USCG Large Cutter Ku-Band Services J&A 06/01/2018
Source Selection Information – see FAR 2.101 and 3.104
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.3 and in accordance with the requirements of FAR 6.302-1, the justification for the use of the statutory authority under FAR Subpart 6.3 is justified by the following facts and rationale under FAR 6.302-1 as follows:
1. AGENCY AND CONTRACTING ACTIVITY:
The contracting agency is the U.S. Department of Homeland Security (DHS), United States Coast Guard (USCG), Command, Control, Communication, Computers, and Information Technology (C4IT) Service Center, Contracting and Procurement Division (CPD), 7323 Telegraph Road, Stop 7340, Alexandria, VA 20598-7340.
2. NATURE/DESCRIPTION OF THE ACTION:
It is the intent of the U.S. Coast Guard (USCG) to modify contract HSCG79-17-C-PTH032 to extend the period of performance an additional six months ( ) in accordance with FAR Clause 52.217-8, Option to Extend Services. The initial period of performance of this contract is from to . This period of performance consists of one (1) six (6) month Base Period, and one (1) six (6) month Option Period.
FAR 52.217-8 was included in the contract but the prices were not included in the price evaluation at time of award.
The USCG (C4IT) Service Center has an ongoing requirement for Ku-Band airtime, bandwidth and support services provided for USCG Large Cutters from the following classes:
. These services are currently being procured under contract HSCG79- 17-C-PTH032, which was awarded on a sole-source basis to Segovia Incorporated (doing business as (dba) Inmarsat Government), 11600 Sunrise Valley Drive, Suite 200, Reston, VA 20191-1410, on September 25, 2017. The proposed six-month extension to the period of performance of HSCG79-17-C-PTH032 will be funded through the
. As stated in the IGCE, the estimated cost for the services is $ for the six-month period of performance. A forthcoming competitive solicitation will be issued for a follow-on task order to provide Ku-Band Commercial Satellite (SATCOM) Services for USCG Large Cutters and Mobile Assets. The Contracting Officer intends to extend the current contract period of performance to allow sufficient time for solicitation, evaluation, award, and a period of ninety (90) days (following award) to transition service from the incumbent to the new vendor.
Exercising the option to extend services under FAR 52.217-8 will provide for continuity of Ku- Band SATCOM services for the USCG Large Cutter Fleet until the forthcoming follow-on task order for Ku-Band SATCOM Services for USCG Large Cutters and Mobile Assets is solicited and awarded on a competitive basis. The USCG intends to make award during , so as to allow for a ninety (90) day transition period between the current contractor and a new contractor. The purpose of allowing for a ninety (90) day transition period is to ensure continuity of service during successful transition prior to the end of the period of performance of the 52.217-8 option period (which would be on ). During the 90-day transition period following award of the follow-on task order, the USCG will order new terrestrial data circuits to connect to the winning vendor’s network and install equipment to connect this service to the Coast Guard’s unclassified enterprise data network, CGONE. Provisioning new circuits can take up to 60 days, and transitioning Large Cutters between service providers will require one-on-one work between the two vendors and the USCG to reconfigure the satellite terminal on each Large Cutter. As such, a period of ninety (90) days is required to provide the amount of time necessary to allow for a successful transition between the current contractor and a new contractor. It is the USCG’s belief that a six (6) month contract extension would be the most advantageous to the USCG to maintain Cutter communications and continue the USCG mission without disruption.
3. DESCRIPTION OF SUPPLIES/SERVICES:
The USCG Telecommunications and Information Systems Command (TISCOM), Networks Product Line (NET-PL), Remote Internet and Microwave Branch (RIMB) is the requiring office that obtains supplies and services necessary to support the USCG’s Cutter Connectivity capability.
