LRO REFUELING PERFORMANCE WORK STATEMENT (PWS)
ISSUED AS PART OF HSFELA-14-Q-1001
TO BE INCORPORATED IN THE CONTRACT AWARDED THEREUNDER
I. Background
The Federal Emergency Management Agency (FEMA), Louisiana Recovery Office (LRO), has facilities in Baton Rouge and New Orleans (Algiers) that are equipped with generators to provide back-up power when a loss of electrical power occurs as a result of an emergency situation. These generators, and other equipment situated at the facilities, require either diesel fuel or regular (87 octane), unleaded gasoline for operation. Operability of these generators and equipment is considered mission critical.
II. Scope
This PWS is part of a Request for Quote and, following BPA contract award, will serve as the basis for any delivery orders issued thereunder. The RFQ is intended to identify and secure a contractor to deliver generator diesel fuel and gasoline to each of the facilities. A third requirement may include, on an emergency call basis, the delivery of mobile storage tanks (for short-term use). (The facilities are listed below, in Section V.)
In performing this PWS, the contractor will comply at all times with applicable local, state and federal environmental, labor, safety and health regulations, statutes, laws and executive orders.
III. Tasks, Generally
Contractor will provide the fuel and gasoline, as required by each facility. All generators and equipment will be topped off during each delivery. The Contracting Officer Representative (COR) appointed to the contract shall be the ordering person for the purposes of requesting fueling services.
The following will be set out in more detail in the terms and conditions of the BPA as generally reflected in the delivery orders. These will be in the form of Contract Line Item Numbers (CLIN’s), in the Price/Cost Schedule of the contract.
A. There are two types of deliveries contemplated by the PWS: regular, and emergency. The contractor will be expected to fulfill the needs of the Agency with respect to a regular call within 24 hours of the COR’s call. The contractor will be expected to fulfill the needs of the Agency with respect to an emergency call as short a period of time as possible from receipt of the COR’s call. In some instances, depending on the extent of the emergency, and the Agency’s urgent need for refueling, deliveries may be requested on an As-Soon-as-Possible basis. Emergency requirements will reflect cooperation of the contractor and the Agency to assure that safety concerns of all involved personnel are considered.
1. The contractor is expected to deliver the fuel and supply a vehicle from which the driver can refuel the generators and various equipment as the COR requests, within two (2) hours of arrival at the facility. Contractor shall also provide spill protection equipment in order to minimize and contain any spill while refueling is taking place. It is the objective of the contract that contractor take all necessary precautions and take all necessary steps to preclude the occurrence of a spill, and to contain it, at no expense to the Agency, as promptly and completely as possible.
2. Deliveries made against regular calls, shall be between the hours of 8:00 a.m. and 5:00 p.m. Monday through Friday.
3. Deliveries made against emergency calls, shall be made as promptly as possible following receipt of a call from the COR, but in no event more than 12 hours from receipt of the call. Contractor must have emergency call service available on a 24/7 basis, such call number(s) to be supplied to the COR at time of award. Contractor must assure that its driver arrives and is able to complete refueling as quickly as possible; Agency prefers that pumping be completed within two (2) hours after arrival, or such additional time as is reasonable.
B. The Contractor shall furnish and be responsible for all personnel, equipment, labor insurance, licenses, permits, and ancillary supplies necessary for the safe transportation, operation and dispensing of the fuel(s) as required. Delivery vehicles, and drivers of the contractor’s vehicles, are expected to be fully licensed and trained as required by local, state and federal laws and regulations. Contractor personnel shall be experienced in the dispensing of both types of fuel required under this PWS and trained to deal with and remediate any spills.
C. Each fuel delivery to each separate facility will require a bill of lading, in such detail and number of copies as are necessary to permit the designated Agency recipient (usually the COR), to acknowledge receipt of the product(s) and to secure a copy of the B/L for the Agency’s records D. Billing for fuel and the cost of delivery, shall be invoiced to the Agency as will be reflected in the BPA.
Because no emergency, nor its severity, can be fully predicted in advance of its occurrence, the impact of a disaster on any or all of the Agency’s facilities may require use of mobile storage tanks so that refueling the generators and equipment can be temporarily performed by FEMA personnel. The number, capacity and length of use of these storage tanks will be totally dependent on the impact of the disaster and the ability of the local utility to reinstate service to the Agency’s facilities. When requested by the COR, contractor will be asked to treat the requirement under the provisions governing an emergency call (i.e., delivery within 12 hours or less). Contractor is requested, in submitting its quote, to provide current short-term rental rates for the various sizes of mobile, double-walled storage tanks it generally supplies in the 1000 gallon to 5000 gallon range.
Due to the Mission-Critical nature of this PWS, Agency may issue more than one BPA in response to the quotations received. One BPA might issue for the two (2) installations located in the Baton Rouge area, and the other BPA might issue for the New Orleans (Algiers) installation. The addresses of the facilities are set out at Section V., below.
NOTE: While the two facilities located in Baton Rouge are anticipated to remain open for the full twelve (12) months of the initial period of the BPA, the possibility exists that the Algiers facility will close at the end of the 2014 Hurricane Season: November 30, 2014.
IV. Employee Identification
Contractor employees will be required to prominently display a company-issued badge when entering an Agency facility. Such badge shall be worn by the employee(s) so as to be plainly visible and at a minimum display the contractor name, the name of the employee and a recent photo of such employee. All contractor employees shall comply with all Agency escort rules and requirements together with those rules made known to the employees by the COR or security personnel at the facility.
V. Facility Locations
Generators and support equipment which will require refueling are located at the following addresses:
1 Seine Court, New Orleans (Algiers), LA 70114 1500 Main Street, Baton Rouge, LA 70802 2965 N. Sherwood Forest Dr. Baton Rouge, 70814
VI. Period of Performance The initial term of the BPA is twelve (12) months. The BPA will provide for a one (1) year option to extend the agreement. As noted above, the New Orleans facility is subject to closing on November 30, 2014.
VII. Quality Assurance The COR, and any alternate COR appointed to the BPA, shall assure that the terms of the agreement are properly carried out. Contractor, and its employees will cooperate with the COR or Alternate COR with respect to carrying out the terms of the BPA and of all delivery orders issued thereunder.
