Justification for Other Than Full and Open Competition Under 10 U.S.C. 2304 (c)(1)
Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements
Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by Federal Acquisition Regulation (FAR) Subpart 6.3, and in accordance with the requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows:
1. Agency and Contracting Activity.
The Department of Homeland Security (DHS), United States Coast Guard (USCG), Shore Infrastructure Logistics Center (SILC) proposes to enter into a contract on a basis other than full and open competition.
2. Nature and/or description of the action being approved.
The U.S. Coast Guard has a requirement on a sole source basis for Emergency Lodging Services (i.e., berthing, conference rooms, private office spaces, and vehicle parking) for Sector New Orleans (NOLA) at an estimated minimum cost of $5,000.00 per year (minimum guarantee), not to exceed $1,900,000.00 for 5 years.
List the name and address of the proposed contractor(s):
SELEX Galileo, Inc. (SELEX) Integration and Security Assistance Support Center (SASC) 13995 Fred & Al Key Road Stennis International Airport Kiln, Mississippi 39556
DUNS: 188880335
3. Description of Supplies/Services.
The requirement is to provide emergency lodging services (i.e., berthing, conference rooms, private office spaces, and vehicle parking) for Sector New Orleans personnel to stand up a Continuity of Operations (COOP) site in the event of a severe hurricane. The lodging facility must be geographically located within 100 miles of the Port of New Orleans.
Minimum Amount Estimated Maximum Amount Base Period $5,000.00 $380,000.00 Option Period 1 $5,000.00 $380,000.00 Option Period 2 $5,000.00 $380,000.00 Option Period 3 $5,000.00 $380,000.00 Option Period 4 $5,000.00 $380,000.00
TOTAL $25,000.00 $1,900,000.00
4. Identification of Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is 10 U.S.C.
2304(c)(1), implemented by FAR Subpart 6.302-1 entitled “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”.
5. Demonstration That the Nature of the Acquisition Require Use of the Authority Cited.
The requirement is to provide emergency lodging services (i.e., berthing, conference rooms, private office spaces, and vehicle parking) for Sector New Orleans personnel to stand up a Continuity of Operations (COOP) site in the event of a severe hurricane; the lodging facility must be geographically located within 100 miles of the Port of New Orleans. The COOP site will serve as lodging, command center, and safe haven for sector personnel during a potential major hurricane that would endanger life and property and would require the evacuation of the Sector New Orleans buildings and/or the New Orleans metropolitan area. The U.S. Coast Guard will have the “first right” to use the facility/services in the event of a severe hurricane that affects the Gulf Coast, resulting in evacuation of Coast Guard facilities in New Orleans, LA.
SELEX is the only known responsible source located within 100 miles of the Port of New Orleans that can accommodate all Sector New Orleans’ logistical needs in order to properly lead U.S. Coast Guard post hurricane/COOP operations, i.e., provide conference rooms, adequate berthing, offices, and controlled access spaces in an environment rated to withstand Hurricane Condition IV (130-156 mph winds). The SELEX SASC facility was built to be a flexible base for training and operations designed to support a range of missions. The facility’s strategic location close to the Gulf Coast and security features also present an ideal location from which to stage emergency response training and operations. When Hurricane Katrina hit in 2005, the current site of the SASC was operational within 24 hours. The SELEX SASC offers a dedicated emergency operations center perfect for preparation before a storm hits and incident management when and after a storm hits. The facility itself has in-house billeting for 40, but the site can support a crew of up to 500 people in the event of a storm.
Other known facilities fail to meet the requirement because although they can provide berthing rooms, they cannot meet the conference room, parking space, and/or secure space requirements. Also, many lodging facilities do not want to displace their registered guests to accommodate the U.S. Coast Guard in the event of a major hurricane.
6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.
A FedBizOpps notice of Intent to Sole Source will be publicized before a solicitation is issued, as required by FAR 5.2; all responsible sources will be given the opportunity to submit an offer.
7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable.
The Contracting Officer has determined that the anticipated price(s) can be determined fair and reasonable based on commercial pricelists and/or per diem rates in the area.
8. Description of Market Research.
This requirement was previously solicited under solicitation HSCG84-14-Q-BB8057.
Sources sought notice HSCG84-14-I-BB8057 was issued on October 30, 2013 and closed on November 15, 2013. Only one source (Ramada Houma) responded to the sources sought notice. The requirement was posted on FedBizOpps on January 14, 2014 for 30 days under solicitation HSCG84-14-Q-BB8057. The solicitation was amended three times to extend the offer due date because no offer were received; the solicitation finally expired on March 21, 2014. Because the original solicitation was written for hotel type services, SELEX Galileo, Inc. did not submit an offer since the company does not provide hotel type services, e.g., private lodging rooms, private bathrooms, room service, etc.
Market Research in the form of internet searches was conducted by the requestor; three facilities that provide hotel services within 100 miles of the Port of New Orleans were contacted to verify if services could be provided. All three verified that although they could provide berthing rooms, they could not meet the conference room, parking space, and/or secure space requirements. Also, many lodging facilities did not want to displace their registered guests to accommodate the U.S. Coast Guard in the event of a major hurricane.
Competition was sought to the fullest extent possible with no success and after multiple attempts to find another source; no other contractor has been identified to fulfill the requirement.
9. Any Other Facts Supporting the Use of Other Than Full and Open Competition.
The U.S. Coast Guard currently has contract HSCG84-11-D-AAS213 with Preferred Hospitality, LLC (Radisson Hotel Baton Rouge) to provide emergency lodging services for Sector New Orleans; however, after conducting drills and exercises at the facility, the hotel does not meet Sector New Orleans’ needs to sustain operations. Below outlines some of the reasons why the Radisson Hotel Baton Rouge no longer meets Sector New Orleans requirements:
(a) The Radisson is too small to allow the Incident Command Post’s (ICP) footprint to expand. During major responses, Sector NOLA will need additional rooms for break-out meetings, a Joint Information Center, etc. The Radisson can only provide us with two conference rooms.
(b) The Radisson does not provide sufficient floor space; additional floor space is required to welcome other government agencies to join the response management efforts for many COOP scenarios.
(c) The Radisson conference rooms cannot receive outside phone calls, therefore mariners in distress, higher-level commands, and responders cannot place calls into the ICP. All incoming calls are received by the Radisson’s front desk. Therefore, hotel clerks would operate as primary dispatchers and potentially urgent response-related calls might compete with hotel reservation calls for priority.
(d) During a COOP scenario, Sector NOLA would require ample parking. The Radisson has very limited parking available and the parking lot is susceptible to flooding during rain storms. The parking lot floods during summer rain storms (as it did during the June 2013 Operation Poseidon exercise), which consequently means a high probability of flooding during hurricanes.
10. A Listing of the Sources, if Any, That Expressed, in Writing, an Interest in the Acquisition.
When sources sought notice HSCG84-14-I-BB8057 was issued on October 30, 2013, only Ramada Houma responded to the sources sought notice; however, Ramada Houma did not submit an offer in response to solicitation HSCG84-14-Q-BB8057.
11. A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for Supplies or Services Required.
The government will continue to conduct market research in an attempt to identify other facilities that could possibly meet this requirement in the future. It is anticipated that the Coast Guard will look into leasing, purchasing, or building facilities specifically designed to meet the particular need for the unit to respond to natural and man-made disasters.
12. Contracting Officer’s Certification.
I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
Wendy J. Culbreth Date Contracting Officer
13. Technical/Requirements Personnel Certification.
I certify this requirement meets the Government’s minimum need and that the supporting data, which forms a basis for this justification, is complete and accurate.
Felisha M. DeCastro, CWO2 Date Technical Representative or COR
