52.204-7 System for Award Management. (JUL 2013)
52.212-1 Instructions to Offerors—Commercial Items. (APR 2014)
52.212-2 Evaluation—Commercial Items. (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation is the lowest priced, technically acceptable. Technical acceptability will be determined based on offerors’ accurate quotation of required products to include pricing for all option years.
All information must be submitted electronically in either Microsoft Office or Adobe format to the point of contact referenced in the synopsis/solicitation.
Pricing:
Offerors must complete the attached spread sheet and return a copy with their Proposal, in addition to any pricing information that the offeror may wish to submit (see RFP attachment 2). The Secret Service has identified brand name products as capable of fulfilling this requirement and offerors must submit Proposals for only the specified product.
Relevant Past Performance:
Offerors must provide three examples and references for relevant past performance within the last 2 years. Past performance examples should be similar in size and scope when compared to the current requirement. It is requested that the offeror provide the attached Past Performance Survey (attachment 3) to three references, who should in turn submit the surveys directly to the contract specialist via email at david.leonard@usss.dhs.gov. The government will evaluate the submitted information but also reserves the right to evaluate information found in the Past Performance Information Retrieval System (PPIRS), Federal Awardee Procurement Integrity Information System (FAPIIS), or any other means available to the government for the purposes of evaluating past performance.
Note that direct experience with contract efforts that are similar in scope should yield satisfactory ratings for this evaluation factor. If an offeror does not possess direct experience that is relevant to this RFP, then they cannot be rated favorably or unfavorably. The government will evaluate an offerors past performance based on both recentness and relevance in addition to overall performance level.
(b) Options. Options will be evaluated as noted in the provision 52.217-5, Evaluation of Options. (JULY 1990).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
