NOTICE FOR FILING AGENCY PROTESTS

It is the policy of the Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the General Accounting Office (GAO).

Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum, rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the contracting officer or Ombudsman.

Informal forum with the Ombudsman. Interested parties who believe that a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the cognizant contracting officer. If the contracting officer is unable to satisfy the concerns, the interested party is encouraged to contact the USCG Ombudsman for Agency Protests. Under this informal process, the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum.

In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, contracting officer, and solicitation closing date (if applicable).

Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the contracting officer through open and frank discussions. If the protester‘s concerns are unresolved, an independent review is available by the Ombudsman. The protester may file a formal agency protest to either the contracting officer or as an alternative to that, the Ombudsman under the OPAP program.

Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency‘s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth at FAR 33.103. If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. This will not preclude re-filing of the protest to meet the requirement. To be timely, protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be forwarded to the address below:

Performance Work Statement for Bleacher Rental and Setup at the US Coast Guard Academy, New London, Connecticut

1.0 General

1.1 The contractor shall provide all labor, material, equipment, transportation and supervision to furnish, assemble, disassemble and remove portable bleacher systems for the US Coast Guard Academy Commencement Ceremonies for the years of 2012 through 2016. The contractor shall temporarily increase the seating capacity of the USCG Academy‘s Cadet Memorial Field from its existing 2500 capacity to as large as approximately 5000 seats using a combination of the existing and rented bleacher systems. The contractor shall provide a seamless and transparent interface of the rented bleacher system and permanently installed bleacher system. The ability to interchange rented bench seating with upgraded flip-up/tip-up 20 inch seating and/or removal to accommodate wheelchair access will be required. The Coast Guard Academy Commencement Ceremony is typically scheduled for the 3rd Wednesday in the month of May.

The rented bleachers system shall be installed, freshly cleaned/painted, operational and protected from weather prior 4:00 p.m. on the 2nd Monday in the month of May. All contractor owned bleacher systems and equipment can be removed on or after the 3rd Thursday in the month of May. All contractor owned bleacher systems and equipment shall be completely removed from Coast Guard Academy property no later than the 4th Friday in the month of May.

All equipment, supplies and workmanship shall meet or exceed the BOCA National Building Code, Uniform Building Code, International Building Code, Uniform Fire Code, and National Fire Protection Association standards.

Historically, the guest speakers for Coast Guard Academy Commencement Ceremonies are high ranking officials of the U. S. Government and at times include the President of the United States, the Vice President of the United States, the Secretary of Homeland Security and the Commandant of the United States Coast Guard. As such, the Commencement Ceremony may receive national media coverage.

1.1.1 POC for this contract is:

POC: Charles Shaffer Assistant Public Works Officer Phone: (860) 444-8554 Fax: (860) 444-8563 E-mail: Charles.Shaffer@uscg.mil

1.1.2 Site Address:

U.S. Coast Guard Academy 15 Mohegan Avenue New London, CT 06320

STANDARD FOR 1449 RFP: HSCG84-12-R-AA1411 9 of 55

1.2 Project Outline: The contactor shall supply and temporarily increase the seating capacity of the USCG Academy‘s Cadet Memorial Field bleacher system from the existing 2500 seats to as large as approximately 5000 seats.

1.2.1 Rented Portable Bleachers: To add approximately 2500 seats, the contractor shall provide a seamless and transparent interface of the contractor supplied temporary portable bleacher system as large as approximately 2000 seats with the government‘s existing 2500 seat installed bleacher systems and the contractor shall furnish and assemble two free-standing seating pods of approximately 250 seats per pod or the contractor shall assemble two government furnished seating pods of 246 seats per pod. The ability to interchange rented bench seating with upgraded flip-up/tip-up 20 inch seating and/or removal to accommodate wheelchair access will be required as described below.

The government intends to provide the contractor as much lead time possible in determining the government‘s final configuration of all temporary bleachers. The government will provide its final configuration to the contractor approximately one month before the commencement date. With flip-up/tip-up seating, the government understands that the overall seating capacity may be reduced by as many as 200 seats.

1.2.2 CLIN X0001: To furnish an additional 2000 seats, the government anticipates that the contractor will need to assemble temporary bleachers in sections A1, B1, C1, D1, E1, F1 and G1 as detailed in Technical Exhibit 3 (TE3). In order to accommodate the changing number of potential attendees, the government has established a base bid for the contractor to provide bench seating in sections C1, D1, and E1, the bottom two rows will require flip-up/tip-up 20 inch wide seating. The base bid shall include the government‘s requirement detailed in paragraphs

1.2.2.1 through 1.2.2.3 below.

1.2.2.1 Regardless of the final number of seating sections assembled, the bottom two rows of all sections shall require flip-up/tip-up seating for the purpose of accommodating wheelchair-bound guests and their companion(s). Therefore, the bleacher deck plates at the bottom row should be at or near ground level to allow wheelchairs to closely align with the first row of seating.

1.2.2.2 Centered in the body of the rented bleachers shall be a media riser/camera platform.

The dimensions of this platform will vary depending on the level of anticipated national media coverage. Historically, the media platform for a Commencement Ceremony involving the President of the United States or the Vice President measured 5 feet deep by 48 feet long. The dimensions for ceremonies involving other guest speaker measure 5 feet deep by 24 feet long.

This press platform shall be placed on the top 2 rows, abutting the existing grandstand, in the center of section D1 of the bleachers, see TE 3.