The services provided under the current contract (HSCG79-17-C-PTH032) enable the class USCG Large Cutters and the to connect to the USCG’s unclassified enterprise data network (CGONE) using a high-speed Ku-Band Commercial Satellite (SATCOM) service. In developing its requirement to provide high-speed Ku-Band SATCOM connectivity to the USCG Large Cutter fleet, TISCOM-NET-PL-RIMB chose the approach of employing a three (3) satellite Ku-Band network that provides SATCOM coverage and service in the USCG’s primary mission operation areas; . Two SATCOM teleports or ‘downlinks’ support the 3-satellite constellation. Each teleport has USCG controlled Multi-Protocol Labeled Switching (MPLS) routers and circuits that backhaul the USCG Ku-Band cutter connections to CGONE. The Ku-Band architecture is closed and used exclusively by the USCG. The USCG purchases bulk bandwidth for each satellite network and shares it amongst mobile users (i.e., USCG Large Cutters) within the satellite coverage region. Inmarsat Government Incorporated provides a Network Operations Security Center (NOSC) that monitors the USCG Large Cutters and teleport operations, to ensure Ku-Band SATCOM service meets requirements and provides SATCOM network support to USCG TISCOM. Inmarsat Government Incorporated, as the current incumbent, will continue to be responsible for the continued support for Ku-Band SATCOM connectivity for the USCG Large Cutter fleet. The period of performance for the option to extend services under FAR 52.217-8 is from
. The corresponding dollar amount required to fully fund the exercise of the option to extend services under 52.217-8 is $ .
The following table provides the Contract Line Item Number (CLIN) structure, description of services provided under each CLIN, quantities, period of performance (PoP), and dollar amount estimated for each:
4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER
THAN FULL AND OPEN COMPETITION:
This acquisition is being conducted under the authority of 10.U.S.C. 2304(c)(1), as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 titled “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; specifically FAR 6.302-1(a)(2)(iii)(B).
5. DEMONSTRATION THAT THE NATURE OF THE ACQUISITION
REQUIRES USE OF THE AUTHORITY CITED:
The USCG requires continued Ku-Band Service for Large Cutters. Inmarsat Government Incorporated is the current incumbent contractor providing this support. The scope of services provided by the incumbent under this contract is Ku-Band Airtime, Bandwidth, and Support Services for the USCG Large Cutter fleet.
As the incumbent, Inmarsat Government Incorporated is the only company with the necessary knowledge and expertise to provide the services for the extended period of performance without the USCG experiencing unacceptable delays in fulfilling its requirements. Further, the USCG also does not have the resources to run two source selections; one for the follow-on contract and one for the six (6) month extension.
6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED
PRACTICAL:
In accordance with the exception provided at FAR 5.202(a)(11), synopsis and posting to the GPE is not required for the proposed contract action, as the proposed contract action is made under the terms of an existing contract (HSCG79-17-C-PTH032) that was previously synopsized in sufficient detail to comply with the requirements of FAR 5.207 with respect to the current proposed contract action. The forthcoming follow-on task order for Ku-Band SATCOM Services for USCG Large Cutters and Mobile Assets, will be solicited under FAR 16.505, and will be competed among the vendors currently holding contracts under GSA’s CS3 IDIQ contract, providing vendors under CS3 with a fair opportunity to compete for award of a task order for the USCG’s requirement for Ku-Band SATCOM services.

7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND
REASONABLE:
The Contracting Officer has determined that the pricing under the FAR 52.217-8 option period will be the same pricing in effect under the current Period of Performance. The pricing for the current Period of Performance was determined fair and reasonable upon award utilizing techniques in accordance with FAR 15.404(b)(2).
8. DESCRIPTION OF MARKET RESEARCH:
Market research was conducted prior to award of HSCG79-17-C-PTH032. Market research has been conducted for the follow-on requirement. Extending the period of performance of HSCG79-17-C-PTH032 by six months under the FAR 52.217-8 option to extend services will allow for a sufficient amount of time to provide for the competitive solicitation of the follow-on requirement through the U.S. General Services Administration (GSA) Complex Commercial SATCOM Solutions (CS3) multiple-award, indefinite-delivery/indefinite-quantity (IDIQ) contract. Through market research conducted for the follow-on requirement, competing and awarding a task order for the follow-on requirement under the GSA CS3 IDIQ Contract was determined to be the best procurement approach for meeting the full scope of services incorporated in the follow-on requirement.
9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL
AND OPEN COMPETITION:
