Statement of Work

Scope: US Citizenship and Immigration Services (USCIS) has a requirement to conduct naturalization ceremonies in San Francisco, CA for five-years, starting in October 2011.

Approximately 20 ceremonies are expected to be required each year with the dates to be determined in years 2-5.

The facility needs to accommodate approximately 1,300 applicants for citizenship and 1,100-1,400 guests. Ceremonies require that the applicants for citizenship seating area be separated from the guests. Approximately 40 government and contract employees participate in each ceremony requiring VIP parking for 4-6 government cars. Minimal set-up time (30 minutes) and the processing of the applicants for citizenship would begin approximately 2 hours before the formal ceremony begins. The formal ceremony is approximately 30 minutes long, followed by an additional 30 minutes to distribute certificates. The total estimated time the facility is needed is approximately 4 hours.

Ceremonies are to be held between 7:30 am – 11:30 am.

There is a need for space for the applicants to queue, as a government employee will need to speak with each applicant while checking paperwork. After initial check-in, applicants are directed to the seating area where paperwork is collected. A minimum of 6 tables with seating for 2 staff at each table to support the check-in process and a small area similar to a coat check type space is preferred to conduct a back-end review process with selected individuals as required.

The facility shall have audio-visual capability in order to show several short presentations (DVD). The projector must have sufficient lumen capacity to project a standard DVD clearly onto the screen.

Access to a separate room is preferable in order to brief speakers and other guests prior to the ceremony.

In addition to the rental of the facility itself, the rental shall include the following:

Staging cost Raised stage with podium, microphone, and 2 draped tables and chairs US and California flags Easels, stanchions, and ropes Chair set up for 2,500-3,000 attendees 6-8 tables with chairs set up in the lobby area Audio-Visual costs Clean-up Fee Fire Marshall Inspection Fee Lighting inside Storage closet to store Naturalization pamphlets (Not mandatory) Refuse disposal

Preference is for a facility located within the San Francisco city limits, but other venues no further than 8 miles by road will be considered if necessary.

The facility must be accessible by public transportation and public parking must be available in the area. Parking costs will not be provided by USCIS under this contract;

parking costs will the responsibility of the public.

Although there is some flexibility in selecting the final dates of the ceremonies, we have attached a preferred list of dates for fiscal year 2011. We prefer not to hold ceremonies on Mondays and Fridays due to staffing issues.

Dates of the Ceremonies:

October 28, 2010 November 10, 2010 November 23, 2010 December 15, 2010 January 5, 2011 January 25, 2011 February 09, 2011 February 23, 2011 March 9, 2011 March 23, 2011 April 13, 2011 April 26, 2011 May 11, 2011 June 08, 2011 June 22, 2011 July 6, 2011 July 26, 2011 August 17, 2011 September 7, 2011 September 27, 2011

Security: The facility is responsible for the safety and security needs of the ceremony, including providing safety and crowd control, prior to, during, and after the Naturalization ceremonies.

(h) Certification Regarding Responsibility Matters (Executive Order 12689). (Applies only if the contract value is expected to exceed the simplified acquisition threshold.) The offeror certifies, to the best of its knowledge and belief, that the offeror and/or any of its principals—

(1) o Are, o are not presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(2) o Have, o have not, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a Federal, state or local government contract or subcontract; violation of Federal or state antitrust statutes relating to the submission of offers; or https://www.acquisition.gov/far/current/html/52_223_226.html#wp1169038 https://www.acquisition.gov/far/current/html/52_223_226.html#wp1169151 commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property;

(3) o Are, o are not presently indicted for, or otherwise criminally or civilly charged by a Government entity with, commission of any of these offenses enumerated in paragraph (h)(2) of this clause; and

(4) o Have, o have not, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,000 for which the liability remains unsatisfied.

(i) Taxes are considered delinquent if both of the following criteria apply:

(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).

(i) Certification Regarding Knowledge of Child Labor for Listed End Products (Executive Order 13126).

[The Contracting Officer must list in paragraph (i)(1) any end products being acquired under this solicitation that are included in the List of Products Requiring Contractor Certification as to Forced or Indentured Child Labor, unless excluded at 22.1503(b).]

(1) Listed end products.

Listed End Product Listed Countries of Origin

(2) Certification. [If the Contracting Officer has identified end products and countries of origin in paragraph (i)(1) of this provision, then the offeror must certify to either (i)(2)(i) or (i)(2)(ii) by checking the appropriate block.]

[ ] (i) The offeror will not supply any end product listed in paragraph (i)(1) of this provision that was mined, produced, or manufactured in the corresponding country as listed for that product.

[ ] (ii) The offeror may supply an end product listed in paragraph (i)(1) of this provision that was mined, produced, or manufactured in the corresponding country as listed for that product. The offeror certifies that it has made a good faith effort to determine whether forced or indentured child labor was used to mine, produce, or manufacture any such end product furnished under this contract. On the basis of those efforts, the offeror certifies that it is not aware of any such use of child labor.

(2) o Outside the United States.

(Certification by the offeror as to its compliance with respect to the contract also constitutes its certification as to compliance by its subcontractor if it subcontracts out the exempt services.) [The contracting officer is to check a box to indicate if paragraph (k)(1) or (k)(2) applies.]

[ ] (1) Maintenance, calibration, or repair of certain equipment as described in FAR 22.1003-4(c)(1).

The offeror o does o does not certify that—

(iv) The compensation (wage and fringe benefits) plan for all service employees performing work under the contract is the same as that used for these employees and equivalent employees servicing commercial customers.

(3) If paragraph (k)(1) or (k)(2) of this clause applies—

(i) If the offeror does not certify to the conditions in paragraph (k)(1) or (k)(2) and the Contracting

Officer did not attach a Service Contract Act wage determination to the solicitation, the offeror shall notify the Contracting Officer as soon as possible; and

(ii) The Contracting Officer may not make an award to the offeror if the offeror fails to execute the certification in paragraph (k)(1) or (k)(2) of this clause or to contact the Contracting Officer as required in paragraph (k)(3)(i) of this clause.

(l) Taxpayer Identification Number (TIN) (26 U.S.C. 6109, 31 U.S.C. 7701). (Not applicable if the offeror is required to provide this information to a central contractor registration database to be eligible for award.)
