LIMITED -SOURCES JUSTIFICATION (LSJ)

JEFO No.: FY14-0370

Date: A u gus t 1, 201 4 PR Number: RNCC-14-50090

This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.

1. AGENCY AND CONTRACTING A C T IVITY.

The Department of Homeland Security (DHS), Office of Procurement Operations

(OPO) proposes to award a modification to task order GS-23F-0134N/HSHQDC-11-

J-00303 using limited competition procedures pursuant to FAR 8.405-6(a), Limiting

Sources . This action is on behalf of the National Protection and Programs

Directorate (NPPD), Office of Cybersecurity & Communications (CS&C) and

Office of Emergency Communications (OEC).

2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED.

DHS/OPO intends to limit the number of sources solicited pursuant to FAR Part 8.405-

6(a) as alluded to earlier herein for the procurement of outreach services to develop and implement outreach materials such as newsletters and factsheets, development of speeches, talking points and presentations, along with booth deployments and other coordination opportunities. The task order will be extended for a base period of one (1) month with an option period of one (1) month. The period of performance (POP) will be extended from September 1, 2014 through October 31, 2014. The proposed Contractor is

Lafayette Group, Inc., 1919 Gallows Road, Suite 630, Vienna, VA 22182-7749.

3. DESCRIPTION OF THE SUPPLIES/ SERVICES.

A number of organizational entities within CS&C share program responsibilities for supporting the OEC, Outreach Affairs mission. The OEC Director is responsible for the planning for and provisioning of Outreach Affairs for the Federal Government. This office supports the OEC Director to develop and implement outreach materials such as newsletters and factsheets, development of speeches, talking points and presentations, along with booth deployments and other coordination opportunities as alluded to earlier herein.

The Outreach Affairs contract provides services to 1) improve Outreach to OEC audiences, including emergency responders, government officials, public safety and intergovernmental associations and: 2) Develop relationships with members of the media, association staff and stakeholders, especially in State, Local and Tribal government communities.

The total estimated value of this extension is $151,889.10 ( $75,889.05 for the base period and

$75,889.05 for the option period). Having the contractor continue to support OEC Outreach

Affairs to avoid interruption of services by extending the period of performance from

September 1, 2014 through October 31, 2014, will be in the best interest of the Government.

4. AUTHORITY AND SUPPORTING RATIONALE.

This acquisition is being conducted under the authority of the Multiple-Award Schedule

Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for

Executive Agencies, in accordance with FAR 8.405-6(a), Limiting Sources. An award will be made in the interest of economy and efficiency as a logical follow-on to an original Federal

Supply Schedule order, GS-23F-0134N/HSHQDC-11-J-00303, pursuant to FAR 8.405-

6(a)(1)(i)(C). The original award was competitively solicited and awarded using the ordering procedures at FAR 8.405. It is necessary to limit competition for new work described herein as a logical follow-on because the aforementioned extension will allow the current contractor to continue to provide the same key support functions to the CS&C/OEC Outreach Affairs in its mission. The OEC Outreach Affairs supports and promotes the ability of emergency responders and government officials to continue to communicate in the event of natural disasters, acts of terrorism, or other man- made disasters, and works to ensure, accelerate and attain interoperable and operable emergency communications nationwide. In order to meet the mission of OEC, and in turn, to meet the mission of DHS, OEC requires professional support services in the Office of the Director. A disruption of the NPPD/CS&C/OEC

Outreach Affairs services would be detrimental and cost prohibitive as described below:

Transition to new contractors for such a short duration (September 1, 2014 through October

31, 2014) would involve disruptive transition efforts, lengthy personnel security clearance processing, and a need to brief and indoctrinate new contractor personnel. The follow-on is a consolidation of one of the existing Task Orders and the award is anticipated in

September 2014. The time and expense associated with moving forward to solicit and award a new contract prior to the award of the planned follow-on support for such a short duration would be cost prohibitive to the organization. Additionally, failure of the

NPPD/CS&C/OEC Outreach Affairs to perform the above mentioned duties will preclude the ability to coordinate ongoing initiatives.

5. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE.

The contracting officer has determined that extending the POP of the aforementioned task order represents the best value and will result in the lowest overall cost, considering price and administrative costs, to meet the Government’s needs. This order will be placed in accordance with FAR 8.404, “Use of Federal Supply Schedules.” The General Services Administration

(GSA) has already negotiated fair and reasonable pricing rates. Additionally, prior to issuance of the task order modification, the ordering activity will consider the level of effort and the mix of labor proposed to perform the specific task being ordered in order to determine that the total price is reasonable. The contractor’s labor mix and level of effort will also be compared to the

Independent Government Cost Estimate (IGCE).

6. ADESCRIPTION OF THE MARKET RESEARCH CONDUCTED AMONG

SCHEDULE HOLDERS AND THE RESULTS, OR A STATEMENT OF

THE REASON MARKET RESEARCH WAS NOT CONDUCTED.

A market research was not conducted due to the short duration of the proposed extension and due to the fact that the extension is a logical follow-on.

7. ANY OTHER FACTS SUPPORTING THE LIMITED-SOURCES JUSTIFICATION.

There are no additional facts to support the LSJ.

8. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS THAT LED TO THE LIMITED-

SOURCES BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR

SERVICES IS MADE.

The proposed extension will allow OPO to finalize the competitive procurement for the follow-on requirement. It is anticipated the new task order will be awarded in September 2014 as stated earlier herein.

9. DHS intends to post this requirement on FedBizOpps pursuant to FAR 8.405-6(a)(2)(i).

10. TECHNICAL OR REQUIREMENTS PERSONNEL CONCURRENCE.

Pursuant to FAR 8.405-6(c)(2)(x), I certify that this requirement meets the Government’s minimum need and that the supporting data, which form a basis for the Limited-Sources

Justification, are accurate and complete.
