CDP COBRATF FOMS
Questions and Answers # 1
1. Project Manager availability – Is the PM required/expected to be onsite on a daily basis? The PWS calls out an (onsite supervisor, Deputy) so the way it is written eludes that the PM can work from an offsite location and be available by phone 24/7 as long as the designee (onsite manager) is available to meet with the government on short notice, is that correct?.
Yes, the PM is required to be onsite daily during normal working hours, and also available via telephone 24/7. See PWS 2.5.1:
2.5.1 Project Manager
The Contractor shall provide an onsite Project Manager who shall be responsible for all Contractor work performed under the resulting contract. The Project Manager is further designated as "Key by the Government as set forth in the contract clause HSAR 3052.215-70, Key Personnel or Facilities. The Contractor shall designate a Project Manager as part of the proposal, to include qualifications and resume. This individual shall be responsible for the overall management and coordination for the work required under this contract and shall act as a central point of contact with the Government.
2.5.1.1 Project Manager Appointment
The Project Manager shall be a single point of contact for the CO and the COR. It is anticipated that the Project Manager shall be one of the senior level employees provided by the Contractor for this work effort. The name of the Project Manager, and the name(s) of any alternate(s) who shall act for the Contractor in the absence of the Project Manager, shall be provided to the Government as part of the Contractor's proposal. The Project Manager shall have the authority to speak for and act for the Contractor in all matters related to required services under this contract. The Contractor shall include in the designation letter any limitations on the Project Managers ability to bind the Contractor to changes or adjustments. During any absence of the Project Manager, only one alternate shall have full authority to act for the Contractor on all matters relating to work performed under the resulting contract.
2.5.1.2 Project Manager Availability
The Project Manager shall be available to the COR via telephone at all times, 24/7. If the Project Manager will not be available by telephone, he/she will notify the COR of the non-availability and identify an alternate. The Project Manager or designated alternate shall be available to meet with Government personnel at the designated CDP facility(s) within 30 minutes during normal working hours (Monday through Friday between 07:30 and 4:30, CST) and within two (2) hours of request outside normal working hours.
2. For large line item projects like the Corps of Engineers facility upgrade work that was going on during our tour – Who has oversight and overall responsibility for their work plans, health & safety and quality?
For large projects, such as those procured through USACE, USACE has oversight and overall responsibility for the performance of that project and their contractors, with coordination with FEMA (CDP) Government personnel. If FEMA contracts directly for a large project, FEMA has oversight and overall responsibility. In coordination with the FOMS COR, the FOMS contractor may have some minor tasks (work orders) associated with a large project (i.e. clearing equipment or supplies from an area), but the FOMS contractor will not perform large projects or work directly with a large project contractor or Government personnel.
3. Reference: Resumes and Letters of Intent
Question: Will the Government consider only requiring the on-Site PM’s resume? In accordance with the Presidential Memo Contractors are required to Offer the non-management incumbent employees the positions. If you require Resumes for everyone the incumbent employees can influence/drive the procurement. Additionally, if a contractor does not get the incumbent resume we are forced to have a candidate sign a letter of intent knowing we cannot offer them position. Requiring the resumes and letters of intent gives the incumbent contractor an unfair advantage.
IAW the RFP, Section L.3, resumes are only required for proposed key personnel, not everyone. The PWS will be revised to require the following key personnel:
Project Manager
On Site Supervisor (Deputy PM)
Quality Specialist
Safety Specialist
Those key personnel positions listed above that are remaining in the revised PWS are exempt from the requirements FAR 52.222-17 Non-displacement of Qualified Workers, thus incumbent employees’ (or their resumes) are not required for those key personnel positions.

We understand all labor is based on a firm fixed price cost proposal. In the event a repair or maintenance is required on equipment or systems that fall into the category of “but not limited to the following” will the Government execute a contract modification for additional funding to execute these repairs or maintenance?
Funding decisions are made based on a determination of the scope of the work required and coordination with the Contracting Officer. There could be a situation where the Government will add money to the contract if necessary to repair critical infrastructure or components

These paragraphs are summary examples of the types of work invovled with this contract.
1.3.1c
This paragraph states the equipment assigned to, or owned and operated or operated on, other contracts are excluded from this scope of work.

2.3.1
Onsite contract management shall communicate with the corporate office, subcontractor, and the COR/CO.
Communications will be between the Government and Contractor, the Government has no privity with the subcontractor.
In many instances the subcontractor’s employee may have technical knowledge or first-hand experience of the topic of discussion. To affect open, clear, and concise communications subcontractors may be required to provide direct feedback to the Government Representatives. Establishing a non-privity clause with the subcontractor's creates a barrier to effective communications. Will the Government please provide an explanation of the intent of this statement or consider removing the statement from the PWS?
PWS 2.5.1.3 Requests for Information, clarifies RFI's that may be required during the the performance of this contract.
2.3.1.1b

If the Government has established a no-privity with subcontractors as stated in PWS Paragraph 2.3.1 why is it necessary for the inclusion of subcontractor information? Will the Government please consider rewording or deleting the reference to subcontractors in this paragraph?
If Key personnel are subcontractor employees then emergency contact information will be required.
2.3.1.1.4
The Contractor shall provide reports to the COR or government staff as requested and in the format and media as requested.
Under most CMMS reports are generated and formatted in the system. We will attempt to modify the systems to provide reports to the COR in the format requested.

