Questions and Answers
Post Exhibit Questions
Question: RFP: Exhibit 1, Relief Requirements and RFP Section 12.1.2
Question: Section 12.1.2 states that Exhibit 1 specifies which posts require PSO relief, however, Exhibit 1 does not appear to specify this requirement; will the Government please indicate on Exhibit 1, which posts require relief and which posts are self-relieving?
Answer: See Amendment 000003 for updated post exhibit.
Question: The Post Exhibit does not indicate which posts are going to require relief. Is relief required for this contract? If yes, please provide an updated Post Exhibit indicating which posts require relief.
Answer: See Amendment 000003 for updated post exhibit.
Question: Exhibit 1 provides a column that allows for each line item post to be identified as a screening post if the post is responsible for operating an X-ray or performing other screening duties. In some instances, the post exhibit reflects “no” in the screening post column, however in the X-ray/Non X-ray column the post is identified as a “Non X-ray” post. Since Non X-ray posts are still considered screening posts, these references appear to be in conflict. Please confirm that all posts that are marked as “no” in the screening column should be considered as non-screening posts.
Answer: If the column identified as “Screening Station” is marked “no,” it is a non-screening station. If the column identified as “Screening Station” is marked “yes,” it is a screening station and may either be a x-ray screening station or a non-x-ray screening station as identified by the column labeled “X-ray post/non x-ray post.”

Seniority Lists and CBA Questions
Question: There is some confusion in the areas the CBAs cover. Even though one states Statewide and the other states FBI only, both in the Appendix A imply they have the same statewide coverage in the geographic coverage listing. As wages and other benefits are different between the CBAs this clarification is needed to price correctly. Reflect which CBA the listed PSO is associated with?
Answer: CBA local 744 applies to only the FBI locations NY7093ZZ and NY7136ZZ. All other locations are covered by CBA local 618.
Question: The seniority list associates PSOs with TWC Offices (?). Can the Seniority List be revised to reflect the city the PSO is assigned to as this information is needed to assist in determining the geographic distribution of the workforce?
Answer: All information that is known to the Government has been provided on the existing seniority list.
Question: Collective Bargaining Agreements (CBAs) wage and health & welfare (H&W) rates - Each CBA provides wage and H&W rates effective either 12/1/2014 and 12/1/2015 (Local 618) or 2/1/2014 and 2/1/2015 (Local 744). Will the Government please advise bidders whether their prices should reflect the earlier, 2014 effective rates and then ‘flat-line’ the 2014 for the Option Years, or should bidders incorporate the 2015 effective wage & H&W rates to create composite rates, and then ‘flat-line’ the 2015 rates for the Option Years?
Answer: Unless it is the contractor’s intention to pay PSOs greater than the minimum wages and benefits of the successor CBAs, they should not escalate the Option periods to reflect the 2015 CBA wage and benefit rates, rather they should use (1) for Local 618 the 2014 CBA wage and benefit rates and (2) for Local 744 the effective/weighted priced wage rate, which would consider the prospective wage increase that takes place within the base period on 2/1/2015. Use the 2014/2015 composite rate and flat line it across the option years.
Question: Collective Bargaining Agreements (CBAs) – Local 744 – page 289 of 346 ARTICLE 14 – WAGES states the following:
In addition to the wages set forth in this paragraph those Employees required to hold a Top Secret clearance and is granted this clearance shall upon being granted the clearance be awarded an additional sixty ($.60) cents per hour for all hours worked above his/her base rate of pay as set forth above.
Question (a): Is the additional sixty ($.60) cents per hour for all hours worked above his/her base rate of pay as set forth above considered a bona fide fringe benefit?
Question (b): If this is a bona fide fringe benefit, are Offerors required to price this amount for all contract years similar to the way they would price the requirements for salaries?
Answer: The $ .60 an hour for Top Secret Clearance employees is considered a wage, since it is conditional increased pay based on the employee’s status as cleared. Bona fide fringes are defined under 29 CFR 4.171. Section 4.162(a) as referenced under 4.171 provides a listing of bona fide fringe benefits to include medical or hospital care, unemployment benefits, life insurance, disability and sickness insurance, accident insurance etc…
Question: Page 289 of 346, CBA-Local 744 Section 14.1 – CBA list hourly base rate for 2/1/2014 to be $20.02 and for 2/1/2015 to be $20.42. Please confirm that the contractor should do a weighted average hourly base rate for the base year (2/1/14 to 2/1/15).
Answer: As reflected on the SF 1449 in the RFP, the base year period of performance for the anticipated contract is 12/1/14-11/31/15. It is the contractor’s responsibility to determine how they choose to price hourly wage rates for PSOs. For the CBA covering the FBI locations with
CBA rates 2/1/14-1/31/15 and 2/1/15-1/31/15; it would be acceptable to use a weighted average hourly rate to cover the period 12/1/14-11/31/15.
Proposal Submission Requirements Questions
Question: Reference Solicitation Provisions - Proposal Submission Requirements – 4. Page Limitation. Is the Table of Contents included in the 20-page Technical Proposal page limitation?
