Sections 01 52 50 and 01 45 00 has been changed to delete verbiage. 01 45 00 and the only

‘key personnel’ listed that are required are a Superintendent and an Alternate

Superintendent, just in case the primary Superintendent is not present. The Alternate does not have to be on site full time, but be able to assume duties should the primary

Superintendent not be available

The bid date has been changed to April 26, 2016 at 2:00PM.

SECTION 01 45 00

CONSTRUCTION QUALITY CONTROL AND KEY PERSONNEL

PART 1 GENERAL

1.1 SUMMARY

1.1.1 Related Sections

Requirements of this Section apply to, and are component of, each section of the specifications.

1.2 DEFINITIONS

Reference to the Government Project Manager and Construction Representative (ConRep) herein refers to the FLETC Facilities Management Division Project Manager and Construction Representative.

1.3 SUBMITTALS

Approval is required for submittals as identified by each task order. Submit the following in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:

SD-01 Preconstruction Submittals

The below listed Pre-Construction Submittals are critical to start of work activities and are required to be provided to the Government a minimum of seven (7) calendar days prior to the scheduled kick-off Preconstruction Conference All Pre-Construction submittals require Government approval. Make any required Pre-Construction Re-Submittals within five (5) calendar days after Government rejection. Neglect to provide timely approved Pre-Construction submittals will not be the basis for time extension, claim under the Contract, nor will it be subject to the Disputes clause. Submit four (2) submittal copies for Government retention PLUS the number of copies requested for return back to the Contractor.

1.4 REPORTING FORMS

Use reporting forms provided in the contract or obtain a single copy of forms from the Facilities Management COR. The report forms will consist of the Superintendent's Daily Report (FTC-FMD-42) and the Quality Control Daily Report (FTC-FMD-67). Other forms shall be developed by the Contractor and submitted for approval of the Government for reporting of QC Meeting Agendas and Minutes, Preparatory Phase Checklist, Initial Phase Checklist, Rework Items List, Requests For Information (RFI), Field Test Reports, and Testing Plan and Log. Submit electronic daily reports via email to both the Facilities Management Division and Procurement Division. Copy the Government PM, CO, and ConRep (if assigned).

Deliver the following to the assigned Government task order Project Manager during Construction:

a. Superintendent's and QC’s Reports: Electronically transfer completed and signed daily reports to the Facilities Management Division assigned Project Manager and Contracting Officer by Friday of each week. Provide daily reports for all working and non-working days through the date of final acceptance of all work. Annotate non-working days accordingly on reports.

1.5 KEY PERSONNEL AND QC PROGRAM REQUIREMENTS

Establish and maintain a QC program as described in this section. This QC program is a key element in meeting all project objectives of timely and quality performance. The QC program consists of submittal review and approval, testing, completion inspections, and QC certifications and documentation necessary to provide materials, equipment, workmanship, fabrication, construction and operations which comply with the requirements of this Contract. The QC program shall cover on-site and off-site work and shall be keyed to the work sequence. No construction work or testing may be performed without an approved Superintendent being physically present on the FLETC premises. Duties requiring departure from the site during any work activities shall be performed by personnel other than the Superintendent.

Absence of these key personnel or their approved alternates from the FLETC premises during work activities can result in work stoppage, contract price reduction, staffing removal, and/or other actions as determined by the Government. The Contractor shall maintain a competent approved Superintendent at the FLETC premises at all times work is being performed.

Designated Alternate key personnel must be available on-site in the event of absence of the primary key person(s).

1.5.2 Acceptance of the Key Personnel

The Superintendent shall be subject to acceptance by the COR. If at any time during the Contract performance period, should key personnel's job performance fall below a reasonable standard of competence, professionalism, attendance, or should performance be otherwise objectionable, he/she shall be promptly replaced by the Contractor upon request from the Government.

Neglect to maintain an acceptable key Superintendent will not be the basis for claim under the Contract nor will it be subject to the Disputes clause.

All persons are subject to a background criminal investigation at the discretion of the Federal Law Enforcement Training Center.

1.5.3 Notification of Changes

Notify the COR, in writing, of any proposed changes in the QC Plan or changes to the QC organization personnel, a minimum of 10 work days prior to a proposed change. Proposed changes shall be subject to acceptance by the COR. Notify the COR in advance when the Alternate Superintendent will temporarily assume duties as necessitated by an absence of the primary person(s).