1.2.2.3 Vinyl or fabric coverings for the ends of the bleachers shall be provided and installed by the contractors. The end coverings shall be fabricated to neatly fit the profile of the installed bleachers and shall present a neat, professional appearance. Custom fabricated end panels may be required to achieve the fit that is required.

1.2.3 CLIN X0002: CLIN X0002 shall be based upon the contractor providing additional bench seating in Sections B1 and F1 as detailed in TE 3.

STANDARD FOR 1449 RFP: HSCG84-12-R-AA1411 10 of 55

1.2.4 CLIN X0003: CLIN X0003 shall be based upon the contractor providing additional bench seating in Sections A1 and G1 as detailed in TE 3.

1.2.5 CLIN X0004: The government may elect to require all bench seating, a combination of bench seating and flip-up/tip-up seating, or all flip-up/tip-up seating. CLIN X0004 shall be based upon the contractor providing flip-up 20 inch seating for each of the 7 sections (A1 through G1).

If the government elects a combination of bench seating and flip-up seating, the final configuration will remain symmetrical with the flip-up seating centered between the sections of bench seating. To further illustrate the government‘s intention, CLIN X0004 is broken down as follows:

a. Flip-up seating for section D1 only

b. Flip-up seating for sections C1, D1 and E1.

c. Flip-up seating for sections B1, C1, D1, E1 and F1.

d. Flip-up seating for all 7 sections, A1 through G1.

The government will select the color of the flip-up/tip-up seating after receipt of the contractor‘s submittal as required by paragraph 3.3.2, below. The government recognizes that the shade of the color selected may vary slightly due to varying lots of paint and other conditions such as sun fading/bleaching. When installing the flip-up/tip-up seating, the contractor shall sort and install the seat by shade to avoid the appearance of a checkered board effect.

1.2.6 CLIN X0005: The contractor shall furnish and assemble up to two free-standing modular bleacher systems. Each shall provide a seating capacity for approximately 250 individuals.

These modular bleacher systems shall be of substantially similar appearance to the other rented bleacher systems detailed above. Each unit shall be outfitted with 20‖ wide flip-up/tip-up style seating. The bottom row of the pod shall be at least 42‖ above grade to provide optimum viewing for individuals. Each pod shall be equipped with two sets of stairs to provide two paths of access and egress. The maximum overall length and depth of the each unit shall be no more than 25 feet in depth and 70 feet in length. All exposed openings (front, sides & back) to these bleacher system shall be covered using a blue covering so that patrons cannot crawl or see through, behind or under the bleachers. The end coverings shall be fabricated to neatly fit the profile of the installed bleachers and shall present a neat, professional appearance.

1.2.7 CLIN X0006. The government owns a sufficient quantity of portable bleacher components (Ultimate Seating bleacher system) to assemble two free-standing modular bleacher systems that provide a seating capacity of 246 individuals per unit. The bleacher components are either assembled at various locations on the Academy, in storage onboard the Academy, or both. The contractor shall disassemble, relocate and re-assemble the components into one or two free-standing modular bleacher systems to provide a seating capacity 246 seats each. Upon the completion of Commencement, the contractor shall return the bleacher components to their original location and configuration. See Technical Exhibit 4 for the various locations of the government owned portable bleacher components.

STANDARD FOR 1449 RFP: HSCG84-12-R-AA1411 11 of 55

1.3 Location

1.3.1 Rented Bleachers shall be delivered to and assembled on Cadet Memorial Field as indicated on attached field layout drawing, Technical Exhibit (TE)1.

1.4 Delivery Schedule

1.4.2 Rented bleachers can be delivered no earlier than the 1st Monday in the month of May and shall be in place and fully usable prior to 4:00 p.m. on the 2nd Monday in the month of May. The bleachers can be removed no earlier than the 3rd Thursday in the month of May and must be completely removed by the 4th Friday in the month of May.

1.5 General Notes

1.5.1 Site Visit: A site visit is strongly encouraged, but not required.

1.5.2 Drawing Accuracy: Care was taken to accurately portray the site conditions; however, the contractor is responsible to field verify all measurements. A site map and Cadet Memorial Field Layout and Reference Drawings are provided as Technical Exhibits 1 and 2 (TE1 and

TE2).

1.5.3 Protection of Cadet Memorial Field: The bleachers in this contract are to be placed on Cadet Memorial Field‘s FieldTurf ™ playing surface that was constructed in 2004. This surface must be protected from all damage (including permanent depressions) during the installation, use, and removal of all materials required under this contract. In addition, only vehicles with turf style tires will be allowed on the surface. The contractor is solely responsible for repairing any and all damage caused to this field and may be held further responsible if the FieldTurf TM warranty is voided.

1.5.3.4 Plywood underlayment used shall be minimally visible when installation is complete. To minimize visibility of plywood underlayment, the contractor has the option to paint the edges of the plywood green to blend in with the turf. Rework may be necessary if plywood is visible and the Government POC for this contract determines that the exposed plywood creates an unprofessional appearance.

1.5.4 Quality/Condition of Rental Bleachers: The materials to be rented by the government under this contract shall be in ―like new‖ condition (cleaned, painted, and operational) prior to delivery to the Academy. Coast Guard Academy Commencement Ceremonies often attract significant national media attention. Thus, the condition of the rental equipment shall closely resemble that of newly purchased bleachers.
