Limited Sources Justification
I. Identification of the Agency and Contracting Activity.
a. Federal Agency and Contracting Activity: General Services Administration, Federal Acquisition Service, Integrated Technology Services, Office of Acquisition Operations, Strategic Solutions Division
b. Project Officer Information Project Officer Name - Stephen Sill Mailing Address – 1800 F Street NW, Washington, DC 20405 E-mail Address - stephen.sill@gsa.gov Telephone Number - 703-306-6438
II. Nature and/or Description of the Action Being Approved:
Extension of Task Order to Grant Thornton per FAR 8.405-6(a)(1)(i)(C)
a. Program and Acquisition Background:
Homeland Security Presidential Directive 12 (HSPD-12), issued by President George W.
Bush on Aug 27, 2004, provided for a new standardized federal identity credential that would enhance security, reduce identity fraud, and protect the personal privacy of those issued government identification.
GSA, through its GSA HSPD-12 Managed Support Office (MSO), provides a complete end-to-end service to issue fully compliant identity credentials for Government employees and contractors. The program, titled USAccess, allows agencies to benefit from a robust operational infrastructure, centralized program and billing management, technical expertise, and economies of scale for credential management. Furthermore, USAccess provides a key foundational component to help agencies unite their logical and physical access control system implementation strategies.
A task order was awarded to Grant Thornton (GT) in June 2013 to provide Integration, Operation and Administrative Support Services to the MSO. The period of performance on this task order ends on June 25, 2016.
Grant Thornton has been instrumental in the requirements development and acquisition planning for the major operation acquisition that supports USAccess. The initial acquisition for the USAccess core services contract, HSPD-12 Shared Services Provider IV (HSPD-12 SSP IV), was awarded in October 2014. However, the award was protested twice and subsequently cancelled. The cancellation was also protested. A new solicitation was issued, HSPD-12 Core Services Acquisition (CSA), and is currently awaiting proposals. The solicitation is scheduled to close in June 22, 2016.
The delays associated with the protests of the core services contract necessitate continued performance by Grant Thornton, as it is the vendor with the knowledge and experience most germane to the requirements currently being solicited.
b. Acquisition Purpose and Objectives
GSA’s extension of GT’s task order allows for the seamless continuation of acquisition activities relative to the HSPD-12 CSA. Delays in the acquisition and award of the core services contract supporting USAccess have necessitated GT’s continued performance as GT was instrumental in the drafting of the current Performance Work Statement and overall integration of the HSPD-12 MSO Program.
III. Description of the Supplies or Services Required to Meet the Agency’s Needs
a. Project Title. HSPD-12 MSO Integration and Administrative Support
b. Total Estimated Dollar Value and Performance/Delivery Period
June 26, 2016-December 25, 2016 - $540,094
IV. Authority and Supporting Rationale
a. Authority
This procurement action is conducted under the authority of the Multiple Award Schedule Program. Consideration of schedule contractors will be restricted to GT as provided in FAR 8.405-6(a)(1)(i)(C). In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not issued under sole-source or limited-sources procedures.
b. Demonstration of the Proposed Contractor’s Unique Qualifications to Provide the Required Supply or Service
1. Name and Address of the Proposed Contractor:
Grant Thornton, Inc.
2. Nature of the Acquisition and Proposed Contractor’s Unique Qualifications
Grant Thornton has extensive knowledge of the current operations contract and the ongoing Core Services Acquisition. GT was materially involved in the development of the Performance Work Statement currently being competed and is knowledgeable concerning the technical requirements. GT’s staff has not only signed Non-Disclosure Agreements concerning the CSA, but GT has also agreed to restrictions on competitive activities for a period of one year after this task order expires for any acquisitions for which they supplied requirements support.
Award to another interim source would result in disruption to the support of the acquisition of the CSA while a new support contractor is onboarded. Substantial duplication of costs to the Government not expected to be recovered through competition, and would result in additional delays in the transition of this service. Any new solution would require a similar process of development and deployment that would unavoidably increase cost. As GSA is currently in the midst of competitive activities that would eliminate the need for continued sole source support, any effort to provide interim competition would be wasteful, redundant, and counter-productive to an organized award and possible transition.
GSA intends to exercise the six month option in the task order per Clause 52.217-8, Option to Extend Services. Although continued performance is within the limits and at the rates specified in the contract, and can only be adjusted as a result of revisions to prevailing labor rates provided by the Secretary of Labor, competition is limited because prices were not evaluated during the initial competition.
V. Determination by the Ordering Activity Contracting Officer That the Order Represents the Best Value Consistent with FAR 8.404(d)
GSA is seeking continued performance under the current order with pricing that has already been determined to be fair and reasonable. GT’s pricing for the next year is the same as accepted during the previous year. GT’s pricing is at or below its GSA MOBIS Schedule rates, and it has been determined that the level of effort and labor mix is appropriate for the requirement. The order has been determined to represent the best value to provide the required supplies and services while the competitive process for the CSA runs its total course.
VI. Description of the Market Research Conducted
Market research indicates a change in the vehicles available for competition. GSA has initiated the Professional Services Schedule, and many of the MOBIS contractors now have awards on that Schedule. Given GT’s unique qualifications as they relate to the ongoing HSPD-12 CSA, and the fact that this extension is based on GT’s current Schedule rates, the additional market research does not change the need for continued performance by this vendor.
VII. Any Other Facts Supporting the Justification
Even though GSA began the process of competitively awarding a new task order for the core services in 2013, and attempted to make award twice, first in 2014 and again in 2015. GT’s support services were intended, among other things, to support the core services acquisition process. The process, delayed by protest litigation and changed requirements, has taken much longer than anticipated. In order to complete the acquisition process, GSA requires continued performance from specifically GT to economically and efficiently maintain these critical services in the interim. Until the core services acquisition is completed, only GT has the knowledge needed to continue providing integration services without significant additional costs.
VIII. Statement of Actions the Agency May Take to Remove or Overcome Any Barriers That Led to the Restricted Consideration Before Any Subsequent Acquisition for the Supplies or Services is Made
a. Removal of Barriers to Competition
GSA is currently awaiting proposals under the HSPD-12 CSA. The specialized experience GT has is needed through the award of this contract.
GSA is preparing to compete the task order currently being performed by Grant Thornton and anticipates a competitive award by January 2017.
