4. Authority and supporting rationale.
This acquisition is being conducted under the authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 U.S.C. 251, et seq.) and Title 40 U.S.C. 501 in accordance with FAR 8.405-6, “Limited- Sources Justification.” This procurement is being conducted in the interest of economy and efficiency, as a logical follow-on to original Federal Supply Schedule order number HSHQDC-11-F-00043. The original award was competitively solicited and awarded using the ordering procedures at FAR 8.405. New Editions Consulting provided support developing the Trusted Tester training program for OAST. The knowledge and experience that New Editions Consulting has with this program will provide DHS cost savings and efficiency. Failure to execute the logical follow on would result in extensive time to re-train an alternate provider, get them certified to teach the training course, and to adequately familiarize them with the OAST program; this would increase the risk to the government both in cost and schedule. New Editions Consulting is currently the only vendor who possesses the certifications to teach this newly developed DHS Section 508 Trusted Tester Certification Training.
5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).
The contracting officer has determined that issuing the proposed Task Order to New Editions Consulting for the Trusted Tester Certification training represents the best value and will result in the lowest overall cost, considering price and administrative costs, to meet the Government’s needs. This order will be placed in accordance with FAR 8.404, “Use of Federal Supply Schedules.” The General Services Administration (GSA) has already negotiated fair and reasonable pricing rates. Discounts to these GSA schedule rates will be requested. Additionally, prior to issuance of the task order, the ordering activity will consider the level of effort and the mix of labor proposed to perform the specific task being ordered in order to determine that the total price is reasonable. The contractor’s labor mix and level of effort will also be compared to the Independent Government Cost Estimate
(IGCE).
6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.
The DHS Section 508 Trusted Tester Certification Training was established by the Office of DHS Accessible Systems & Technology (OAST). To date, OAST issues all certifications and develops and maintains all records related to this training program. At present, New Editions Consulting personnel have participated in developing the Trusted Tester Best Practices; used the Best Practices to develop this training, and delivered the pilot training classes. As a result of the newness of the certification process, this skill set is limited to only one vendor, the vendor who has helped to create this certification training, New Editions Consulting. Market research was not conducted; New Editions Consulting is the only vendor that is knowledgeable, experienced, and possesses the certification for this newly developed DHS Section 508 training. In the interest of economy and efficiency, a logical