Answer: A table of contents is excluded from the technical proposal page limitation.
Question: Reference; Solicitation Provisions - Proposal Submission Requirements – 4. Page Limitation -- Is the 11 point font size a requirement for tables, charts, and graphics or can a smaller font size be used for tables, charts, and graphics?
Answer: The 11 point font size is required for any text in your Management Approach proposal including tables, charts, and graphics.
Question: Reference; Attachment 8, Field Level Supervision Exhibit -- The Field Level Supervision Exhibit identifies two (2) supervisory classifications, Site Supervisors and Roving Supervisors. Please confirm that Area Supervisors are not included as part of this contract and any supervisors used on this contract should be classified as being either a Site Supervisor or a Roving Supervisor.
Answer: For purposes of submitting the field level supervision exhibit, there is not a classification of an area supervisor. An “area” supervisor would be considered a roving supervisor for purposes of filling out and submitting the Field Level Supervision Exhibit.
Question: RFP Reference: Solicitation Provisions, page 322 of 346 - In reviewing the RFP, we noticed that in the technical proposal requirements, the section typically labeled C. Staffing, through the Relief Plan, were not present in this RFP. The omitted section is highlighted in BLUE below to illustrate
2. Minimum Submission Requirements Transition: Offerors shall submit as a minimum the following to demonstrate the above:
Offerors shall outline significant transition steps and the associated timeframes for completing these steps to assure timely contract start-up and performance. Note: In no event shall any proposed transition timeline include assumptions that the government will waive or defer any contract requirements. Additionally, in no event shall any proposed plan for transition training be dependent upon availability of Government personnel after normal business hours (e.g.
overseeing training during evenings and weekends).
C. Staffing:
1. Staffing Plan.
a. The solicitation includes estimated Basic PSO Service hours that may be ordered by the Government, which exceed the initial known basic PSO Service hours reflected in the post exhibits. Similarly the solicitation includes estimated hours that the Government may order for TAS and ESS. The Government may order these additional hours at anytime during the performance period of this contract and may do so without providing for a “phase-in” period.
The offeror shall describe their staffing plan. Offerors, at their discretion, may include information to enhance the Government’s understanding of the proposal, such as the number of PSO full time equivalents (FTEs) to be assigned to this contract, staffing of TAS and ESS requirements, and the contractor’s ability to permanently staff additional posts with licensed/trained/certified and suitably cleared PSOs with little advance notice.
b. Minimum Submission Requirements Staffing Plan: Offerors shall submit as a minimum the following to demonstrate the above:
Offeror shall describe their staffing plan.
2. Relief Plan.
a. Offerors shall provide a detailed plan indicating their approach to providing relief.
Descriptions of relief plans that do nothing more than restate the SOW requirements or assert the intent to comply with applicable laws and regulations such as “relief shall be provided in accordance with the applicable Collective Bargaining Agreement or applicable Department of Labor regulations” may adversely impact your evaluation under this technical factor. Aspects of the relief plan that Offerors may address at their discretion to enhance the Government’s understanding of the proposal, include their policy for providing meal and break periods and whether these periods are paid or unpaid, the number of annual relief hours that will be required to fill all posts requiring continuous coverage during meal/break periods, the number of personnel that they will provide to perform annual relief hours, and whether the personnel are dedicated full time equivalents for provision of relief or if they will perform under the contract in other capacities in addition to relief. Offerors are reminded that patrol (rover) and supervisory PSOs shall not be used to provide breaks/relief while simultaneously performing the rover or the supervisory function. If using supervisory personnel to provide relief, a plan should be in-place to ensure that this does not impact your proposed level of supervision.
b. Minimum Submission Requirements Relief Plan: Offerors shall submit as a minimum the following to demonstrate the above:
Offerors shall provide a detailed plan indicating their approach to providing relief.
Notice to Offerors: Submission of information under the “Management Approach” factor in response to the solicitation does not take the place of or otherwise diminish the successful contractor’s requirement to submit detailed related contract deliverables (e.g., Transition Plan, Quality Control Plan, etc.) after contract award. Rather, the information provided in response to this factor should be detailed enough (without exceeding prescribed page limitations) to present the offeror’s strategy and/or innovative solutions to delivering the highest quality security services in full compliance with all contract requirements. After award of the contract, the successful contractor's Management Approach will be incorporated into the contract.
Notwithstanding this incorporation, the successful awardee will be required to submit detailed contract deliverables which not only provide greater detail than what is provided with the quote or proposal, but also fully delineates the planned implementation of the promised approach(s) and plans for communicating results to the COR throughout contract performance.
Was this section inadvertently omitted from the RFP template or is it not required for this submission?
Answer: All evaluation criteria are included in the RFP. The above evaluation criteria, requiring a staffing plan is not part of the evaluation criteria for this RFP.
Question: RFP Reference: Solicitation Provisions, page 322 of 346 - In reviewing the RFP, we noticed that in the technical proposal requirements, the section typically labeled C. Staffing, through the Relief Plan, were not present in this RFP. The omi...