1.6 CONTRACTOR KEY PERSONNEL

All key personnel shall be direct employees of the prime Contractor and shall be on-site on normal working days at least between the hours of 7:30 a.m. and 4:30 p.m. Additionally, the authorized primary or alternate

Superintendent key personnel shall be on-site at any time work is being performed.

1.6.1 Superintendent

1.6.1.1 Duties

The Contractor shall employ, on-site at the project location, a Superintendent who shall be subject to approval by the Government prior to Notice to Proceed being given. The Superintendent shall devote his/her time to the supervision of work under this contract and shall be on-site at least on normal working days between the hours of 7:30 a.m. and 4:30 p.m. and at all times during the active performance of construction activities. The Superintendent shares a high level of responsibility for management and production of timely and quality conforming work. The Superintendent shall monitor work performance and accurately report activities in daily reports.

Autonomy of the on-site superintendent is critical to the smooth operation of FLETC requirements.

An Appointment Letter delegating these authorities shall be signed by a Principle Officer of the firm and submitted to the COR along with the Superintendent's resume for approval. The Superintendent will conduct routine meetings as required with Contractor and Subcontractor personnel to:

coordinate trade work performance, review schedule objectives for definable features of work, coordinate work conformance to approved submittals, plan and sequence the orderly progress of trade work, correct work deficiencies, maintain job site safety, address material and equipment delivery and proper storage, ensure environmental compliance, ensure testing is satisfactory, and conduct other related supervisory duties as necessary. Computer proficiency is required in such software systems as Word, Excel, Outlook (e-mail) and MS Project/Primavera. The individual must demonstrate a working knowledge and proficiency with Critical Path Network scheduling.

.1.6.1.2 Superintendent Qualifications

An individual with a minimum of five (5) years combined experience in the following positions: Project Superintendent, QC Manager, Project Manager, or Construction Manager on similar size and type construction contracts which included the major trades that are part of this Contract. The individual shall have at least three (3) of the most recent years’ experience as a Superintendent on similar size, complexity and type contracts. The individual must possess and demonstrate extensive experience and a working knowledge in the full range of trades and disciplines typical to work under this contract (For example: architectural work and finishes, carpentry, structural, earthwork, pavement, utilities, concrete, heating, ventilation and air conditioning, piping, plumbing, fire alarm and protection, electrical distribution systems, lighting, lightning protection, telecommunications, multi-media, and interior furnishings). The individual must be familiar with the safety requirements of EM 385-1-1 and/or OSHA 1926 Construction, and have experience in the areas of hazard identification, safety compliance, and sustainability. Computer proficiency is required in such software systems as Word, Excel, and Outlook (e-mail). The individual must demonstrate a working knowledge and proficiency with Critical Path Network scheduling and with MS Project or similar project management software.

1.6.1.3 Alternate Superintendent Duties and Qualifications

The Government approved and authorized alternate Superintendent shall be available to serve in the event of the designated primary Superintendent’s absence. The Alternate Superintendent's duties and qualifications shall be the same as the Superintendent's.

1.6.2 Key Personnel Resume Requirements

1.6.2.1 Acceptable key personnel qualifications, performance, and organizational observance of required authorities are considered critical to the project.

1.6.2.2 Offerers shall initially submit their proposed primary and alternate key personnel resumes and letters with the technical proposal during the contract solicitation phase. Any approvals of proposed key personnel are contingent upon the Government’s review and approval of key personnel and satisfactory background investigations. Award of a contract does not imply acceptance of the proposed key personnel. Acceptance occurs post-award.

1.6.2.3 Post-award and a minimum of seven (7) calendar days prior to the scheduled Preconstruction Conference, the Contractor shall again submit the documents required for formal Government review and approval of all key personnel. Submission of resumes failing to demonstrate compliant qualifications will be rejected.

1.6.2.4 Any subsequent proposed change in key personnel requires submission of the resume and other documents for Government review and approval.

1.7 SUBMITTAL REVIEW AND APPROVAL

Procedures for submission, review and approval of submittals are described in Section 01 33 00 SUBMITTAL PROCEDURES. Submittals requiring Government approval will be identified by each specification section and are to be scheduled and made prior to the acquisition of the material or equipment covered thereby. Submittals not requiring Government approval will be made available to the Government if requested for information only.

1.8 COMPLETION INSPECTIONS

1.8.1 Punch-Out Inspection

Near the completion of all work on a contract or any increment thereof, established by a completion time stated, the Superintendent shall self-perform an inspection of the work and develop a "punch list" of items which do not conform to the contract documents. Include in the punch list any remaining items on the "Rework Items List", which were not corrected prior to the Punch-Out Inspection. The punch list shall include the estimated date by which the deficiencies will be corrected. Two copies of the punch list shall be provided to the Government. The Superintendent shall make follow-on inspections to ascertain that all deficiencies have been corrected. Once this is accomplished, the Contractor shall certify in writing to the Government that Punch-Out work is satisfactorily completed and the facility is ready for the Government "Pre-Final Inspection". Allow a minimum of two (2) working days for Government coordination of the start of Pre-Final Inspection.

1.8.2 Pre-Final Inspection

The Government will perform this inspection to verify that the contract is complete. The Government may terminate Pre-Final Inspection at any time should it be determined the work has not been satisfactorily completed or that previously documented deficiencies remain incomplete. In such an instance the Contractor shall resume and progress Punch-Out work and shall repeat the Punch-Out Inspection. A Government "Pre-Final Punch List" may be developed as a result of this inspection. The Superintendent shall ensure that all items on this list are corrected prior to notifying the Government that a "Final" inspection with the Client can be scheduled. Any items noted on the "Pre-Final" inspection shall be corrected in a timely manner and shall be accomplished before the contract completion date for the work, or any particular increment thereof, if the project is divided into increments by separate completion dates.

1.8.3 Final Acceptance Inspection

The Superintendent shall coordinate with the Government PM the date a contract final acceptance inspection can be held. The notice shall certify in writing that all items previously identified on the pre-final punch list will be corrected and acceptable, along with any other unfinished Contract work, by the proposed date of the final acceptance inspection. The Contractor shall be represented by the Superintendent and others deemed necessary. Attendees for the Government may include the Project Manager, COR, and personnel representing the Client.

1.9 DOCUMENTATION

1.9.1 Construction Documentation

Reports are required for each day that work is performed and shall accompany the Contractor Quality Control Daily Report prepared for the same day.

Maintain current and complete records of on-site and off-site QC program operations and activities. Reports are required for each day work is performed. Account for each calendar day throughout the life of the Contract. Every space on the forms must be filled in. Use N/A if nothing can be reported in one of the spaces. The Project Superintendent must prepare and sign their respective daily reports. The reporting of work shall be identified by terminology consistent with the construction schedule. In the "remarks" sections of the reports, enter pertinent information including directions received, problems encountered during construction, work progress and delays, conflicts or errors in the drawings or specifications, field changes, safety hazards encountered, instructions given and corrective actions taken, delays encountered and a record of visitors to the work site, quality control problem areas, deviations from the QC Plan, construction deficiencies encountered, meetings held. For each entry in the report(s), identify the Schedule Activity No. that is associated with the entered remark.

1.9.2 Rework Items List and Corrective Action Plans

The Superintendent shall maintain a list of work that does not comply, identifying what items need to be reworked, the date the item was originally discovered, the date the item will be corrected by, and the date the item was corrected. Provide detailed written Corrective Action Plans to the Government Project Manager as requested in association with rework items.

Corrective action plans shall be presented in narrative format with supporting drawings, product information, submittals, and other documents as required. Do not proceed with work without written Government Project Manager approval of Corrective Action Plans. Make changes to Corrective Action Plans as required by the Government. Remove and replace non-compliant or deficient work as instructed. There is no requirement to report a rework item that is corrected the same day it is discovered.

Attach a copy of the "Rework Items List" to each Progress Meeting Agenda and to the last daily CQC Report of each month. The Contractor shall be responsible for including those items identified by the Government.

1.9.3 As-Built Drawings

The Superintendent is required to ensure the as-built drawings, if required, are kept current on a daily basis and marked to show deviations which have been made from the contract drawings. Ensure each deviation has been identified with the appropriate modifying documentation (e.g. Field Change No., Variance No., Modification No., Request for Information No., etc.).

The Superintendent shall initial each revision.

1.10 NOTIFICATION OF NON-COMPLIANCE

The Government will notify the Contractor of detected non-compliance with the Contract. Such notice, when verbally delivered to the Contractor at the work site, shall be deemed sufficient for the purpose of notification. The Government may, at its discretion, issue Construction Contractor Compliance Notices (CCCN's) or other written documentation concerning non-compliant work. The Contractor shall take immediate steps to bring work into compliance. When a Corrective Action Plan is required by the Government, no corrective work shall occur prior to Government Project Manager approval of the Corrective Action Plan. If the Contractor fails or refuses to promptly bring work into compliance, the Government may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to such stop orders shall be made the subject of claim for extension of time for excess costs or damages by the Contractor.

PART 2 PRODUCTS

PART 3 EXECUTION

3.1 PREPARATION

Designate receiving/storage areas for incoming material to be delivered according to installation schedule and to be placed convenient to work area in order to minimize waste due to excessive materials handling and misapplication. Store and handle materials in a manner as to prevent loss from weather and other damage. Keep materials, products, and accessories covered and off the ground, and store in a dry, secure area. Prevent contact with material that may cause corrosion, discoloration, or staining.

Protect all materials and installations from damage by the activities of other trades.

3.2 GOVERNMENT QUALITY ASSURANCE

In accordance with FAR 52.246-12, Inspection of Construction:

a. Government inspections and tests are for the sole benefit of the

Government and do not-

(1) Relieve the Contractor of responsibility for providing adequate quality control measures;

(2) Relieve the Contractor of responsibility for damage to or loss of the material before acceptance;

(3) Constitute or imply acceptance; or

(4) Affect the continuing rights of the Government after acceptance of the completed work under paragraph (f) of this section.

b. The presence or absence of a Government inspector does not relieve the Contractor from any contract requirement, nor is the inspector authorized to change any term or condition of the specification.

c. The Contractor shall promptly furnish, at no increase in contract price, all facilities, labor, and material reasonably needed for performing such safe and convenient inspections and tests as may be required by the Project Manager. The Government shall perform all inspections and tests in a manner that will not unnecessarily delay the work.

d. The Contractor shall, without charge, replace or correct work found by the Government not to conform to contract requirements, unless in the public interest the Government consents to accept the work with an appropriate adjustment in contract price. The Contractor shall promptly segregate and remove rejected material from the premises.

e. If the Contractor does not promptly replace or correct rejected work, the Government may-

(1) By contract or otherwise, replace or correct the work and charge the cost to the Contractor; or

(2) Terminate for default the Contractor's right to proceed.

f. If, before acceptance of the entire work, the Government decides to examine already completed work by removing it or tearing it out, the Contractor, on request, shall promptly furnish all necessary facilities, labor, and material. If the work is found to be defective or nonconforming in any material respect due to the fault of the Contractor or its subcontractors, the Contractor shall defray the expenses of the examination and of satisfactory reconstruction. However, if the work is found to meet contract requirements, the Government shall make an equitable adjustment for the additional services involved in the examination and reconstruction, including, if completion of the work was thereby delayed, an extension of time.

3.3 GOVERNMENT ACCEPTANCE

The performance and quality of work delivered by the Contractor, including services rendered and any documentation, shall be subject to inspection, review, and acceptance by the Government. All work shall be completed within the time specified in the contract, including provision of close-out documents and correction of deficiencies noted during the final inspection.

3.4 WARRANTY RESPONSIBILITIES

The Contractor shall perform quality control duties in relation to warranty work. Provide a knowledgeable and competent person on site to coordinate, supervise, and to execute quality control processes on warranty work.

Perform final inspection of warranty work and promptly notify the Government of the compliant completion of warranty work. Response times and corrective actions shall be coordinated with the Government. In accordance with FAR 52.246-21 Warranty of Construction:

a. In addition to any other warranties in this contract, the

Contractor warrants that work performed under each contract conforms to the contract requirements and is free of any defect in equipment, material, or design furnished, or workmanship performed by the Contractor or any subcontractor or supplier at any tier.

b. This warranty shall continue for a period of 1 year from the date of final acceptance of the work in each contract. If the Government takes possession of any part of the work before final acceptance, this warranty shall continue for a period of 1 year from the date the Government takes possession.

c. The Contractor shall remedy at the Contractor's expense any failure to conform, or any defect. In addition, the Contractor shall remedy at the Contractor's expense any damage to Government-owned or controlled real or personal property, when that damage is the result of-

(1) The Contractor's failure to conform to contract requirements;

or

(2) Any defect of equipment, material, workmanship, or design furnished.

d. The Contractor shall restore any work damaged in fulfilling the terms and conditions of this clause. The Contractor's warranty with respect to work repaired or replaced will run for 1 year from the date of repair or replacement.

e. The Contracting Officer shall notify the Contractor, in writing, within a reasonable time after the discovery of any failure, defect, or damage.

f. If the Contractor fails to remedy any failure, defect, or damage within a reasonable time after receipt of notice, the Government shall have the right to replace, repair, or otherwise remedy the failure, defect, or damage at the Contractor's expense.

g. With respect to all warranties, express or implied, from subcontractors, manufacturers, or suppliers for work performed and materials furnished under this contract, the Contractor shall-

(1) Obtain all warranties that would be given in normal commercial practice;

(2) Require all warranties to be executed, in writing, for the benefit of the Government, if directed by the Contracting Officer;

and

(3) Enforce all warranties for the benefit of the Government, if directed by the Contracting Officer.

h. This warranty shall not limit the Government's rights under the

Inspection and Acceptance clause of this contract with respect to latent defects, gross mistakes, or fraud.

1.3 DEFINITIONS

a. Multi-employer work site (MEWS). The prime contractor is the "controlling authority" for all work site safety and health of the subcontractors.

b. Recordable Occupational Injuries or Illness. An occupational injury or illnesses which result in serious injuries, lost workday cases, non-fatal cases or significant mishaps.

c. Serious Injuries & Fatalities. Regardless of the time between the injury and death or the length of the illness; hospitalization of three or more employees; or property damage in excess of $200,000.

d. Lost Workday Cases. Injuries, other than fatalities, that result in lost workdays.

e. Non-Fatal Cases. Cases without lost workdays which result in transfer to another job or termination of employment, or require medical treatment (other than first aid) or involve property damage in excess of $10,000 but less than $200,000 or involve: loss of consciousness or restriction of work or motion. This category also includes any diagnosed occupational illnesses which are reported to the employer but are not classified as facilities or lost workday cases.

f. Health and Safety Plan. Army term of SHP or SSHP used in COE EM-

385-1-1. "USACE" property and equipment specified in COE EM-385-1- 1 should be interpreted as Government property and equipment.

g. Safety Officer. The superintendent or other qualified or competent person who is responsible for the on-site safety required for the project.

h. Significant Contractor Mishap. A contractor mishap which involves falls of 4 feet or more, electrical mishaps, confined space mishaps, diving mishaps, equipment mishaps, and fire mishaps which result in a lost time injury, or property damage of $10,000 or more, but less than $200,000; or when fire department or emergency medical treatment (EMT) assistance is required.

i. Medical Treatment. Treatment administered by a physician or by registered professional personnel under the standing orders of a physician. Medical treatment does not include first aid treatment provided by a physician or registered personnel.

j. First Aid. A one-time treatment, and follow-up visit for the purpose of observation, of minor scratches, cuts, burns, splinters, and so forth, which do not ordinarily require medical care, even though provided by a physician or registered professional personnel.

k. Lost Workdays. The number of days (consecutive or not) after, but not including, the day of injury or illness during which the employee would have worked but could not do so; that is, could not perform all or part of his normal assignment during all or any part of the workday or shift; because of the occupational injury or illness.

1.4 SUBMITTALS

Submit in accordance with Section 01 33 00, "Submittal Procedures."

SD-07 Certificates

Accident prevention plan (APP);

The above must be submitted a minimum of 7 days prior to scheduled Preconstruction Conference. Government approval is required prior to Notice to Proceed and commencement of construction work activities.

1.5 QUALITY ASSURANCE

1.5.1 Qualifications

a. Qualifications of Safety Officer:

(1) Ability to manage the on-site contractor safety program through appropriate management controls,

(2) Ability to identify hazards and have the capability to expend resources necessary to abate the hazards.

(3) Must have worked on similar types of projects that are equal to or exceed the scope of the project assigned with the same responsibilities.

b. Qualification of Crane Operators. Crane operators shall meet the requirements in COE EM-385-1-1, Appendix G.

1.5.2 Meetings

1.5.2.1 Preconstruction Conference

The safety officer shall attend the preconstruction conference and routine progress meetings.

1.5.2.2 Meeting on Work Procedures

Meet with employees regularly to discuss work procedures and safety precautions required by the APP and AHA. Ensure the participation of the Contractor's PM, Superintendent and the Quality Control Manager.

1.6 ACCIDENT PREVENTION PLAN (APP)

Prepare the APP in accordance with the required and advisory provisions of COE EM-385-1-1 including Appendix A, "Minimum Basic Outline for Preparation of Accident Prevention Plan," and as modified herein. Include the associated AHA and other specific plans, programs and procedures listed on Pages A-3 and A-4 of COE EM-385-1-1, some of which are called out below.

On-site work shall not be authorized until the Government has approved the

APP.

1.6.1 Contents of the Accident Prevention Plan

a. Name and safety related qualifications of Safety Officer (including training and any certifications).

b. Qualifications of competent and of qualified persons including competent person for excavation.

c. Identify of the individual who will complete exposure data (hours worked); accident investigations, reports and logs; and immediate notification of accidents to include subcontractors.

d. Emergency response plan. Conform to COE EM-385-1-1, paragraph 01.E and include a map denoting the route to the nearest emergency care facility with emergency phone numbers. Contractor may be required to demonstrate emergency response.

e. Hazardous Material Use. Provisions to deal with hazardous materials, pursuant to the Contract Clause "FAR 52.223-3, Hazardous Material Identification and Material Safety Data." And the following:

(1) Inventory of hazardous materials to be introduced to the site with estimated quantities.

(2) Plan for protecting personnel and property during the transport, storage and use of the materials

(3) Emergency procedures for spill response and disposal, including a site map with approximate quantities on site at any given time. The site map will be attached to the inventory, showing where the hazardous substances are stored

(4) Material Safety Data Sheets for inventoried materials not required in other section of this specification.

(5) Labeling system to identify contents on all containers on-site.

(6) Plan for communicating high health hazards to employees and adjacent occupants.

f. Hazardous Energy Control Plan. For hazardous energy sources, comply with COE EM-385-1-1, paragraph 12.A.07.

g. Critical Lift Procedures. Weight handling critical lift plans will be prepared and signed in accordance with COE EM-385-1-1, paragraph 16.c.18.

h. Alcohol and Drug Abuse Plan. Description of the on-site prevention program.

i. Fall Protection Plan. The plan shall be site specific and protect all workers at elevations above 6 feet.

j. Silica Exposure Reduction. The plan shall include specific procedures to prevent employee silica inhalation exposures.

k. Excavation Plan. The safety and health aspects prepared in accordance with Section 02302, "Excavation, Backfilling, and Compacting for Utilities"

1.7 ACTIVITY HAZARD ANALYSIS (AHA)

As a minimum, define activity being performed, sequence of work, specific hazards anticipated, control measures to eliminate or reduce each hazard to acceptable levels, training requirements for all involved, and the competent person in charge of that phase of work. For work with fall hazards, including fall hazards associated with scaffold erection and removal, identify the appropriate fall arrest systems. For work with materials handling equipment, address safeguarding measures related to materials handling equipment. For work requiring excavations, include excavation safeguarding requirements. The appropriate AHA shall be reviewed and attendance documented by Contractor at the preparatory, initial, and follow-up phases of Quality Control inspection.

1.8 FALL HAZARD PREVENTION PROGRAM

1.8.1 Scaffolds

Delineate the fall protection requirements necessary during the erection and dismantling operation of scaffolds used on the project in the fall protection plan and activity hazard analysis for the phase of work.

1.8.2 Training

Institute a fall protection program. As part of the Fall Protection Program, contractor shall provide training for each employee who might be exposed to fall hazards.

1.9 DUTIES OF THE SAFETY OFFICER

a. Actively participate in the development of the required safety plan submittals.

b. Monitor and ensure construction hazards are identified and corrected.

c. Maintain applicable safety reference material, including COE EM- 385-1-1, on the job site.

d. Maintain a log of safety inspections performed. Report all observed safety violations and corrective actions in writing to the Government.

e. Immediately stop any work activity in the event unsafe work practices are observed which are believed to pose a serious risk to personnel safety or property.

f. Attend the pre-construction conference and routine progress meetings.

g. Provide regular safety related training and instruction to all employees performing work under this contract.

1.10 DISPLAY OF SAFETY INFORMATION

Display the following information in clear view of the on-site construction personnel:

a. Map denoting the route to the nearest emergency care facility with emergency phone numbers.

b. AHA

c. Confined space entry permit.

d. Sign with number of hours worked since last lost workday accident.

1.11 SITE SAFETY PREFERENCE MATERIALS

Maintain safety-related references applicable to the project on site, including COE EM-385-1-1 and those others listed in the article "References." Maintain applicable equipment manufacturers' manuals.

1.12 HIGH HAZARD WORK AND LONG DURATION

Work under this contract is potentially hazardous. Pursuant to contract clause "FAR 52.236-13, Accident Prevention, Alternate I," submit in writing additional proposals for effecting accident prevention under hazardous conditions.

1.13 SITE CONDITIONS

Contractors will arrange for their own emergency medical treatment.

Government has no responsibility to provide.

1.14 REPORTS

1.14.1 Reporting Reports

For OSHA inspections or recordable accidents, the prime contractor will conduct a suitable investigation, provide a copy of the OSHA inspection or accident report to the Government, and identify corrective actions. Provide findings and reports to the Government within 5 calendar days of the inspection or accident.

1.14.2 Notification

Notify the Contracting Officer, within 4 hours, of any accident meeting the definition of OSHA recordable occupational injury or illness. Information shall include Contractor name; contract title; type of contract; name of activity, installation or location where mishap occurred; date and time of mishap; names of personnel injured; extent of property damage, if any; and brief description of mishap (to include type of construction equipment used, PPE used, etc.) In addition to OSHA reporting requirements, initial notification shall be made of any accident involving significant mishaps.

1.14.3 OSHA Citations and Violations

Provide the PM and Contracting Officer with a copy of each OSHA citation, OSHA report and Contractor response. Correct violations and citations promptly and provide written corrective actions to the Government.

PART 2 PRODUCTS

2.1 FALL PROTECTION ANCHORAGE

Fall protection anchorages, used by contractors to protect their people, will be left in place and so identified for continued customer use.

PART 3 EXECUTION

3.1 CONSTRUCTION

Comply with COE EM-385-1-1, NFPA 241, the accident prevention plan, the activity hazard analysis and other related submittals and activity fire and safety regulations.

3.1.1 Hazardous Material Exclusions

Notwithstanding any other hazardous material used in this contract, radioactive materials or instruments capable of producing ionizing/non-ionizing radiation as well as materials which contain asbestos, mercury or polychlorinated biphenyls, di-isocynates, lead-based paint are prohibited.

3.1.2 Unforeseen Hazardous Material

The contractr should have identified materials such as PCB, lead paint, and friable and nonfriable asbestos. If material, not indicated, that may be hazardous to human health upon disturbance during construction operations is encountered, stop that portion of work and notify the Contracting Officer, ConRep and COR immediately. Within 14 calendar days the Government will determine if the material is hazardous. If material is not hazardous or poses no danger, the Government will direct the Contractor to proceed without change. If material is hazardous and handling of the material is necessary to accomplish the work, the Government will issue a modification pursuant to "FAR 52.243-4, Changes" and "FAR 52.236-2, Differing Site Conditions."

3.2 PRE-OUTAGE COORDINATION MEETING

Contractors are required to apply for utility outages a minimum of 15 days in advance. As a minimum, the request should include the location of the outage, utilities being effected, duration of outage and any necessary sketches. Once approved and prior to beginning work on the utility system requiring shut down, the Contractor shall attend a pre-outage coordination meeting with the Construction Representative to review the scope of work and the lock out/tag out procedures for worker protection.

3.3 PERSONNEL PROTECTION

3.3.1 Hazardous Noise

Provide hazardous noise signs, and hearing protection, where ever equipment and work procedures produce sound-pressure levels greater than 85 dBA steady state or 140 dBA impulse, regardless of the duration of the exposure.

3.3.2 Fall Protection

Enforce use of the fall protection device named for each activity in the AHA all times when an employee is on a surface 6 feet or more above lower levels. Personal fall arrest systems are required when working from an articulating or extendible boom, scissor lifts, swing stages, or suspended platform. Fall protection must comply with ANSI A10.14.

3.3.2.1 Personal Fall Arrest Device

Equipment, subsystems, and components shall meet ANSI Z359.1, Personal Fall Arrest Systems. Only a full-body harness with a shock absorbing lanyard is an acceptable personal fall arrest device. Body belts may only be used as positioning devices only such as for steel reinforcing assembly. Body belts are not authorized as a personal fall arrest device. Harnesses must have upper middle back "D" rings for proper body suspension during a fall.

Lanyard must be fitted with a double locking snap hook attachment.

Webbing, straps, and ropes must be of synthetic fiber or wire rope.

3.3.3 Scaffolding

Employees shall be provided with a safe means of access to the work area on the scaffold. Climbing of any scaffold braces or supports not specifically designed for access is prohibited. Contractor shall ensure that scaffold erection is performed by employees that are qualified. Do not use scaffold without the capability of supporting at least four times the maximum intended load or without appropriate fall protection as delineated in the accepted fall protection plan. Minimum platform size shall be based on the platform not being greater in height than four times the dimension of the smallest width dimension for rolling scaffold. Some Baker type scaffolding has been found not to meet these requirements. Stationary scaffolds must be attached to structural building components to safeguard against tipping forward or backward. The first tie-in shall be at the height equal to 4 times the width of the scaffold base.

3.3.4 Use of Material Handling Equipment

a. Material handling equipment such as forklifts shall not be modified with work platform attachments for supporting employees unless specifically delineated in the manufactures printed operating instructions. Crane supported work platforms shall only be used in extreme conditions if the Contractor proves that using any other access to the work location would provide a greater hazard to the workers.

b. Cranes must be equipped with Load Indicating Devices, anti-two blocks devices, load, boom angle moment indicating indicators.

c. Christmas-tree lifting (multiple rigged materials) is not allowed.

3.3.5 Excavations

The Contractor designated Safety Officer shall be on site when work is being performed in excavation, and shall inspect excavations prior to entry by workers. Individual must evaluate for all hazards, including atmospheric, that may be associated with the work, and shall have the resources necessary to correct hazards promptly.

3.3.6 Conduct of Electrical Work

Underground electrical spaces must be certified safe for entry before entering to conduct work. Cable intended to be cut must be positively identified and de-energized prior to performing each cut. Perform all high voltage cutting remotely. When racking in or live switching of circuit breakers, no additional person other than the switch operator will be allowed in the space during the actual operation. Plan so that work near energized parts is minimized to the fullest extent possible. Use of electrical outages clear of any energized electrical sources is the preferred method. When working in energized substations, only qualified electrical workers shall be permitted to enter. When work requires Contractor to work near energized circuits as defined by the NFPA 70, high voltage personnel must use personnel protective equipment that includes, as a minimum, electrical hard hat, safety shoes, insulating gloves with leather protective sleeves, fire retarding shirts, coveralls, face shields, and safety glasses. Insulating blankets, hearing protection, and switching suits may be required, depending on the specific job and as delineated in the Contractor AHA.

3.3.7 Crystalline Silica

Grinding, abrasive blasting, and foundry operations of construction materials containing crystalline silica, shall comply with OSHA regulations, such as 29 CFR 1910.94, and COE EM-385-1-1, (Appendix C). The Contractor shall develop and implement effective exposure control and elimination procedures to include dust control systems, engineering controls, and establishment of work area boundaries, as well as medical surveillance, training, air monitoring, and personal protective equipment.

3.4 ACCIDENT SCENE PRESERVATION

For serious accidents, ensure the accident site is secured and evidence is protected remaining undisturbed until released by the Contracting Officer.

3.5 FIELD QUALITY CONTROL

3.5.1 Inspection

Include safety inspection as a part of the daily Quality Control inspections required in Section 01 45 00, "Quality Control."
