OPOAM 3016.505-90(a)(2)(ii) Justification for Exception to Fair Opportunity
Exceeding the SAT pursuant to FAR 16.505(b)(2)(ii)(B)
JEFO No.: FY18-0141 - 1 -
JEFO No.: FY18-0141
Date: 03/14/2018 PR Number: RSRP-18-00005
1. Agency and Contracting Activity. Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for an Exception to Fair Opportunity.”
The Department of Homeland Security, Office of Procurement Operations, STAD, prepared this justification for an exception to fair opportunity.
2. Nature and/or description of the action being approved.
DHS/OPO intends to extend the period of performance of task order HSHQDC-16-J- 00450 an additional three months without considering other awardees under the Systems Engineering and Technical Assistance (SETA) II IDIQ pursuant to FAR 16.505 (b)(2)(ii)(C).
3. A description of the supplies or services required to meet the agency’s need (including the estimated value).
This JEFO is for the three month extension of HSHQDC-16-J-00450 is for SETA support services for the Reseach and Development Partnerships (RDP) office. This effort is expected to add $699,656 additional funding to the task order.
4. Identify the exception to fair opportunity and supporting rationale, including a demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the exception cited.
___X______FAR 16.505(b)(2)(i)(C). The order must be issue on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.
RDP needs to continue the work that Booz Allen Hamilton is currently doing to ensure there are no impacts on programmatic goals. The incumbent brings to bear a highly integrated group of subject matter experts and technical support who have built deep understanding of the environments, technology and requirements of RDP. Additionally, the competition for the replacement SETA II task order is currently on hold until the structure of RDP is further clarified in the coming month and RDP needs to ensure it has continued support from Booz Allen Hamilton while the SETA II task order is re-competed.
JEFO No.: FY18-0141 - 2 -
S&T RDP has a requirement for an additional three months of services under the existing task order to continue the level of quality of mission critical business and technical management support currently provided by Booz Allen Hamilton. This effort is being extended rather than re-competed at this moment for two main reasons:
1) There are organizational changes occurring in RDP that have led to multiple changes in the requirements since the PR was established leading to a delay in solicitation creation. The amount of support that specific offices within RDP need is gradually changing and some office will soon no longer require SETA support and others offices will soon require more or different types of support. This 3 month extension will allow for these institutional changes to occur without any loss of SETA support and allow for the award of a task order that will not require large amount of modifications to reflect all the organizational changes that are occuring.
2) The office of P3 under the RDP task order has decided to transition their contractor support off of SETA II entirely and procure support via the OASIS IDIQ because the support they will soon need is less SETA in nature. The support P3 needs is technical expertise, logistics, administrative and communications expertise, including marketing and adverstisement. P3 currently receives logistics and administrative support from two separate task orders, this task order HSHQDC-16-J-00450 with Booz Allen with a period of performance end of 03/22/2017 and HSHQDC-16-J-00238 with Noblis that ends 07/28/2018. This extension will allow both task orders to end at closer time and allow the work to transition over to a new OASIS task order that is currently in the RFI process, without having any gaps in service for logistics and administrative support.
Additionally, Market Research showed that Noblis and ManTech do have similar capabilities, but this effort is being procured as a sole source because the other vendors would not be able to provide adequate personnel in as quick a time. Booz Allen is the only vendor able to ensure there is no break in service since Booz Allen currently has all personnel in place. Additionally, these services are needed in a faster time period than a competition would allow and DHS does not need them for a long enough time to make transition to a different contractor worth the transition costs, including programmatic delays.
5. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer anticipates that all costs will be able to be determined fair and reasonable because the Contracting Officer will request that the contractor keep the labors consistent with the current active period of performance. These labor prices were determined fair and reasonable during the award of the task order due to competition at both the IDIQ level and task order level. If the contractor chooses to propose different prices, certified cost and pricing data will be required and cost analysis will be completed.
6. Any other facts supporting the justification.
JEFO No.: FY18-0141 - 3 -
7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made.
A new procurement for these services is either currently in the RFP development stage or the RFI stage. DHS OPO intends to compete the services very shortly and does not anticpate any additional extensions.
8. DHS intends to post this requirement on FedBizOpps pursuant to FAR 16.505(b)(2)(ii)(D).
9. Technical/Requirements Personnel Certification.
Pursuant to FAR 16.505(b)(2)(ii)(B)(9), I certify that this requirement meets the Government’s minimum need and that the supporting data, which form a basis for the justification, are accurate and complete.
Technical Representative/COR Date
10. Contracting Officer Certification and Approval
Pursuant to FAR 16.505(b)(2)(ii)(B)(8), I certify that this justification is accurate and complete to the best of my knowledge and belief and hereby determine that the circumstances for an exception to fair opportunity exist:
