WORK RESTRICTIONS

1.1 SPECIAL SCHEDULING REQUIREMENTS AND WORK RESTRICTIONS

a. The work is subject to time restrictions herein specified and specified in the permits issued for the work included in Appendix A.

b. All dredging and disposal work shall be completed no later than March

23. In the event that the post-dredge survey indicates that the specified dredge limits have not been met then the Contractor shall use the remaining days left in the month to correct the deficiencies. No work is all allowed after March 31.

c. Have all equipment, personnel, and materials necessary to perform the work on site before beginning the work.

d. The work under this contract requires special attention to the scheduling and conduct of the work in connection with existing Coast Guard operations. Identify on the construction schedule each factor which constitutes a potential disruption to operations.

e. Conduct dredging operations so that navigation through the channel is possible at all times. Relocate and secure dredging equipment at the end of each work day away from the channel and areas of the mooring basin in use.

f. Dredging equipment is prohibited from operating on upland adjacent to the channel.

g. Except when the Coast Guard shoreline is designated as the disposal site, obtain permission from the owner(s) of the shoreline area designated to receive the dredged material if the Contractor’s disposal method requires access to the shoreline over private property. It is the Contractor’s responsibility to coordinate directly and reach agreement with the private property owners.

h. When the Coast Guard shoreline is designated as the disposal site: off loading and transporting the material is prohibited adjacent to the existing floating docks and steel sheet pile bulkheads. Land based equipment for spreading the material may access the shoreline over an existing asphalt drive and a sand area between the drive and shoreline.

Take precautions to protect the drive from damage and insure that the elevation of the sand at the end of the drive is not lowered. Lowering the elevation could cause a breech in the event of a strong storm/surge occurring at the same time as high tide. See Appendix B, Coast Guard Shoreline.

3 EXECUTION

3.1 PROTECTION OF NATURAL RESOURCES

Preserve the natural resources within the project boundaries and outside the limits of permanent work. Restore to an equivalent or improved condition upon completion of work. Confine construction activities to within the limits of the work indicated or specified

3.1.1 Land Resources

Do not remove, cut, deface, injure, or destroy trees or shrubs without the Contracting Officer's permission. Do not fasten or attach ropes, cables, or guys to existing nearby trees for anchorages unless authorized by the Contracting Officer. Where such use of attached ropes, cables, or guys is authorized, the Contractor shall be responsible for any resultant damage.

3.1.2.1 Oily and Hazardous Substances

Prevent oil or hazardous substances from entering the ground, drainage areas, or navigable waters. In accordance with 40 CFR 112, surround all temporary fuel oil or petroleum storage tanks with a temporary berm or containment of sufficient size and strength to contain the contents of the tanks, plus 10 percent freeboard for precipitation. The berm shall be impervious to oil for 72 hours and be constructed so that any discharge will not permeate, drain, infiltrate, or otherwise escape before cleanup occurs.

3.1.3 Fish and Wildlife Resources

Do not disturb fish and wildlife. Do not alter water flows or otherwise significantly disturb the native habitat adjacent to the project and critical to the survival of fish and wildlife, except as indicated or specified.

3.2 HISTORICAL AND ARCHAEOLOGICAL RESOURCES

Carefully protect in-place and report immediately to the Contracting Officer historical and archaeological items or human skeletal remains discovered in the course of work. Upon discovery, notify the Contracting Officer. Stop work in the immediate area of the discovery until directed by the Contracting Officer to resume work. The Government retains ownership and control over historical and archaeological resources.

3.3 CONTROL AND DISPOSAL OF SOLID WASTES

Pick up solid wastes, and place in covered containers which are regularly emptied. Do not prepare or cook food on the project site. Prevent contamination of the site or other areas when handling and disposing of wastes. At project completion, leave the areas clean. Recycling is encouraged and can be coordinated with the Contracting Officer and the activity recycling coordinator. Remove all solid waste (including non-hazardous debris) from Government property and dispose off-site at an approved landfill. Solid waste disposal off-site must comply with most stringent local, State, and Federal requirements including 40 CFR 241, 40 CFR 243, and 40 CFR 258.

ONTROL AND DISPOSAL OF HAZARDOUS WASTES

3.4.1 Management of Wastes

a. All material, whether hazardous or non-hazardous shall be disposed in accordance with all laws and provisions and all Federal, State or Local Regulations. Ensure all waste is properly characterized.

The result of each waste characterization (TCLP for RCRA materials) will dictate disposal requirements.

b. Contractor is responsible for segregation of waste. Label the containers in accordance with 40 CFR 262.

c. Dispose of material classified as hazardous waste at an EPA or State approved hazardous waste treatment, storage, or disposal facility off Government property.

d. Store waste materials in U.S. Department of Transportation (49 CFR

178) approved 208 liter 55 gallon drums. Properly label each drum to identify the type of waste (49 CFR 172) and the date the drum was filled. For hazardous waste, the collection drum requires marking/labeling in accordance with 40 CFR 262 during the accumulation/collection timeframe. The Contracting Officer or an authorized representative will assign an area for interim storage of waste-containing drums. Do not store hazardous waste drums in interim storage longer than 90 calendar days from the date affixed to each drum.

e. Handle, store, transport, and dispose hazardous waste in accordance with 40 CFR 260, 40 CFR 261, 40 CFR 262,40 CFR 263, 40 CFR 264, and 40 CFR 265. Comply with land disposal restriction notification requirements as required by 40 CFR 268.

Section 01 57 19 Page 8

3.4.2 Disposal Documentation

a. All paperwork required by the transporter and/or disposal facility, including waste profiles and the Hazardous Waste Manifest, must be submitted to the Contracting Officer or authorized representative for approval prior to the date of the scheduled removal.

b. All shipments of Hazardous Waste must be accompanied by a Uniform

Hazardous Waste Manifest and a Land Disposal Restriction Notification. The Coast Guard shall be listed as the Generator on all hazardous waste manifest. The Contractor will verify with the Contracting Officer that the Generator Name and Mailing Address in Box 3 of the manifest are correct. Only authorized Coast Guard personnel shall sign hazardous waste manifests. The Contracting Officer shall provide the name of the authorized signatory to the Contractor. The Coast Guard shall retain all original Generator copies of the manifest.

c. Submit written evidence to demonstrate the hazardous waste treatment, storage, or disposal facility (TSD) is approved for lead disposal by the EPA, State or local regulatory agencies. Submit one copy of the completed hazardous waste manifest, signed and dated by the initial transporter in accordance with 40 CFR 262.

Contractor shall provide a certificate that the waste was accepted by the disposal facility. [Provide turn-in documents or weight tickets for non-hazardous waste disposal.]

3.5 POLLUTION PREVENTION/HAZARDOUS WASTE MINIMIZATION

The Contractor shall actively pursue minimizing the use of hazardous materials and the generation of hazardous waste while on-site. The Hazardous Waste Management Section of the Environmental Protection Plan shall include the Contractor's procedures for pollution prevention/hazardous waste minimization. For preparing this part of the plan, the Contractor may consult the activity Environmental Office for suggestions and to obtain a copy of the installation's pollution prevention/hazardous waste minimization plan for reference material. If no written plan exists, the Contractor may obtain information by contacting the Contracting Officer. The Contractor shall describe the types of the hazardous materials expected to be used in the construction when requesting information.