Yes, however, there maybe reports that might be outside of the information contained within the CMMS.

2.3.1.1.4
Contractor shall transition to the upgraded CMMS upon notification by COR that the upgraded CMMS is ready transition.
Contractor shall have 90 days to complete this transition and begin use of the agency
CMMS.
Will the Government please add this requirement to Section J, Attachment 8?
There is no need to add as a deliverable.
2.3.1.3
Verbal scheduling and status reports shall be provided when requested by the COR. The status of any item of work must be provided within one hour of the inquiry during regular working hours, and within four hours after regular working hours. Reports on the status of work requirements shall be provided when requested by the contracting officer/COR.
We understand the requirement for effective and open communication.
Depending on the emergency and impact of a given work order a one-hour response time does not seem unreasonable. However providing the status of any item of work within one-hour seems unreasonable and may impeded the effective execution of current/existing and more pressing contract functions. Will the Government please establish a more reasonable response time for non-emergency related requests by the Government?
One hour for a verbal status report is reasonable. To make this flexibile to accommodate situations where the one hour reporting is not faesible the wording was changed to "should" verses "must."
2.3.1.4.1
Minimally, the preventive or predictive maintenance standards or guides proposed by the Contractor shall be based on;
manufacturers recommended maintenance or the most current Public Buildings Service Operations and Maintenance Standards (PM Guide) or guides proposed by Contractor.

The Contractor shall propose to the Government predictive maintenance standards or guides for each piece of equipment where the manufacturer/designer recommends preventive maintenance...The equipment requiring Contractor proposed preventive or predictive maintenance standards or guides shall include all of the building equipment when any of the following equipment characteristics apply:
This statement is confusing and contradictive. First the Government is requesting maintenance standards or guides for each piece of equipment with recommended preventive maintenance.
Then the Government includes all equipment with moving parts. prone to failure, subject to this contract. etc. Will the Government please clarify and provide a detailed list of equipment currently in use at the COBRTF that will require this standards and/or guides?

2.3.1.4.2
Building Automation Systems (BAS) Control Systems
This paragraph and related paragraphs are confusing and contradictory. PWS Paragraphs 1.3b, d, and r seem to allude to BAS being included in this scope of work.
PWS Paragraph 1.3.1h seems to allude to BAS software and licenses as being excluded from this contract. Will the Government please clarify?
The contractor shall be responsible for ensuring Government is notified of updates to the sofware. The Governement will be resonsible for upgrading BAS software and softwre licenses. See PWS 2.3.1.4.2
2.3.1.4.2
The Contractor is responsible for all system hardware; for keeping software functioning as necessary; for making set point adjustments as necessary and appropriate;
for other than reloading programs and for making operator level changes such as set point adjustments.
This statement is confusing. Initially the contractor is responsible for making set point adjustments as necessary but, then seems to indicate this requirement is for other than making operator level changes such as set point adjustments. Will the Government please clarify this requirement
PWS: 2.3.1.4.2 , removed " for other than reloading programs and for making operator level changes such as set point adjustments"
2.3.1.4.2
The Contractor is not responsible for upgrading software but should inform Government of software update revisions and patches.
This requirement is contradicting the information found in PWS Paragraph 1.3r.
Will the Government please clarify this requirement?
Information in PWS 1.3r is correct. The contractor shall be responsible for ensuring Government is notified of updates to the sofware.
2.3.1.4.2
The Contractor is also responsible for periodic backups when the CDP IT office does not provide this function.
Will the Government please clarify this requirement? Is the CDP IT office currently conducting these backups? Who is currently providing these backups?
data backup support is provided by the CDP IT department.
2.3.1.4.3
The Contractor is responsible for retaining an adequate level of expertise to manage the control systems.
It is unclear in PWS Paragraph 1.3, 1.3.1, and
2.3.1.4.2 if and what the contractor is responsible for under the BAS. Will the Government please provide a detailed listing of the Contractor's responsibilities?
The Contractor is responsible for items/event referenced in the following PWS paragraphs:
2.3.1.4.3, 2.3.1.4.2, 1(b), 1(d), and 1(r)
2.3.1.4.4

New preventive maintenace schedule replaced attachment
2.3.1.4.4 Preventive Maintenance Plan/Schedule Is this the same requirement and preventive maintenance schedule requirement as identified in PWS Paragraph 2.3.1.4.1? Yes
2.3.1.9
Contractor participation in daily operations, exercises, planning, emergency response, recovery, and Continuity of Operations shall be mandatory regardless of scheduled Contractor work.
Will this requirement include the approval of and payment of overtime if required?
PWS Paragraph 2.3.1.3:
Overtime for personnel shall be pre-approved by the COR.
2.3.1.11
The Contractor shall tour major building equipment at set frequencies.
What are the "set frequencies" of these tours? Is this a redundant requirement since this information is already included in the Preventive Maintenance Schedule requirements in PWS Paragraph 2.3.1.4.4 and Section J Attachment 14?
