Questions and Government Response

Question
Type
Response
MUST bid on all 9 respirator types? Possible to bid on one N99 model?
Contractual
Offeror’s must bid on all respirator types. Please note that the solicitation has been amended to include seven (7) rather than nine (9) respirator types (reference revised tables A and B).
Third Party Evaluation (D&B)/Past Performance Evaluation acceptable in place of one attached to RFP?
Contractual
Third Party Evaluations are acceptable if no other past performance exists for the company.
Please clarify ‘total small business’ set aside versus ‘emerging small business’.
Contractual
Small Business Set Aside is no longer applicable to this solicitation.
Has a RFP for DO 00001 been established so we may better understand the quantity required for this delivery.
Contractual
See table A, Column C, under Delivery Order 00001.
We are not aware of any products available (from a qualified Country) as requested in section III page 5, number 3 C: “N99 flat fold without exhalation valve”; will a consideration be made for vendors submitting without this product?
Technical
The solicitation has been amended to remove reference to an N99 Flat fold. Offerors may not offer N99 which does not have NIOSH certification.
There is NO Table "B" attached.
General
Table B is included within the spreadsheet entitled “HSHQDC-10-R-00003_Tables A and B.” Reference the tabs for Table B at the bottom of the workbook.
Is it permissable to only quote on the one Type "N99 Flat fold?"
Contractual
All products referenced in the RFP must be priced for the proposal to be considered. Solicitation has been amended to include seven (7) rather than nine (9) respirator types (reference revised tables A and B).
Is it mandatory to answer ALL 9 -- for all three of the referenced respirators: N95, N99, N100? (Page 27)
Contractual
All products referenced in the RFP must be priced for the proposal to be considered. Solicitation has been amended to include seven (7) rather than nine (9) respirator types (reference revised tables A and B).
Will the full contract be delivered to the one address only at HHS Supply Service Center (PSC/SAS/DSM) Perry Point, Maryland 21902?
Contractual
No. Deliveries will be all around the United States and in US territories.
Can we propose a mask which does not meet the technical requirements or lacks other classifications?
Contractual
No. All products proposed must meet the solicitation requirements and have NIOSH and/or FDA approvals as required.

Neither checkbox in FAR 52.212-3(k) are checked. Does this mean this paragraph does not apply? If so, how should I respond? If not, we need to know which checkbox should be checked.

The following statement in that paragraph says that if the offeror has NOT completed the annual representations and certifications on the website, then paragraphs (b) through (j) need to be submitted. This leaves out paragraph (k). Is in your intention that those offerors who DID complete the info on the ORCA website need to complete paragraph (k), but those offerors who did NOT complete the info on the ORCA website don’t need to complete paragraph (k)?

Contractual
FAR 52.212-3(k) does not apply.

FAR 52.212-3(k) is not applicable. Section V.B.1.c of the solicitation has been amended to reconcile with the requirements of FAR 52.212-3. Offerors shall ensure that their certifications are current and applicable to the requirements of this solicitation, including 52.212-3(g)(4), Trade Agreements Certificate.

Section IV, paragraph E.1 states that if an offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically at http://orca.bpn.gov., however Section V, paragraph B.1.c states that if the offeror has already completed the annual representations and certifications electronically at http://orca.bpn.gov, that only paragraph (k) from FAR 52.212-3 need be completed. These instructions are in conflict.
Contractual
Section V.B.1.c of the solicitation has been amended to reconcile with the requirements of FAR 52.212-3.
How does DHS allow for the contractor to protect themselves from market fluctuations in pricing on the option years.
General
DHS is requesting pricing for the duration of the IDIQ. Prices offerors propose are a business decision for each company. Offerors are advised that if awarded an IDIQ contract they may propose unit pricing less than the unit pricing incorporated into their IDIQ during delivery order competitions.
I am also being told some of your items are non- existing.
Technical
Unfortunately this statement (not a question) did not provide sufficient detail to allow the Government to provide a response. Please reference section III.D and the revised pricing tables as included in the amended solicitation for a revised description of the respirator technical requirements.
Are quantities listed as each or per box.
Technical
Quantities listed in the RFP are each. I.e. “1,000,000” is 1,000,000 respirators.
