HSCG85-07-R-65BX146

Notice to Offerors

1. This is an unrestricted, competitive negotiated procurement for work to be performed within the coastal and estuarine region from the border between Texas and Mexico to Naples, FL. In order to be selected for award, offerors are required to submit written proposals consistent with the requirements of this solicitation. Source selection will be based upon a responsibility determination outlined in Section M.

2. In addition to the requirement to submit written proposals, the offeror must complete and complete all applicable items of this solicitation, with particular emphasis on Sections A, B, and K.

3. It is the offeror’s responsibility to ensure its proposal meet all solicitation requirements. Failure to provide all necessary information may result in a proposal being rejected or not receiving full consideration since the Coast Guard reserves the right to award a contract based upon initial proposals.

4. Offerors are advised that some of the technical descriptions provided in this solicitation are for informational use only. The Coast Guard does not warrant the accuracy of this information. This is the best information available to the Coast Guard and is provided to the offerors to assist them in preparing their competitive proposals.

5. Questions regarding this procurement shall be processed in accordance with Section L.11

NOTICE FOR FILING AGENCY PROTESTS

United States Coast Guard Ombudsman Program

It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO).

Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the Contracting Officer or Ombudsman.

Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the U.S. Coast Guard Ombudsman for Agency Protests. Under this informal process the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).

Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester’s concerns are unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103(d) (2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. To be timely protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be submitted to:

(2) General Liability: Bodily injury liability insurance coverage shall be written into the comprehensive form of policy of at least $500,000 per occurrence, and

Each certificate shall set forth that each policy of insurance represented thereby will expire on (DATE) and that each such policy contains the following clause:

H.2

COMPETITIVE ORDERING PROCEDURES

The specifications provided in this solicitation are as definitive as possible, but will require some update by the Coast Guard to reflect the actual technical requirements for a given cutter.

Each optional contract line item (CLIN) is associated with a composite labor rate and a lay day rate (for instance, CLIN 0002 is associated with sub-CLINs 0002A and 0002B for CGC JUNIPER’s drydocking ). The composite labor rate and lay day rate will be used in negotiating all prime contract labor costs involved in any changes to the given drydocking/decon package (see Special Contract Requirements H.3 and H.4).

Post-award, for given optional CLINs 0002 - 0007, the Coast Guard will issue a request for proposal to each of the awardees. The RFP will provide an updated specification, period of performance, proposal format and proposal deadline.

Price evaluation for competitive award of each drydocking/decon package will be accomplished by summing the proposed values of the CLIN and its two associated sub-CLINs. The lowest-priced proposal will be issued as an order under the contract.

H.3

COMPOSITE LABOR RATE

a.

The composite labor hour rate price in Section B shall be the sole labor hour rate used to price the prime contractor's burdened labor hours for all contract changes, whether within scope or new work. The contractor shall not receive any compensation in addition to this rate for prime contractor's direct labor associated with changes under this contract.

b.

The composite labor hour rate shall represent total compensation for the following: burdened labor (whether at a straight time, overtime or double time rate); any port or association fees, rents or other levies; all overhead and general and administrative costs and all direct and indirect costs and profit.

c.

The composite labor hour rate will be used to price only hardcore production labor hours, which are limited to include only those hours necessary and reasonable to perform direct hardcore production functions. The Composite Labor Rate shall include the cost of the support functions and personnel listed below, whether such support functions are normally charged directly or indirectly in the contractor's accounting system. Such support functions shall not be separately compensated.

This clause shall not affect the other rights of the parties under FAR 52.243-1, CHANGES-FIXED PRICE (AUG 1987)(ALT II)(APR 1984), including the right of the Contracting Officer to issue unilateral change orders, and the right of the contractor to request equitable adjustment.

e.

The quoted composite labor hour rate for sub-CLINs 0002A, 0003A, 0004A, 0005A, 0006A and 0007A will be incorporated as part of order for the respective CLINs. The quantity of hours indicated in sub-CLINs 0002A, 0003A, 0004A, 0005A, 0006A and 0007A of Section B are representational estimates only, and the extended price will be used to perform price analysis for competitive order awards on each CLIN. The estimated quantity of hours per CLIN (1,000) is the Government's best estimate of the total number of hours that might be required for growth work on a given drydocking. The actual number of hours may be greater or less.

H.4

LAY DAYS (HSAR 3052-217-94)

a.

Lay day time will be paid by the Government at the Contractor's stipulated bid price for this item of the contract when the vessel remains on the dry dock or marine railway as a result of any change that involves work in addition to that required under the basic contract.

b.

No lay day time shall be paid until all items of the basic contract for which a price was established by the Contractor and for which docking of the vessel was required have been satisfactorily completed and accepted.

c.

Days of hauling out and floating, whatever the hour, shall not be paid as lay day time, and days when no work is performed by the Contractor shall not be paid as lay day time.

d.

Payment of lay day time shall constitute complete compensation for all costs, direct and indirect, to reimburse the Contractor for use of dry dock or marine railway.

Additional not in HSAR clause:

The quoted composite lay day rate for sub-CLINs 0002B, 0003B, 0004B, 0005B, 0006B and 0007B will be incorporated as part of order for the respective CLINs. The quantity of lay days indicated in sub-CLINs 0002B, 0003B, 0004B, 0005B, 0006B and 0007B of Section B are representational estimates only, and the extended price will be used to perform price analysis for competitive order awards on each CLIN. The estimated quantity of lay days per CLIN (10) represents the Government's best estimate of the total number of lay days that might be required. The actual number of lay days may be greater or less.

H.5

CONTRACTOR PERFORMANCE EVALUATION

a.

The contractor's performance will be evaluated throughout the contract period in accordance with FAR 42.15. The results will be compiled and reported in a Contractor Performance Evaluation by SFLC for use by this agency and other government agencies on future source selection decisions. The areas to be evaluated are:

Quality of Product or Service

Business Relations

Timeliness b.

Each area will be evaluated using the following scale: Outstanding (5), Excellent (4), Good (3), Fair (2), Poor (1) and Unsatisfactory (0).

c.

The results of the report will be provided to the contractor who will be provided thirty (30) days to review and provide comments. All comments will be considered by the Contracting Officer and reviewed in accordance with FAR 42.1503. The report will be marked "Source Selection Information" and safeguarded for official use only in accordance with Federal Acquisition Regulation Part 3.104.

d.

A copy of the Contractor Performance Report template is available upon request.
