Rebuild Water Distribution System – USCG STA Fire Island, 1 Recue Road, Babylon, NY.

Sole Source Justification

PSN 6785128

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by FAR Subpart 6.3 and in accordance with the requirements of FAR 3.603-1, the justification for the use of the statutory authority under FAR Subpart 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows:

1. Agency and Contracting Activity - DHS, U.S. Coast Guard, CEU Providence, 475 Kilvert St Suite 100, Warwick, RI 02886.

2. Nature and/or Description of Action being Approved – Approval to procure materials described below within a Construction Contract for a maintenance project to:

Replace Site Water Lines – USCG STA Fire Island, 1 Recue Road, Babylon, NY.

on a basis other than Full & Open Competition (1 selected component).

3. Description of Supplies/Services – The specified meter monitoring equipment is an “Obvius” brand assembly of components and programming. This is a computer based monitoring/networking system connecting facilities station wide to monitor utility usage. Specifically to provide data acquisition and wireless metering components by Obvius (specifically wireless Modbus/Pulse Transceiver referred to herein as a “Modhopper”). One Modhopper will be installed to monitor water use for the station.

The estimated cost for the sole sourced Obvius equipment is presented below. Total project cost (IGE) is provided for reference.

Total Project IGE/ Cost Obvius Products

a. The sole source products are: Modhopper transceivers used to wirelessly collect information and transmit meter data.

4. Identification of Statutory Authority Permitting Other than Full & Open Competition - 10 USC 2304 (c)(1); (c) Application for brand name descriptions. An acquisition that uses a brand name description or other purchase description to specify a particular brand name, product, or feature of a product, peculiar to one manufacturer does not provide for full and open competition regardless of the number of sources solicited. It shall be justified and approved in accordance with FAR 6.303 and

6.304. The justification should indicate that the use of such descriptions in the acquisition is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company. See 5.102(a)(6) for the requirement to post the brand name justification. (Brand-name or equal descriptions and other purchase descriptions that permit prospective contractors to offer products other than those specifically referenced by brand name, provide for full and open competition and do not require justifications and approvals to support their use.): FAR 6.302-1.

5. Demonstration That the Nature of the Acquisition Requires Use of the Authority cited - The justification for the use of the sole source item is as follows:

a. This project specifies the installation of a remote transmitter to transmit daily usage information in accordance with the Coast Guard’s Advanced Metering Initiative. Station Fire Island has Obvius Monitoring equipment installed in their facilities.

b. Installation of equipment other than Obvius system components would result in a non-compatible system, and would impose a significant training/maintenance burden on Station Fire Island and negatively affect their ability to monitor utility usage.

Design Project Manager deems use of Obvius equipment to be in best interests of the Government.

6. Description of Efforts made to ensure that Offers are Solicited from as Many Potential Sources as is Practicable Other Sources that supply energy tracking equipment exist, but they are not compatible with the existing installed Obvius system.

7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable – The
