Limited-Sources Justification (LSJ)
For Protective Security Officer Services for Oklahoma Statewide
LSJ No.: FY15-0342
This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C.
152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.
1. Agency and Contracting Activity:
The Department of Homeland Security (DHS), Office of Procurement Operations (OPO), Federal Protective Service (FPS), West Consolidated Contracting Group (WCCG) intends to issue a task order under a General Service Administration (GSA)/Federal Supply Schedule (FSS) contract pursuant to FAR 8.405-6(a), Limiting Sources.
2. Nature and/or description of the action being approved:
FPS WCCG intends to limit the number of sources solicited pursuant to FAR 8.405-6(a)(1)(i)(B) for the procurement of continued armed Protective Security Officer (PSO) throughout the state of Oklahoma to DECO, Inc., 11140 Zealand Ave., N., Champlin, MN, 55316-3594.
3. Description of Supplies/Services:
The requirement is to provide armed PSO services throughout the state of Oklahoma for three months. Presently FPS is obtaining the aforementioned services from Deco, Inc. via orders under Federal Supply Schedule contract GS-07F-0103M / BPA HSCEC7-10-A-00002. This BPA was extended for six months in accordance with FAR 8.405-6(a)(1)(i)(B), "Limited Sources” and FAR Clause 52.217-8. Limited Source Justification FY15-044 was approved by the Competition Advocate on January 26, 2015. The extension was necessary in order to adequately document the source selection decision, perform further business analysis, and allow for a 120 day transition period under the resulting award.
Although an award decision has been reached and award was made on June 15, 2015, there continues to be a need to ensure uninterrupted security service coverage during the 120 day transition. The 120 day transition is necessary for the awardee to perform the extensive screening, fitness testing and training and to acquire necessary licenses and permits required for performance. As such, a task order will be executed for three months under the incumbent contractor’s General Service Administration (GSA) Federal Supply Schedule (FSS) contract.
This proposed action is to acquire continued PSO services from DECO, Inc. for the 120 day transition period. This will ensure uninterrupted security throughout the state of Oklahoma until there is full performance of services under the follow-on contract. The performance period for the three month task order is from August 1, 2015, through October 31, 2015, with an approximate value of $2,617,538.74.
Summary of Estimated Hours
08/01/2015 – 10/31/2015 Quantity (hrs) Unit Price Total Recurring (Basic) PSO Services 47,570.43 $46.70 2,221,539.08 Temporary Additional Services (TAS) 8,479.65 $46.70 $395,999.66 Total Value for Three Months 56,050.08 $2,617,538.74
4. Authority and supporting rationale:
This acquisition is being conducted under the authority of the Multiple Award Schedule Program 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies, in accordance with FAR 8.405-6(a)(1)(i)(B), "Limited Sources." In accordance with FAR 8.405- 6(a)(1)(i)(B) only one source is capable of providing the supplies and services required at the level of quality required because the supplies or services are unique or highly specialized. Currently, DECO, Inc. is performing PSO services at federally owned and leased facilities throughout the state of Oklahoma via orders under BPA HSCEC7-10-A-00002. The BPA’s six month extension of services is set to expire on July 31, 2015. An additional three month interim task order is needed. The follow-on contract was awarded June 15, 2015 and a performance period start date of November 1, 2015 allows for the 120-day transition period. DECO, Inc. is the only source capable of providing the required PSO services starting August 1, 2015.
Due to the extensive screening, health, training, licenses and permits to be obtained, and transition requirements for PSOs under the FPS program, another PSO service firm cannot immediately replace the existing contractor. The incumbent contractor is familiar with the post requirements, locations and has a trained PSO force in place, and is therefore the only contractor at this time that can immediately fulfill the requirement without delay or disruption of necessary services to the Government. If a new PSO service firm were to immediately replace the existing firm a significant and severe drop in overall security would result, and federal government personnel, visitors and assets would be in jeopardy. Given the reality of terrorist threats, it is in the best interest of DHS and the public to continue to allow the incumbent contractor to provide the services until there is full performance of services under the follow-on contract. Effective PSO services are integral to FPS plans to respond to bio-chemical attacks, domestic workplace violence, trespassing, disorderly conduct, and emergency medical situations. PSO services also mitigate threats, by detecting explosive devices, firearms, hazardous materials and suspicious packages. Finally, PSO services are critical for stable operations, as detailed in continuity of operations plans (COOPs), and provide support for requirements. Given the cited critical roles, the order is needed to ensure a smooth transition and to eliminate any potential disruption in PSO services.
5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d):
When preparing the three month extension, the FPS Contracting Officer, using the procedures in FAR 8.405, will determine that the resultant order represents the best value and results in the lowest overall cost alternative, considering price, to meet the Government's needs. The nature of the service is such that the contractor is proposing only one labor category, Guard II, and the level of effort is solely at the discretion of the Government.
6. Statement of the reason market research was not conducted:
The agency has conducted market research in the past and is familiar with other potential sources and their qualifications. None of these sources can meet the extensive training, weapons and security clearance requirements within the time constraints associated with this requirement. Other firms could provide the services but not immediately and not without incurring substantial cost, causing unacceptable delays or potentially jeopardizing the safety of government employees or visitors. Thus, no other contractor can provide the required PSO services starting August 1, 2015 without an unacceptable interruption in services at this time.
7. Any other facts supporting the justification:
These uninterrupted services ensure the safety and well-being of the public and federal employees working at these locations. The incumbent is providing satisfactory services to the Government.
Solicitation of offers from other companies under the circumstances is not practical.
8. Statement of Actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition of the service is made:
Follow-on contract HSHQC7-15-D-00005 for PSO service in the state of Oklahoma was competitively awarded on June 15, 2015 with services scheduled to begin on November 1, 2015. The current requirement will provide for the continuation of PSO services under a GSA/FSS until services under the follow-on contract begin.
9. DHS intends to post this requirement on FedBizOpps pursuant to 8.405-6(a)(2)(i).
10. Technical and Requirements Personnel Certification.
Pursuant to FAR 8.405-6(c)(2)(x), I certify that this requirement meets the Government’s minimum need and that the supporting data, which form a basis for the Limited-Sources Justification, are accurate and complete.
